Marriage Equality For Same-Sex Couples: Where We Are And Where We Are Going, Jennifer Levi Jan 2009

Marriage Equality For Same-Sex Couples: Where We Are And Where We Are Going, Jennifer Levi

Faculty Scholarship

The legal landscape for same-sex couples seeking to marry has shifted dramatically over the last five years. On October 10, 2008, the Connecticut Supreme Court became the third state high court to rule that its state constitution could not sustain a statutory framework that excludes same-sex couples from marrying, following the Massachusetts Supreme Judicial Court on November 18, 2003, and the California Supreme Court on May 15, 2008. Same-sex couples throughout the country have gotten married in Connecticut, Massachusetts, California, and in other countries throughout the world that provide full marriage equality, including in Canada. The Author discusses the developments …

Symposium: Defining Race: Colorblind Diversity: The Changing Significance Of "Race" In The Post-Bakke Era, Bridgette Baldwin

Faculty Scholarship

In 1954, fifty-eight years after the Plessy v. Ferguson decision, the Supreme Court was afforded another opportunity to reverse the “separate but equal doctrine” in Brown v. Board of Education of Topeka (Brown I). Brown I was a consolidation of five civil rights cases from the District of Columbia, Delaware, Kansas, Virginia, and South Carolina that attempted to change race relations in America by affording African Americans a piece of the pie. A few other cases soon followed Brown I. In 1963, Goss v. Board of Education of Knoxville proclaimed that any program that structurally appeared to maintain segregation would …

A Multi-State Evaluation Of The Factors Predicting Educational Achievement Of Adult Foster Care Alumni, Markell Harrison-Jackson Jan 2009

A Multi-State Evaluation Of The Factors Predicting Educational Achievement Of Adult Foster Care Alumni, Markell Harrison-Jackson

Graduate Student Dissertations, Theses, Capstones, and Portfolios

Child maltreatment, a major public-health concern in the United States, has the most detrimental impact on adult emotional and physical development. According to the urban Institute, in the past decade foster-care expenditures for child maltreatment totaled $14.4 billion. Each year, 30,000 alumni "age out" of foster care. These are alumni who exit the foster-care system only because they reach the age of 18, not because they are reunited with their families, are adopted, or leave to attend college. Prior longitudinal research has shown that the nearly 80% of the alumni who are emancipated at the age of 18 failed to …

Predictors Of Pedestrian Injury Risk In Children With Attention-Deficit/Hyperactivity Disorder, Combined Type, Despina Stavrinos Jan 2009

Predictors Of Pedestrian Injury Risk In Children With Attention-Deficit/Hyperactivity Disorder, Combined Type, Despina Stavrinos

All ETDs from UAB

Unintentional injury is the leading cause of pediatric mortality, killing more children than the next 20 causes of death combined. In middle childhood, the second leading cause of unintentional injury is pedestrian injury. One group at particular risk of pedestrian injury is children with ADHD-Combined Type (ADHD-C). It is unknown why children with ADHD-C may be at elevated risk for pedestrian injury. The objective of the proposed research was to explore the underlying mechanisms for pedestrian injury risk in children with ADHD-C. We employed the ethically viable tool of virtual reality (VR) to measure the pedestrian behavior of 78 children …

Biological Characterization Of Fc Receptor-Like 6 (Fcrl6), Daniel M. Schreeder Jan 2009

Biological Characterization Of Fc Receptor-Like 6 (Fcrl6), Daniel M. Schreeder

All ETDs from UAB

Members of the Fc receptor-like (FCRL) family are cell-surface proteins with ancient conservation, distinct lymphocyte expression patterns, and tyrosine-based signaling capa-bilities that imply a fundamental role for them in modulating immune responses. Though they share many features with the Fc receptors (FCR) for IgG and IgE, FCRLs have not been found to bind immunoglobulin. In these studies, we sought to characterize the cellu-lar expression pattern, binding partner, and function of a recently identified FCRL family member, human FCRL6. By developing specific monoclonal antibodies (mAbs) we determined that FCRL6 is dis-tinctly expressed by cytotoxic lymphocytes, namely NK cells, CD8+ T cells, …

Three reasons to review accumulating data in clinical trials include: ethical issues, financial concerns and administrative concerns. Interim analysis is a good way to monitor accumulating data in clinical trials. Interim analysis allows for the possibility that a study may be terminated early; that is, if the currently observed data convincingly favor the null or the alternative hypothesis then the study ends early. In addition, many clinical trials are conducted to compare a treatment group to a standard group on multiple endpoints. Combining interim analyses with multiple endpoints allows for more information to be provided from the trial than either …

Analysis Of The Malaria Vaccine Potential Of Plasmodium Falciparum Merozoite Surface Protein-3, Stephen James Jordan Jan 2009

Analysis Of The Malaria Vaccine Potential Of Plasmodium Falciparum Merozoite Surface Protein-3, Stephen James Jordan

All ETDs from UAB

Malaria causes an estimated 1-3 million deaths each year, with the majority of deaths being a result of infection with Plasmodium falciparum. No commercially available vaccine currently exists, but multiple subunit-based vaccines are in development including one based on the promising vaccine candidate P. falciparum Merozoite Surface Protein-3 (PfMSP3). PfMSP3 varies in sequence between P. falciparum isolates, but all variation is restricted to the N-terminal domain. This observation has lead to the development of a PfMSP3-based vaccine comprised solely of the highly conserved, yet poorly immunogenic, C-terminal domain. The rationale for supporting the C-terminal domain relies entirely on its conserved …

Development Of An Instrument To Assess The Predisposing Factors Of Sun Protection With Adolescent Athletes: An Exploratory Mixed Methods Study, Jason S. Fulmore

All ETDs from UAB

Purpose: In 2005, one in three cancers worldwide was skin-related with an estimated 132,000 malignant melanoma and more than three million non-melanoma cancers. The primary cause of photocarcinogenesis is exposure to ultraviolet radiation. Seven million secondary school students who participate in athletics annually and their coaches are at elevated risk for ultraviolet radiation. The purpose of this study was to use a two-phase sequential exploratory mixed methods design to explore adolescent athletes' views about sun protection and skin cancer. Method: Two research questions guided the study: (a) what factors affect adolescent athletes' knowledge, outcome expectations, and behaviors of sun protection; …

Oxidative Stress-Stimulated Vascular Calcification, Chang Hyun Byon Jan 2009

Oxidative Stress-Stimulated Vascular Calcification, Chang Hyun Byon

All ETDs from UAB

Oxidative stress plays a critical role in pathogenesis of atherosclerosis. However, the effect of oxidative stress-induced molecular signaling in development of vascular calcification, a feature of advanced atherosclerosis, has not been defined. Osteogenic differentiation of vascular smooth muscle cells (VSMC) is critical in development of vascular calcification. We determined hydrogen peroxide (H2O2)-induced oxidative stress promoted a phenotypic switch of mouse primary VSMC from contractile to osteogenic phenotype. This effect was associated with increased expression and transactivity of Runx2, a key transcription factor for osteogenic differentiation. Inhibition of Runx2 using short hairpin RNA blocked oxidative stress-induced VSMC calcification. By contrast, adenovirus-mediated …

Intracellular Trafficking Of The Hantaviral Nucleocapsid Protein And Its Function In Modulation Of Immune Signaling, Steven Joe Ontiveros Jan 2009

Intracellular Trafficking Of The Hantaviral Nucleocapsid Protein And Its Function In Modulation Of Immune Signaling, Steven Joe Ontiveros

All ETDs from UAB

Old World and New World hantaviruses, family Bunyaviridae, mature intracellularly within cellular compartments. Although it is generally accepted they assemble and bud in the Golgi apparatus the site remains controversial for New World hantaviruses, because some studies have raised the possibility of their maturation at the plasma membrane. Furthermore, the site of assembly hantaviruses still remains undetermined. The nucleocapsid (N) protein has been proposed to play a key role in facilitating assembly. To gain insight into the assembly pathways of Old World hantaviruses, we examine the intracellular trafficking of the Hantaan (HTN) virus N protein. We show progressive redistribution of …

Back To Basics: Habeas Corpus Procedures And Long-Term Executive Detention, Marc D. Falkoff Jan 2009

Back To Basics: Habeas Corpus Procedures And Long-Term Executive Detention, Marc D. Falkoff

Faculty Articles, Papers, and Other Scholarship

The lesson from the Hamdi plurality and the Court in Boumediene is not that all hearsay is admissible in an executive-detention habeas action, but rather that the district courts should exercise their discretion in determining whether to allow particular hearsay statements into evidence and should seriously consider the degree to which such statements could be relied upon when assessing the legality of a detention. Although the legal and political issues raised by the habeas corpus authority of federal courts are familiar to most lawyers and legal scholars in the context of federal review of state convictions, in this article I …

The Role Of Vea On Aspergillus Flavus Infection Of Peanuts, Corn And Cotton, Ana M. Calvo, R.M. Duran, J.W. Cary Jan 2009

The Role Of Vea On Aspergillus Flavus Infection Of Peanuts, Corn And Cotton, Ana M. Calvo, R.M. Duran, J.W. Cary

Faculty Articles, Papers, and Other Scholarship

The aflatoxin-producing fungus Aspergillus flavus is a causal agent of preharvest contamination of food commodities such as oil seed crops worldwide. Peanut, corn and cottonseed are among the oil seeds that are susceptible to aflatoxin contamination during invasion of these crops by A. flavus. Contamination of agricultural commodities with aflatoxins can result in serious economic hardships to producers and adverse health impacts in both humans and domestic animals. It is therefore of great importance to determine ways to control A. flavus dissemination, survival and toxin formation. In this study we demonstrate the role of the veA regulatory gene in the …

Synergy For Science Learning: An Interdisciplinary Partnership To Improve The Quality Of Science, Technology, Engineering And Mathematics Education, Alan Zollman, Kathleen Kitts, Mansour Tahernezhadi, Penny Billman

Faculty Articles, Papers, and Other Scholarship

Synergy is the interaction of two or more elements to produce a combined impact greater than the sum of their separate effects. In this paper, synergy for science learning came from the amalgamation of separate, independent science education contributors. Synergy for science learning thus was created by three resulting elements: content and applications, designed by the College of Engineering and College of Liberal Arts and Sciences; research-based pedagogy, developed by the Colleges of Education and College of Liberal Arts and Sciences; and dynamic classroom implementation, guided by action research and delivered by the partnership school districts.

Greater Employment Equalities In The New South Through New Constitutional Guarantees, Jeffrey A. Parness Jan 2009

Greater Employment Equalities In The New South Through New Constitutional Guarantees, Jeffrey A. Parness

Faculty Articles, Papers, and Other Scholarship

Most American state constitutions contain equal protection clauses. The words in these clauses often follow the words in the equal protection clause of the federal constitution. Not surprisingly perhaps, many state courts read their own clauses as providing no greater equalities than are afforded federally, following "in lockstep". But some American state constitutions have special equality provisions having no federal counterparts. Such clauses not only facilitate, but seemingly require, greater independent state constitutionalism. For example, in Illinois there are three special equality provisions beyond the general equal protection clause. They deal with employment, housing, local government and school districts. Of …

Inequalities In Illinois Constitutional Equality, Jeffrey A. Parness, Laura Lee Jan 2009

Inequalities In Illinois Constitutional Equality, Jeffrey A. Parness, Laura Lee

Faculty Articles, Papers, and Other Scholarship

In 1970 four new equality provisions were added to the Illinois Constitution, including two explicit equal protection provisions and two explicit antidiscrimination provisions. Shortly thereafter, Elmer Gertz, the Chair of the Bill of Rights Committee for the relevant constitutional convention, declared that we in Illinois have gone beyond all other states and the federal government in eliminating discrimination. Unfortunately, a few years later Gertz lamented that while Illinois had the strongest nondiscrimination provisions of any state constitution, these provisions had only yielded unrealized expectations. Today, the 1970 equality mandates continue to be unrealized. This paper reviews the four provisions and …

The massive subprime losses at Citigroup, UBS, Bank of America, Wachovia, Washington Mutual, and other banks astounded the financial world. Equally shocking were the failures of Lehman Brothers, Merrill Lynch, and Bear Stearns. The conversion of Goldman Sachs and Morgan Stanley into bank holding companies left no large independent investment banks standing. If all that was not enough, Bernard Madoff's incredible $50 billion Ponzi scheme was a new milestone in the nation's financial history. Those failures and Madoff's fraud were unforeseen and undetected by the regulator, the Securities and Exchange Commission (SEC), which was responsible for overseeing the broker-dealers that …

The Actr Nationwide Survey Of Russian Language Instruction In U.S. High Schools In 2009, Dan E. Davidson, Nadra Garas

Russian Language Journal

Adequate access to extended sequences of instruction across a range of world languages in the U.S. K‐12 system can provide the “early start” in language learning, which is essential for a new generation of Americans who will compete in the highly globalized economy of the 21st century.2 The study of Arabic, Chinese Japanese, Persian, and Russian have attracted particular attention among U.S. policymakers, given the importance of these and other major world languages for long‐term U.S. national security interests, scientific and cultural exchange, mutual understanding, and the preservation of U.S. economic competitiveness around the world.

Birth Language Attrition And Reacquisition In Russian Adoptees, Avram J. Lyon Jan 2009

Birth Language Attrition And Reacquisition In Russian Adoptees, Avram J. Lyon

Russian Language Journal

The wave of adoption from Russia and other countries of the former Soviet Union has brought a large number of incomplete Russian speakers into the United States; over 71,000 orphans from Russia, Ukraine, Kazakhstan, and Belarus have been issued United States entry visas since 1992 (U.S. Department of State 2007 and 2009; Ruggiero 2007). This is part of a larger trend toward international adoption, amounting to several hundred thousand children in the past decades. Children adopted by American families experience a radical reduction in birth language exposure and must quickly acclimate to and become proficient in the language of the …

“He Would Kill Me With His Penis”: Genocidal Rape In Rwanda As A State Crime, Christopher W. Mullins Jan 2009

“He Would Kill Me With His Penis”: Genocidal Rape In Rwanda As A State Crime, Christopher W. Mullins

Articles

Only recently have critical criminologists begun a systematic exploration of genocide, war crimes and crimes against humanity as state crimes (Kramer and Michalowski 2005; Mullins and Rothe 2008; Haveman and Smeulers 2008). This paper contributes to that growing literature through examining the nature and dynamics of sexual violence as it occurred during the 1994 Rwandan genocide. It draws upon empirical examination of events depicted in transcripts of trials held before the International Criminal Tribunal for Rwanda. It qualitatively examines the role of leaders in producing mass sexual assaults. It explores how sexual mutilations were more intense expressions of what the …

Publications

The purpose of this study is to examine the relationship between the level of death anxiety among a national sample of United States funeral directors with varying levels of death exposure, age, and sex. Utilizing the Multidimensional Fear of Death Scale (MFODS), the results showed a significant, but weak negative relationship between levels of death anxiety and the participants' reported number of funerals attended per year. The correlation between death anxiety scores and the number of reported embalming cases performed yearly was, however, not significant. We found a significant negative correlation between death anxiety and age in both men and …
