The Effect Of Environmental Service Learning On Empowerment For Responsible Environmental Behaviors In College Students, Derek W. Rosenberger Jan 2009

The Effect Of Environmental Service Learning On Empowerment For Responsible Environmental Behaviors In College Students, Derek W. Rosenberger

Master of Arts in Higher Education (MAHE) Theses

The purpose of this study was to empirically test whether service learning pedagogy utilized in a general education science course is able to promote locus of control (LOC) for responsible environmental behavior (REB) and intent to act (ITA) upon REB. To measure this, two instruments, the Environmental Action Internal Control Inventory, developed by Smith-Sebasto and Fortner (1994) to test for LOC for REB, and Hsu’s (1997) ITA construct, developed to test for ITA upon REB were administered to two sections of a general education science course for non-science majors utilizing a nonequivalent pretest posttest control group design. This study shows …

Strip-Mining And Grassroots Resistance In Appalachia: Community Lawyering For Environmental Justice, Dean Rivkin Jan 2009

Strip-Mining And Grassroots Resistance In Appalachia: Community Lawyering For Environmental Justice, Dean Rivkin

Scholarly Works

Environmental justice campaigns have been a dynamic feature of public interest lawyering for over four decades. These community lawyers, sensitive to the democratic imperatives of their grassroots clients, employ a viscous blend of legal and nonlegal strategies to achieve their clients’ aims. This article is the story of an environmental justice campaign, still being waged, in the Appalachian mountains of east Tennessee. The campaign seeks to halt the destructive practice of mountaintop removal strip-mining for coal through the deployment of traditional litigation and more unconventional extrajudicial strategies, both of which are designed to build the voices and power of the …

Free Trade And The Environment, Nicole Hassoun Jan 2009

Free Trade And The Environment, Nicole Hassoun

Philosophy Faculty Scholarship

What should environmentalists say about free trade? Many environmentalists object to free trade by appealing the “Race to the Bottom Argument.” This argument is inconclusive, but there are reasons to worry about unrestricted free trade’s environmental effects nonetheless; the rules of trade embodied in institutions such as the World Trade Organization may be unjustifiable. Programs to compensate for trade-related environmental damage, appropriate trade barriers, and consumer movements may be necessary and desirable. At least environmentalists should consider these alternatives to unrestricted free trade if they do not prevent the achievement of other important moral objectives, can efficiently reduce environmental problems, …

Competition: The Next Generation Of Environmental Regulation?, Stephen M. Johnson Jan 2009

Competition: The Next Generation Of Environmental Regulation?, Stephen M. Johnson

Articles

Risk. In the environmental arena, when determining whether to regulate or how to regulate activities or products, policymakers must begin by assessing the level of risk presented by the activity or product. Although essential information about the level of risk is often in the hands of the actors or producers, they may be reluctant to provide this information to policymakers, unless they are compelled to do so, because the disclosure of information about the risk presented by their activity or product could reduce demand for their activity or product, increase potential liability for harm caused by their activity or product, …

The Failures Of American Poverty Measures, Stephen Pimpare Jan 2009

The Failures Of American Poverty Measures, Stephen Pimpare

Business, Politics & Security Studies Faculty Scholarship

How we think about need or deprivation-how we judge its severity, its causes and effects, and the progress we have made (or not made) over time in reducing it-has much to do with how we define and then measure it. And, we measure it poorly. The insufficiencies of official data on American poverty are reasonably well known, yet they continue, nonetheless, to be the principal means by which we gauge need in the United States. After a review of such official measures, this article discusses alternative means of evaluating need in the United States, highlighting the benefits of examining poverty …

Is Religion The Environment’S Last Best Hope? Targeting Change In Individual Behavior Through Personal Norm Activation, Stephen M. Johnson

Articles

This Article explores the important role that religious organizations have played, and can play, in personal norm activation to influence change in individuals’ environmentally destructive actions. Part I of the Article describes the need for regulating or targeting individuals, in addition to industrial sources, in order to address many of the remaining significant environmental problems. Part II examines the advantages and disadvantages of targeting individual actions through command-and-control regulation, economic-based alternatives, and information disclosure programs. Part III outlines the concept of norm activation and details the manner in which information disclosure programs can be used to activate personal norms to …

An Investigation Of The Intersection Between Art And Activism, Emily Wilcox Jan 2009

An Investigation Of The Intersection Between Art And Activism, Emily Wilcox

Mahurin Honors College Capstone Experience/Thesis Projects

Art has social relevance and is effective as a means of activism. Current social and environmental crises make art-based activism especially relevant today. There are problems with prevailing views on art, which prevent many artists from seeing themselves as agents of change. Therefore, some established views on art need to shift in order for artists to become more empowered. Ways of utilizing art for activism are many and varied. Activism is often approached with attitudes that are problematic and ineffective. An art-based approach is a positive alternative because it stimulates empathy. Empathy is necessary to achieve social and environmental justice. …

Evaluating The Role Of Epa Policy Levers: An Examination Of A Voluntary Program And Regulatory Threat In The Metal-Finishing Industry, Keith Brouhle, Charles Griffiths, Ann Wolverton Jan 2009

Evaluating The Role Of Epa Policy Levers: An Examination Of A Voluntary Program And Regulatory Threat In The Metal-Finishing Industry, Keith Brouhle, Charles Griffiths, Ann Wolverton

United States Environmental Protection Agency: Publications

In this paper, we evaluate the influence of two environmental policy levers on emissions in the metal-finishing industry: a voluntary program- the Strategic Goals Program (SGP)- and the threat of formal regulation. While voluntary approaches are increasingly utilized as policy tools, the effectiveness of such programs is often questioned, and the impact of a voluntary program in tandem with a regulatory threat is not well understood. We examine the decision to participate in the SGP and regulatory threat had on facility emission behavior. Participation in the program appears related to several forms of external pressure: the regulatory threat, industry trade …

Trust & Transparency: Promoting Efficient Corporate Disclosure Through Fiduciary-Based Disclosure, Michael R. Siebecker Jan 2009

Trust & Transparency: Promoting Efficient Corporate Disclosure Through Fiduciary-Based Disclosure, Michael R. Siebecker

Sturm College of Law: Faculty Scholarship

Could embracing the philosophy of “encapsulated trust” as the basis for a fiduciary duty of disclosure improve the integrity and effectiveness of corporate communications? The question arises because a tragedy of transparency threatens the viability of the burgeoning corporate social responsibility (CSR) movement, where consumers and investors employ various social, environmental, or ethical screening criteria before purchasing a company's stock or products. In an efficient market, fully informed consumers and investors could reward companies that engage in CSR by purchasing their products or stock and, conversely, punish companies that fail to engage in desired practices by refusing to purchase their …

Climate Change, Consumption, And Cities, Alice Kaswan Jan 2009

Climate Change, Consumption, And Cities, Alice Kaswan

Fordham Urban Law Journal

Part I of this Article highlights the nation’s high level of energy consumption and argues that policies directed solely at tailpipes and smokestacks will fail to reach climate change goals. Part II of this Article observes that recently proposed federal legislation does not sufficiently address consumption. Part III argues that direct local land use and green building measures can and should play a critical role in reducing demand. Part IV recognizes that, notwithstanding the institutional and practical arguments in favor of local initiatives, significant barriers could slow their adoption and implementation. Part V argues that federal legislation could overcome obstacles …

China's Environmental Problems: Is A Specialized Court The Solution?, Darcey J. Goetz Jan 2009

China's Environmental Problems: Is A Specialized Court The Solution?, Darcey J. Goetz

Washington International Law Journal

China’s economic growth has come at a high price: environmental and natural resource destruction. Presently, China’s legal system is not prepared to protect China’s environmental resources. China’s State Council has expressed an interest in establishing a civil and administrative system to manage environmental matters. Some of the objectives expressed by the State Council could be achieved by creating a special tribunal to address environmental issues, similar to New Zealand’s Environment Court. A specialized court promotes environmental protection, and specialization creates experts in a specific field, allowing for consistency among decisions. An environmental court will fit into China’s current legal system …

Questioning The Resort To U.S. Hegemonic Military Force, Harry Van Der Linden Jan 2009

Questioning The Resort To U.S. Hegemonic Military Force, Harry Van Der Linden

Scholarship and Professional Work - LAS

This paper seeks to defend the thesis that this American project of military hegemony has a variety of global security costs of such combined magnitude that there is a strong prima facie case against the resort to armed force by the United States, so that its wars might be wrong even when there is a just cause. My thesis is based on the jus ad bellum principle of proportionality.
