Taking The Initiative: Exploring The Influence Of Citizen Legislating On Good Goverance In The American States, Kerri Milita Jan 2009

Taking The Initiative: Exploring The Influence Of Citizen Legislating On Good Goverance In The American States, Kerri Milita

Electronic Theses and Dissertations

The citizen legislator is both a controversial and recurring phenomenon of interest in political science research. A longstanding concern for the discipline has been whether or not involvement of the public in the lawmaking process is an asset or a liability to quality governance. This study explores the desirability of citizen legislating in the American states. A four dimensional index is created that includes empirical indicators of "substantive" and "procedural" governance. These indicators include voter turnout, fiscal health, the ideological distance between government and the citizenry, and the diversity of a state's interest group system. The total number of initiatives …

Elucidating The Social Skills Deficits In Children With Asperger's Disorder: A Comparative Study, Lindsay Scharfstein Jan 2009

Elucidating The Social Skills Deficits In Children With Asperger's Disorder: A Comparative Study, Lindsay Scharfstein

Electronic Theses and Dissertations

Children with Asperger's Disorder are considered to have impairments in social interaction, but to date few studies have empirically addressed this issue. This study examined the existence of social skills deficits in children with Asperger's Disorder, children with social phobia, and children with no psychological disorder. Using direct observation of social skills during role-play tasks, blinded observers rated an overall impression of social effectiveness and three specific categories of social skill: pragmatic behavior (e.g., effort to maintain conversation, latency to respond), speech and prosodic behavior (e.g., vocal inflection, voice volume), and paralinguistic conversational behaviors (e.g., facial orientation, motor movement). Children …

Have You Heard? Predictors Of Hpv Awareness Among A Random Sample Of College Students, Meagan Arrastia Jan 2009

Have You Heard? Predictors Of Hpv Awareness Among A Random Sample Of College Students, Meagan Arrastia

Electronic Theses and Dissertations

College students have been identified as at high risk for contracting Human Papillomavirus (HPV) due to engaging in risky behaviors, such as binge drinking and unprotected sex. Before preventative measures like vaccination and condom usage can be promoted, awareness must be evaluated. A random sample of 438 college students was surveyed on their awareness of HPV using both paper and online surveying methods. Using binary logistic regression, HPV awareness was predicted using demographic measures. The majority of the sample reported having heard of HPV before. Sexually active respondents and females were significantly more likely to report awareness. Non-whites and first-generation …

Fostering Teacher's Conceptual Understanding Of Ordering, Adding, And Subtracting Fractions Through School-Based Professional Development, Jessica Maguhn Jan 2009

Fostering Teacher's Conceptual Understanding Of Ordering, Adding, And Subtracting Fractions Through School-Based Professional Development, Jessica Maguhn

Electronic Theses and Dissertations

In an attempt to examine my practice of providing conceptually-based professional development on fractions to fifth grade teachers, I conducted a series of four one hour professional development workshops. I focused on the conceptual understanding of ordering, adding, and subtracting fractions. I examined the solution process that teachers used to solve fraction problems and their abilities to explain and justify their solutions in an attempt to interpret their understanding. My data showed the effects of this workshop series. The study helped determine the effects of conceptually-based professional development on fractions as demonstrated in the teachers' discussions, participation, and written explanations.

Crime Labs And Prison Guards: A Comment On Melendez-Diaz And Its Potential Impact On Capital Sentencing Proceedings, John H. Blume, Emily C. Paavola Jan 2009

Crime Labs And Prison Guards: A Comment On Melendez-Diaz And Its Potential Impact On Capital Sentencing Proceedings, John H. Blume, Emily C. Paavola

Cornell Law Faculty Publications

The Sixth Amendment to the United States Constitution guarantees a criminal defendant the right "to be confronted with the witnesses against him." Four years ago, in Crawford v. Washington, the United States Supreme Court held that this right bars the admission of testimonial hearsay statements against criminal defendants, regardless of whether or not the statements fall within an evidentiary hearsay exception. It was a decision that other courts later described as a "bombshell," a "renaissance," and "a newly shaped lens" through which to view the Confrontation Clause. The case generated an extensive amount of discussion among legal commentators.

Since its …

The Afterlife Of Ford And Panetti: Execution Competence And The Capacity To Assist Counsel, Christopher W. Seeds Jan 2009

The Afterlife Of Ford And Panetti: Execution Competence And The Capacity To Assist Counsel, Christopher W. Seeds

Cornell Law Faculty Publications

The capacity to assist counsel and communicate a defense once held a central place in assessing competence for execution. Since Ford v. Wainwright (1986), however, courts have discarded this measure, viewing Justice Powell’s concurring opinion, which required only that a prisoner understand the execution as mortal punishment for a capital crime, as the Eighth Amendment rule. In a significant development, the Supreme Court’s decision in Panetti v. Quarterman (2007) - its first interpreting Ford - sends notice that Justice Powell’s statements on the substantive standard are not Ford's rule, providing a long overdue opportunity to address whether executing prisoners with …

A New Look At Judicial Impact: Attorneys' Fees In Securities Class Actions After Goldberger V. Integrated Resources, Inc., Theodore Eisenberg, Geoffrey P. Miller, Michael A. Perino Jan 2009

A New Look At Judicial Impact: Attorneys' Fees In Securities Class Actions After Goldberger V. Integrated Resources, Inc., Theodore Eisenberg, Geoffrey P. Miller, Michael A. Perino

Cornell Law Faculty Publications

Judicial impact studies have generally found widespread compliance by lower courts. Often, however, these studies employ relatively insensitive measures of compliance, limit their focus to compliance with Supreme Court precedent, and only occasionally examine the impact of judicial decisions on the ultimate consumers of those rulings - the members of society who are subject to them. Significant questions thus remain, such as whether and to what extent lower courts in fact comply with precedent and what if any role fear of reversal plays in compliance. To address these gaps, we use regression analysis to examine how the district courts in …

When Should A Mistake Of Fact Excuse?, Stephen P. Garvey Jan 2009

When Should A Mistake Of Fact Excuse?, Stephen P. Garvey

Cornell Law Faculty Publications

This symposium contribution advances two claims. First, a mistake (or ignorance) of fact should matter in the criminal law only insofar as it causes an actor to be ignorant of the law. Mistakes of fact should have exculpatory force if and only if they cause ignorance of the law, which ignorance ought to be an excuse to criminal liability. Second, an actor who should otherwise be excused because he is ignorant of the law, which ignorance is in turn the result of some mistake of fact, should not lose that excuse just because the underlying mistake of fact can in …

Opportunistic Sensing: Security Challenges For The New Paradigm, Apu Kapadia, David Kotz, Nikos Triandopoulos Jan 2009

Opportunistic Sensing: Security Challenges For The New Paradigm, Apu Kapadia, David Kotz, Nikos Triandopoulos

Dartmouth Scholarship

We study the security challenges that arise in Opportunistic people-centric sensing, a new sensing paradigm leveraging humans as part of the sensing infrastructure. Most prior sensor-network research has focused on collecting and processing environmental data using a static topology and an application-aware infrastructure, whereas opportunistic sensing involves collecting, storing, processing and fusing large volumes of data related to everyday human activities. This highly dynamic and mobile setting, where humans are the central focus, presents new challenges for information security, because data originates from sensors carried by people— not tiny sensors thrown in the forest or attached to animals. In this …

Privatizing And Publicizing Speech, Nelson Tebbe Jan 2009

Privatizing And Publicizing Speech, Nelson Tebbe

Cornell Law Faculty Publications

When and how should governments be permitted to use private-law mechanisms to manage their public-law obligations? This short piece poses that question in the context of Summum, which the Supreme Court decided earlier this year, and Buono, which it will hear in the fall. In both cases, the government manipulated formal property rules in order to fend off constitutional challenges. In Summum, the government took ownership of a religious symbol in the face of a free speech challenge, while in Buono it shed ownership of land containing another sectarian symbol in an effort to moot an Establishment Clause problem. Although …

(Mis)Interpreting Mathematical Models: Drift As A Physical Process, Roberta L. Millstein, Robert A. Skipper, Michael Dietrich Jan 2009

(Mis)Interpreting Mathematical Models: Drift As A Physical Process, Roberta L. Millstein, Robert A. Skipper, Michael Dietrich

Dartmouth Scholarship

Recently, a number of philosophers of biology (e.g., Matthen and Ariew 2002; Walsh, Lewens, and Ariew 2002; Pigliucci and Kaplan 2006; Walsh 2007) have endorsed views about random drift that, we will argue, rest on an implicit assumption that the meaning of concepts such as drift can be understood through an examination of the mathematical models in which drift appears. They also seem to implicitly assume that ontological questions about the causality (or lack thereof) of terms appearing in the models can be gleaned from the models alone. We will question these general assumptions by showing how the same equation …

An Examination Of Professional Development Activities Available To Teachers In The Mid-America Region Of The Association Of Christian Schools International, Linda M. Neuzil, Marsha Vaughn Jan 2009

An Examination Of Professional Development Activities Available To Teachers In The Mid-America Region Of The Association Of Christian Schools International, Linda M. Neuzil, Marsha Vaughn

International Christian Community of Teacher Educators Journal

The spotlight in education in recent years has been focused on the areas of professional development activities for teachers and the development of professional learning communities. However, the majority of research has omitted the Christian school community which requires its own body of research examining the unique conditions in which both private school students and educators learn and work. While the need for student achievement remains constant in both public and private schools, the social, philosophical, political, financial, and emotional contexts are quite dissimilar. The purpose of this study is to examine the availability and utilization of professional development activities …

Venture Capital Firm's Reputation Effect On Its Start-Up Company's Long Term Operating Performance And Survivorship, Huei Siang Yap Jan 2009

Venture Capital Firm's Reputation Effect On Its Start-Up Company's Long Term Operating Performance And Survivorship, Huei Siang Yap

Dissertations and Theses Collection (Open Access)

In this paper, I tested the effects of three proxies for venture capitalist(VC) reputation on its invested company's long term industry-djusted operating performances (ROA , ROE), market-to-book ratio and survival time (time to delisting) in the aftermarket. VC's market share and VC's IPO share have strong and positive association with the post-IPO long-term performance metrics, and the effects are statistically significant even after accounting for self-selection bias. For long term survivorship of start-up companies, I applied hazard analysis to the IPO company's time to delisting with accelerated failure time (AFT) model as the baseline hazard function, and found that start …

The Customer Is King : Mutual Fund Relationships And Analyst Recommendations, Ping Liu Jan 2009

The Customer Is King : Mutual Fund Relationships And Analyst Recommendations, Ping Liu

Lingnan Theses

I investigate whether the business relations between mutual funds and brokerage firms influence sell-side analyst coverage and recommendations. Using a comprehensive sample of analyst recommendations in China over the 2004-2008 period, I find that the likelihood of analyst coverage and analysts’ relative recommendations, benchmarked against consensus recommendations, are positively associated with the mutual fund business relationship. I measure the business relation by the weight of a stock in the mutual fund client’s portfolio and the commission revenue generated from the mutual fund clients. My results show that mutual funds take advantage of these optimistic recommendations by selling the stocks. I …

Improving The Profitability Of Direct Marketing : A Quantile Regression Approach, Xi Zhang Jan 2009

Improving The Profitability Of Direct Marketing : A Quantile Regression Approach, Xi Zhang

Lingnan Theses

Direct marketing is to target consumers who are most likely to respond. A number of target selection methods have been employed to select potential customers. These methods either only consider the customer response probability and ignore the profit issue or assume that the estimates of profit are homogenous across customers when considering the expected amount of profit. Furthermore, the traditional analytical techniques based on ordinary least squares (OLS) regression, which focus on the average customer, cannot examine the differences of various customer groups or account for customer heterogeneity in profitability estimates. Quantile regression, instead of the point estimate for the …

Understanding Plant Community Composition In Agricultural Welands: Context Dependent Effects And Plant Interactions, Elizabeth Boughton Jan 2009

Understanding Plant Community Composition In Agricultural Welands: Context Dependent Effects And Plant Interactions, Elizabeth Boughton

Electronic Theses and Dissertations

Community composition results from an integrated combination of random processes, regional habitat spatial structure, local environmental conditions, and species interactions. For example, the outcome of plant interactions can change depending on local environmental conditions such as nutrient availability, land management, or herbivory intensity. In particular, plant interactions may vary between facilitation and competition depending on ecological context, with facilitation expected to be prevalent under stressful conditions. I present the results of four studies that address different aspects of the community assemblage and dynamics emphasizing the synergistic effect of different processes. In the first, I investigated the importance of habitat isolation …

Determinants Of Chloroplast Gene Expression And Applications Of Chloroplast Transformation In Lactuca Sativa And Nicotiana Tabacum, Tracey Ruhlman

Electronic Theses and Dissertations

Genetic modification of plastids in the model plant tobacco (Nicotiana tabacum) has demonstrated that numerous foreign gene products can accumulate to high levels in this setting. Plastid biotechnology is maturing to encompass the improvement of food and feed species and the production of biopharmaceutical proteins for oral delivery necessitating development of stable transplastomic edible plants. In the interest of establishing an edible platform we have investigated the use of native and foreign regulatory elements in relation to foreign gene expression in plastids. Multiple sequence alignments of intergenic regions for 20 species of angiosperm showed that despite 95% identity in the …

Videotaped Oral Reading Fluency Lab: An Alternative Approach To One-On-One Interventions For Intermediate Elementary Students With Learning Disabilities, Beth Christner Jan 2009

Videotaped Oral Reading Fluency Lab: An Alternative Approach To One-On-One Interventions For Intermediate Elementary Students With Learning Disabilities, Beth Christner

Electronic Theses and Dissertations

The ability to read aloud fluently is a reflection of one's ability to automatically decode words and comprehend text at the same time (Samuels, 2006), a task which may be difficult for many intermediate elementary students with learning disabilities (LD) (Ferrara, 2005). Previous research shows that audio-assisted repeated readings and goal-setting with feedback are effective methods of improving oral reading fluency (ORF) (Chard, Vaughn, & Tyler, 2002; Morgan & Sideridis, 2006; Therrien, 2004) but implementing these interventions may be time-consuming for teachers and tedious for students. The purpose of this research was to determine the impact of including repeated reading …

Hedonic Property Value Modeling Of Water Quality, Lake Proximity, And Spatial Dependence In Central Florida, Patrick Walsh Jan 2009

Hedonic Property Value Modeling Of Water Quality, Lake Proximity, And Spatial Dependence In Central Florida, Patrick Walsh

Electronic Theses and Dissertations

Hedonic property value analysis is one of the leading methods of environmental valuation. This non-market technique uses variation in home sales to infer the values of amenities or disamenities. While there have been numerous studies about air quality and hazardous waste, the number of papers focusing on water quality is much smaller. Consequently, there are still many unanswered questions about the proper handling of water quality through hedonic methods. Furthermore, estimates from hedonic property price analyses are rarely used in government cost benefit analyses. This dissertation investigates several important hedonic issues in a large analysis of water quality in central …
