Rethinking Visitation: From A Parental To A Relational Right, Ayelet Blecher-Prigat Jan 2009

Rethinking Visitation: From A Parental To A Relational Right, Ayelet Blecher-Prigat

Duke Journal of Gender Law & Policy

[...] visitation rights are considered to arise from the very fact of parenthood, so that parents are entitled to this right simply by being legally recognized as parents. [...] visitation rights are subject to the general rule of parental exclusivity: only a child's legal parents have rights considered parental, and non-parents cannot acquire them.

A Man’S Right To Choose His Surname In Marriage: A Proposal, Michael Mahoney Frandina

Duke Journal of Gender Law & Policy

[...] a brief history of marital and naming practices will outline how these two concepts have shifted to a primarily private issue today, as compared with the Middle Ages, when they were primarily public issues highly concerned with property matters. [...] naming involves important issues in the construction of one's identity.

The Bfoq Defense: Title Vii’S Concession To Gender Discrimination, Katie Manley Jan 2009

The Bfoq Defense: Title Vii’S Concession To Gender Discrimination, Katie Manley

Duke Journal of Gender Law & Policy

Should the BFOQ exception still exist? Because permitting discrimination under Title VII seems fundamentally contrary to the anti-discrimination purpose of the statute, this article questions whether the BFOQ defense is consistent with the aims of Title VII or whether, in actuality, the defense undermines the Act's effectiveness by providing a loophole for employers to participate in the discriminatory practices Title VII seeks to forbid.

A Trellis-Coded Modulation Scheme With A Novel Expanded 16-Dimensional Constant Envelope Q2psk Constellation, Milton I. Quinteros, Edit J. Kaminsky, Kenneth V. Cartwright

Electrical Engineering Faculty Publications

This paper presents a TCM scheme that uses a new expanded 16-Dimensional Constant Envelope Q2PSK constellation along with a simple convolutional encoder of rate 2/3. An effective gain of 2.67 dB over uncoded CEQ2PSK is achievable with low complexity, and without suffering from constellation expansion penalty. Larger coding gains are easily achieved with encoders of higher rates. In addition, an optimal hardware implementation of the required decoders is described.

Promoting Learning And Achievement Through Self-Assessment, Heidi Andrade, Anna Valtcheva Jan 2009

Promoting Learning And Achievement Through Self-Assessment, Heidi Andrade, Anna Valtcheva

Educational Theory and Practice Faculty Scholarship

Criteria-referenced self-assessment is a process during which students collect information about their own performance or progress; compare it to explicitly stated criteria, goals, or standards; and revise accordingly. The authors argue that self-assessment must be a formative type of assessment, done on drafts of works in progress: It should not be a matter of determining one's own grade. As such, the purposes of self-assessment are to identify areas of strength and weakness in one's work in order to make improvements and promote learning. Criteria-referenced self-assessment has been shown to promote achievement. This article introduces criteria-referenced self-assessment, describes how it is …

The History Of The Adventist Interpretation Of The "Daily" In The Book Of Daniel From 1831 To 2008, Denis Kaiser Jan 2009

The History Of The Adventist Interpretation Of The "Daily" In The Book Of Daniel From 1831 To 2008, Denis Kaiser

Master's Theses

During the more than 160 years since Adventism's inception, the interpretation of the tamid or "daily" in the book of Daniel underwent several changes with respect to the argumentation, as well as the way differing views are handled. This study analyzes various Millerite and Adventist interpretations of the tamid in Dan 8 between 1831 and 2008 focusing especially on the approach to the biblical text, the argumentation, and the atmosphere during the time of conflict (1900 - 1930), as well as on Ellen White's counsels during the period, puzzling statement, and possible explanations. This documentary study was based primarily on …

The Doctrine Of Sin In The Thought Of George R. Knight: Its Context And Implications, Jamie Kiley Jan 2009

The Doctrine Of Sin In The Thought Of George R. Knight: Its Context And Implications, Jamie Kiley

Master's Theses

George R. Knight attempts to chart a middle course between various historical extremes on the doctrine of sin. His view of the Fall and of the consequent effects on human nature is not as pessimistic as that of theologians in the Augustinian tradition (including Martin Luther and John Calvin), who stress the complete corruption of human nature and the loss of free will. On the other hand, Knight’s view is not as optimistic as the views of such theologians as Pelagius or M. L. Andreasen, who tend not to see the Fall as having affected human nature itself, and believe …

Theodicy And Execution For Expiation In 2 Samuel 21:1-14, Carrie S. Rhodes Jan 2009

Theodicy And Execution For Expiation In 2 Samuel 21:1-14, Carrie S. Rhodes

Master's Theses

Problem The execution of Saul’s descendants in 2 Sam 21:1-14 has long been interpreted as resulting from David’s succession motives, and may appear to be posthumous ruler punishment, expiation on Saul’s behalf, or an error in judgment on David’s part in whom to turn to in order to know what to do in this case. In addition, the delay in justice until David’s reign for something that Saul had done is puzzling. Method Analysis of the Hebrew text, comparison between ANE and biblical homicide law, examination of the sociological structure of the ANE family, examination of the characters of Saul …

A Historical Analysis And Performer's Guide To Sergei Prokofiev's Sonata For Solo Or Unison Violins, Op.115, Joanna Steinhauser

LSU Major Papers

Sergei Prokofiev composed his last work for violin in 1947, the Sonata for Solo or Unison Violins, Op. 115. This work stands apart from Prokofiev’s other works because it serves the dual purpose of both solo or unison sonata, and is the least performed or recorded work among the violin repertoire of Prokofiev. This work was written exactly at the point in Soviet history when its government launched official attacks on many composers including Prokofiev, and was never performed during Prokofiev’s lifetime. Nevertheless, the work represents an important point in Prokofiev’s career, during the final stages of his Soviet period, …

The Impact Of Early Positive Results On A Mathematics And Science Partnership: The Experience Of The Institute For Chemistry Literacy Through Computational Science, K. S. Murray, M. A. Henry, M. C. Hogrebe

Journal of Mathematics and Science: Collaborative Explorations

After one year of implementation, the Institute for Chemistry Literacy through Computational Science, an NSF Mathematics and Science Partnership Institute Project led by the University of Illinois at Urbana-Champaign’s Department of Chemistry, College of Medicine, and National Center for Supercomputing Applications, experienced statistically significant gains in chemistry content knowledge among students of the rural high school teachers participating in its intensive, year-round professional development course, compared to a control group. The project utilizes a two-cohort, delayed-treatment, random control trial, quasi-experimental research design with the second cohort entering treatment one year following the first. The three-year treatment includes intensive two-week summer …

Connecting Mathematics And The Applied Science Of Energy Conservation, R. E. Carbone, J. M. Pearce Jan 2009

Connecting Mathematics And The Applied Science Of Energy Conservation, R. E. Carbone, J. M. Pearce

Journal of Mathematics and Science: Collaborative Explorations

To effectively teach science in the elementary classroom, pre-service K-8 teachers need a basic understanding of the underlying concepts of physics, which demand a strong foundation in mathematics. Unfortunately, the depth of mathematics understanding of prospective elementary teachers has been a growing and serious concern for several decades. To overcome this challenge, a two-pronged attack was used in this study. First. students in mathematics courses were coupled with physical science courses by linking registration to ensure co-requisites were taken. This alone improved passing rates. Secondly, an energy conservation project was introduced in both classes that intimately tied the theoretical mathematics …

") mid-year meeting workshop on Intellectual Property in Vancouver, British Columbia. The panel, renamed "The Politics of Intellectual Property," and moderated by Keith, included talks by Justin Hughes, Mark Lemley, Jay Thomas, and me, and it was followed by three concurrent sessions on "The Politics Concerning Moral Rights," "The Politics of Global Intellectual Property, " and "The Politics of Patent Reform." I'm not sure what the organizing committee had in mind when it …

Detrital-Zircon Geochronology Of The Metasedimentary Rocks Of North-Western Graham Land, David L. Barbeau Jr, Justin T. Davis, Kendra E. Murray, Victor Valencia, George E. Gehrels, Khandaker M. Zahid, David J. Gombosi Jan 2009

Detrital-Zircon Geochronology Of The Metasedimentary Rocks Of North-Western Graham Land, David L. Barbeau Jr, Justin T. Davis, Kendra E. Murray, Victor Valencia, George E. Gehrels, Khandaker M. Zahid, David J. Gombosi

Faculty Publications

Metasedimentary rocks constitute an important but comparatively poorly understood part of the Antarctic Peninsula. Herein we report single-grain U-Pb detrital-zircon ages from samples of the Trinity Peninsula and Botany Bay Groups of north-western Graham Land. All studied samples are dominated by a large and narrowly defined population of late Palaeozoic zircons. Significant early–middle Palaeozoic and minor Neoproterozoic and Mesoproterozoic sub-populations constitute the majority of pre-Carboniferous grains. These detrital-zircon age populations are consistent with sediment derivation entirely from western Gondwana sources. Despite the clear Gondwana signatures, our data suggest that the Trinity Peninsula Group province was either a parautochthonous peri-Gondwanan terrane …

A Remote Sensing And Gis-Assisted Spatial Decision Support System For Hazardous Waste Site Monitoring, John R. Jensen, Michael E. Hodgson, Maria Garcia-Quijano, Jungho Im, Jason A. Tullis Jan 2009

A Remote Sensing And Gis-Assisted Spatial Decision Support System For Hazardous Waste Site Monitoring, John R. Jensen, Michael E. Hodgson, Maria Garcia-Quijano, Jungho Im, Jason A. Tullis

Faculty Publications

Humans produce large amounts of waste that must be processed or stored so that it does not contaminate the environment. When hazardous wastes are stored, waste site monitoring is typically conducted in situ which can lead to a serious time lag between the onset of a problem and detection. A Remote Sensing and GIS-assisted Spatial Decision Support System for Hazardous Waste Site Monitoring was developed to improve hazardous waste site management. The system was designed to be recursive, flexible, and integrative. It is recursive because the system is implemented iteratively until the risk assessment subsystem determines that an event is …

Fabrication Of Nanostructures For Improved Performance Of Electrochemical Sensors And For Reference Compensation In Localized Surface Plasmon Resonance Sensors, Prashanthi Para Jan 2009

Fabrication Of Nanostructures For Improved Performance Of Electrochemical Sensors And For Reference Compensation In Localized Surface Plasmon Resonance Sensors, Prashanthi Para

University of Kentucky Master's Theses

L‐glutamate is associated with several neurological disorders; thus, monitoring fast dynamics of L‐glutamate is of great importance in the field of neuroscience. Electrode miniaturization demanded by many applications leads to reduced surface area and decreased amounts of immobilized enzymes on coated electrodes. As a result, lower signal‐to‐noise ratios are observed for oxidase‐enzyme based sensors. To increase the signal‐to‐noise ratio we have developed a process to fabricate micro‐ and nano‐ structures on the microelectrode surface.

Localized surface‐plasmon resonances (SPR) has been extensively used to design label‐free biosensors that can monitor receptor‐ligand interactions. A major challenge with localized SPR sensors is that …

Impact Of Microphone Positional Errors On Speech Intelligibility, Arulkumaran Muthukumarasamy Jan 2009

Impact Of Microphone Positional Errors On Speech Intelligibility, Arulkumaran Muthukumarasamy

University of Kentucky Master's Theses

The speech of a person speaking in a noisy environment can be enhanced through electronic beamforming using spatially distributed microphones. As this approach demands precise information about the microphone locations, its application is limited in places where microphones must be placed quickly or changed on a regular basis. Highly precise calibration or measurement process can be tedious and time consuming. In order to understand tolerable limits on the calibration process, the impact of microphone position error on the intelligibility is examined. Analytical expressions are derived by modeling the microphone position errors as a zero mean uniform distribution. Experiments and simulations …

Verification And Debug Techniques For Integrated Circuit Designs, David Allen Crutchfield Jan 2009

Verification And Debug Techniques For Integrated Circuit Designs, David Allen Crutchfield

University of Kentucky Master's Theses

Verification and debug of integrated circuits for embedded applications has grown in importance as the complexity in function has increased dramatically over time. Various modeling and debugging techniques have been developed to overcome the overwhelming challenge. This thesis attempts to address verification and debug methods by presenting an accurate C model at the bit and algorithm level coupled with an implemented Hardware Description Language (HDL). Key concepts such as common signal and variable naming conventions are incorporated as well as a stepping function within the implemented HDL. Additionally, a common interface between low-level drivers and C models is presented for …
