Dying To Know: A Demand For Genuine Public Access To Clinical Trial Results Data, Christine Galbraith Davik Jan 2009

Dying To Know: A Demand For Genuine Public Access To Clinical Trial Results Data, Christine Galbraith Davik

Faculty Publications

Four years ago at the age of 34, I heard the awful words "I'm sorry, but you have breast cancer" coming from my doctor. After the initial shock of the diagnosis wore off, I like many others who have faced life-threatening diseases began to work with a team of physicians to develop an appropriate treatment plan, which included contemplating enrollment in a clinical trial. Quite unexpectedly, my position as an intellectual property professor whose scholarship focuses primarily on information control, my role as a member of my university's Institutional Review Board that oversees studies involving human subjects, and my newly …

Fighting Against Biopiracy: Does The Obligation To Disclose In Patent Applications Truly Help?, Jacques De Werra Jan 2009

Fighting Against Biopiracy: Does The Obligation To Disclose In Patent Applications Truly Help?, Jacques De Werra

Vanderbilt Journal of Transnational Law

In the global fight against biopiracy, one of the key issues is to prevent the grant and exploitation of patents on traditional knowledge and genetic resources by requiring that patent applicants for inventions involving traditional knowledge and genetic resources disclose the source of those resources and provide evidence that the prior informed consent of the local owners of such resources has been obtained and that benefit-sharing agreements have been entered into with those owners.

This Article argues that a legal discussion of biopiracy should analyze the obligation to disclose the use of traditional knowledge and genetic resources in an invention …

Lawyers Without Borders, Catherine A. Rogers Jan 2009

Lawyers Without Borders, Catherine A. Rogers

Faculty Scholarship

Professional regulation of attorneys is still attempting to catch up with the burgeoning international legal profession, which until recently has been wholly unregulated. The primary effort has been through revisions to Model Rule 8.5 to extend the reach of the Rule to international cases and professional activities in foreign countries. Because Rule 8.5 was drafted for domestic multi-jurisdiction practice, however, it is based on assumptions about territoriality and the historical relationship between the jurisdiction of tribunals and the licensing of attorneys that are simply inapposite in international settings. As a result, applying Rule 8.5 to international tribunals and international advocacy …

The Impact Of College Recreation Center Renovation On Overall Participant Utilization And Frequency, James R. Kilchenman

Browse all Theses and Dissertations

The purpose of this research study was to investigate changes in student utilization of a campus recreation center following a two-year renovation project that added 3,500 square feet to the existing facility. The variables studied for this investigation were the recreation center user age, class level, ethnicity, and sex. Data for this study were collected though activity reports produced when users swiped their University ID cards for admission to the recreation center. Overall there was a 189% increase with unique users following the renovation project. Mean student uses also increased for most variable categories, most notably with freshman and sophomore …

The Copyright Revision Act Of 2026, Jessica Litman Jan 2009

The Copyright Revision Act Of 2026, Jessica Litman

The Honorable Helen Wilson Nies Memorial Lecture

Congress may be persuaded to embark on a new round of copyright revision. If history is any guide, a revised copyright law is likely to be longer, broader, more complicated and less flexible than the one we have now. Before committing ourselves to that enterprise, Prof. Litman suggests we take the opportunity to imagine what the copyright system might look like if we were free to write on a blank slate. We should enact a statute that is much shorter and simpler, that gives creators a larger share of copyright goodies and distributors a smaller one, and that builds in …

The Literature Of Difference In Cultures Of Science, Scout Calvert Jan 2009

The Literature Of Difference In Cultures Of Science, Scout Calvert

University of Nebraska-Lincoln Libraries: Faculty Publications

Review of The Nature of Difference: Sciences of Race in the United States from Jefferson to Genomics, edited by Evelynn M. Hammonds and Rebecca M. Herzig.

The Nature of Difference is a timely addition to conversations about race and genomics, organized so as to allow readers to make new connections between contemporary discourses and the histories of science and race. The text’s selections and the organization of the selections with introductory material are especially helpful, serving as navigational aids to the sometimes astounding statements of racial fact that could otherwise be conversation stoppers. The book would be useful either as …

Organizational Narcissism And Virtuous Behavior, Dennis Duchon, Brian Drake Jan 2009

Organizational Narcissism And Virtuous Behavior, Dennis Duchon, Brian Drake

Department of Management: Faculty Publications

Extreme narcissistic organizations are unable to behave ethically because they lack a moral identity. While such organizations are not necessarily unethical intentionally, they become self-obsessed and use a sense of entitlement, self-aggrandizement, denial, and rationalizations to justify anything they do. Extreme narcissistic organizations might develop formal ethics programs, but such programs will have little effect on behavior.

Department of Entomology: Faculty Publications

1 The western corn rootworm Diabrotica virgifera virgifera LeConte is a major insect pest of field maize, Zea mays L. Larvae can cause substantial injury by feeding on maize roots. Larval feeding may destroy individual roots or root nodes, and reduce plant growth, stability, and yield. Costs associated with managing corn rootworms in continuous maize are annually one of the largest expenditures for insect management in the United States Corn Belt.

2 Even though D. virgifera virgifera has been studied intensively for over 50 years, there is renewed interest in the biology, ecology, and genetics of this species because of …

Gene Expression Profiling Of Tolerant Barley In Response To Diuraphis Noxia (Hemiptera: Aphididae) Feeding, A. Gutsche, Tiffany Heng-Moss, Gautam Sarath, P. Twigg, Yuannan Xia, G. Lu, D. Mornhinweg Jan 2009

Gene Expression Profiling Of Tolerant Barley In Response To Diuraphis Noxia (Hemiptera: Aphididae) Feeding, A. Gutsche, Tiffany Heng-Moss, Gautam Sarath, P. Twigg, Yuannan Xia, G. Lu, D. Mornhinweg

Department of Entomology: Faculty Publications

Aphids are, arguably, the single most damaging group of agricultural insect pests throughout the world. Plant tolerance, which is a plant response to an insect pest, is viewed as an excellent management strategy. Developing testable hypotheses based on genome-wide and more focused methods will help in understanding the molecular underpinnings of plant tolerance to aphid herbivory. As a first step in this process, we undertook transcript profiling with Affymetrix GeneChip Barley Genome arrays using RNA extracted from tissues of tolerant and susceptible genotypes collected at three hours, three days and six days after Diuraphis noxia introduction. Acquired data were compared …

Cross-Layer Analysis Of The End-To-End Delay Distribution In Wireless Sensor Networks, Yunbo Wang, Mehmet C. Vuran, Steve Goddard Jan 2009

Cross-Layer Analysis Of The End-To-End Delay Distribution In Wireless Sensor Networks, Yunbo Wang, Mehmet C. Vuran, Steve Goddard

School of Computing: Conference and Workshop Papers

Emerging applications of wireless sensor networks (WSNs) require real-time quality of service (QoS) guarantees to be provided by the network. However, designing real-time scheduling and communication solutions for these networks is challenging since the characteristics of QoS metrics in WSNs are not well known yet. Due to the nature of wireless connectivity, it is infeasible to satisfy worst-case QoS requirements in WSNs. Instead, probabilistic QoS guarantees should be provided, which requires the definition of probabilistic QoS metrics. To provide an analytical tool for the development of real-time solutions, in this paper, the distribution of end-to-end delay in multi-hop WSNs is …

Gathering Cows Using Virtual Fencing Methodologies, Dean M. Anderson, Marek Doniec, Carrick Detweiler, Iuliu Vesilescu, Daniela Rus, Barbara Nolen, Roy Libeau Jan 2009

Gathering Cows Using Virtual Fencing Methodologies, Dean M. Anderson, Marek Doniec, Carrick Detweiler, Iuliu Vesilescu, Daniela Rus, Barbara Nolen, Roy Libeau

School of Computing: Conference and Workshop Papers

Free-ranging livestock are classically controlled by herders. Holding, moving, or gathering free-ranging cattle requires flexible husbandry practices for efficient and effective lowstress animal management. Behavioral theory and practical experience indicates cattle can be taught to respond to auditory cues. Preliminary research has demonstrated that cows can be gathered autonomously using recorded audio cues associated with manual gathering. However, efficient gathering requires movement in the proper direction. Therefore, we believe using audio cues administered from directional virtual fencing (DVF™) equipment can facilitate proper animal orientation and facilitate the gathering of animals with minimal human intervention. Results from applying directional audio cues …

Comparison Of Fuzzy Clustering Methods And Their Applications To Geophysics Data, David J. Miller, Carl A. Nelson, Molly Boeka Cannon, Kenneth P. Cannon Jan 2009

Comparison Of Fuzzy Clustering Methods And Their Applications To Geophysics Data, David J. Miller, Carl A. Nelson, Molly Boeka Cannon, Kenneth P. Cannon

Department of Mechanical and Materials Engineering: Faculty Publications

Fuzzy clustering algorithms are helpful when there exists a dataset with subgroupings of points having indistinct boundaries and overlap between the clusters. Traditional methods have been extensively studied and used on real-world data, but require users to have some knowledge of the outcome a priori in order to determine howmany clusters to look for. Additionally, iterative algorithms choose the optimal number of clusters based on one of several performance measures. In this study, the authors compare the performance of three algorithms (fuzzy c-means, Gustafson-Kessel, and an iterative version of Gustafson-Kessel) when clustering a traditional data set as well as real-world …
