Batson, Empowerment And New Jury Models: The Case For ‘Open Inquiry’, Patrick C. Brayer Jul 2009

Batson, Empowerment And New Jury Models: The Case For ‘Open Inquiry’, Patrick C. Brayer

Faculty Works

This 2009 article recommends the practice technique of “open inquiry,” which encourages attorneys and courts to ask jurors to openly identify their race, gender, and ethnicity during voir dire for purposes of appellate review under Batson v. Kentucky and related holdings. An open inquiry helps protect the rights of all jurors to sit. It thus creates a greater chance that juries are more diverse and promotes more voices and experiences during deliberation. The open inquiry method also promotes individual juror participation and increases the group's receptiveness toward individual voices during deliberations. Most importantly, open inquiry forces practitioners to rethink how …

Choice Ideology And The Parameters Of Its Practice: Alternative Abortion Narratives In New Mexico, Abigail Rae Adams Jul 2009

Choice Ideology And The Parameters Of Its Practice: Alternative Abortion Narratives In New Mexico, Abigail Rae Adams

Anthropology ETDs

The ideology of choice, embedded in the pro-choice, anti-abortion debate in the United States, is founded on Enlightenment notions that take the autonomous individual with perfect knowledge and rationality as the unit of analysis. The basic premise is that each woman 'chooses' from a variety of equally accessible options. Hidden in the political language of choice are the constraints all women face as they attempt to negotiate reproduction, especially if they wish to end a pregnancy. 'Choice' does not exist as an abstract freedom, but is situated within the realities of power and agency. This paper examines the ability of …

Healers And Helpers, Unifying The People: A Qualitative Study Of Lakota Leadership, Kem M. Gambrell Jul 2009

Healers And Helpers, Unifying The People: A Qualitative Study Of Lakota Leadership, Kem M. Gambrell

Department of Agricultural Leadership, Education, and Communication: Dissertations, Theses, and Student Research

The purpose of this critical grounded theory qualitative study was to explore Lakota Leadership from a Native perspective. Interviews were conducted with enrolled members of a Lakota tribe in an urban setting as well as on the Rosebud reservation to gain better awareness of leadership through a non-mainstream viewpoint. Previously, in order to understand leaders and followers, research limited its scope of discernment to dominant society, implying that non-mainstream individuals will acquiesce, or that differences found are inconsequential. Leadership scholars also have implied that leadership theory is “universal enough”, and can be applied globally regardless of influences such as race, …

War, Peace, And The Landscape Of The Inka Heartland, Terence N. D'Altroy, Darryl A. Wilkinson Jul 2009

War, Peace, And The Landscape Of The Inka Heartland, Terence N. D'Altroy, Darryl A. Wilkinson

Cardozo Public Law, Policy & Ethics Journal

The article argues that the conservation of cultural heritage in the Inka imperial heartland must move beyond the protection of discrete archaeological sites to encompass the broader landscape, which includes intangible elements such as social memory, power dynamics, and historical narratives. The authors advocate for a holistic approach to heritage management that integrates the physical environment with the cultural and historical contexts that give landscapes their significance.

Place-Making As Contemplative Practice, Douglas E. Christie Jul 2009

Place-Making As Contemplative Practice, Douglas E. Christie

Theological Studies Faculty Works

In an age of chronic and widespread displacement, the work of place-making—the discovery and cultivation of a sense of place—has gained new significance and meaning. In this essay, I propose to consider how place-making can be understood as a form of contemplative practice. Anthropologist Keith Basso describes place-making as a work of “retrospective world-building” that enables a person or community to see a place in all its richness and complexity and hold that place in the imagination. Following the work of photographer Robert Adams, I want to suggest that what makes this work contemplative in character is the integration and …

Gender And The Value Of Bodily Goods: Commodification In Egg And Sperm Donation, Rene Almeling Jul 2009

Gender And The Value Of Bodily Goods: Commodification In Egg And Sperm Donation, Rene Almeling

Law and Contemporary Problems

Listing a child for sale in the local paper's classified section is unthinkable, and it is illegal for donors to sell organs in the US. Yet fertility programs routinely recruit young women and men to "donate" eggs and sperm in return for financial compensation. Payments to women vary substantially, both within particular agencies and in different regions of the US, but the national average is around $4,200. Here, Almeling constructs a theoretical framework analyzing the social process of assigning value to the human body. He further describes the historical emergence of the market in eggs and sperm before turning to …

Applications And Potentials For Biogenic Methane Recovery Operations In Nebraska Agriculture, Industry, And Economic Development, David Micheal Dingman

Department of Environmental Studies: Undergraduate Student Theses

ABSTRACT: This thesis report illustrates the applications and potentials of biogenic methane recovery in Nebraska’s agricultural and industrial sectors and as a means for increasing sustainable economic development in the state’s rural communities. As the nation moves toward a new green economy, biogenic methane recovery as a waste management strategy and renewable energy resource presents significant opportunities for Nebraska to be a national and world leader in agricultural and industrial innovation, advanced research and development of renewable energy technology, and generation of new product markets. Nebraska’s agricultural economy provides a distinct advantage to the state for supporting methane recovery operations …

From Judging Culture To Taxing "Indians": Tracing The Legal Discourse Of The "Indian Mode Of Life", Constance Macintosh Jul 2009

From Judging Culture To Taxing "Indians": Tracing The Legal Discourse Of The "Indian Mode Of Life", Constance Macintosh

Osgoode Hall Law Journal

In this article I consider how judicial decision making characterizes Indigenous peoples' culture outside the context of determinations under section 35(1) of the Constitution Act, 1982. I am concerned with how contemporary jurisprudence sometimes subjects Indigenous people to stereotyped tests of Aboriginality when they seek to exercise legislated rights. These common law tests of Aboriginality tend to turn on troubling oppositional logics, such as whether or not the Indigenous person engages in waged labour or commercial activities. These tests arose in historic legislation and policy that were premised on social evolutionary theory and were directed at determining whether an Indigenous …

Developing A Philosophical Profile Of The Individual For Complex Problem-Solving Through Agent-Based Modeling, Ipek Bozkurt Jul 2009

Developing A Philosophical Profile Of The Individual For Complex Problem-Solving Through Agent-Based Modeling, Ipek Bozkurt

Engineering Management & Systems Engineering Theses & Dissertations

Research that focuses on the emotional, mental, behavioral and cognitive capabilities of individuals has been abundant within disciplines such as psychology, sociology, and anthropology, among others. The main argument made in this dissertation, however, is that a different perspective is necessary in order to gain insight about individuals when facing the complex problems that are presented within engineering and management disciplines. This is done by developing the Philosophical Profile of the Individual (PPI) that uses epistemology, ontology and teleology as underlying dimensions of philosophical predispositions. The epistemology dimension considers whether an individual is an Empiricist or a Rationalist, the ontology …

Holism And Human History, Martin Zwick Jul 2009

Holism And Human History, Martin Zwick

Complex Systems Faculty Publications and Presentations

This paper uses a systems-theoretic model to structure an account of human history. According to the model, a process, after its beginning and early development, often reaches a critical stage where it encounters some limitation. If the limitation is overcome, development does not face a comparable challenge until a second critical juncture is reached, where obstacles to further advance are more severe. At the first juncture, continued development requires some complexity-managing innovation; at the second, it needs some event of systemic integration in which the old organizing principle of the process is replaced by a new principle. Overcoming the first …
