Freedom Of The Press 2.0, Edward Lee

In today's digital age, copyright law is changing. It now attempts to regulate machines. Over the past twenty years, and particularly with the advent of the Internet, copyright holders have increasingly invoked copyright law to regulate directly - indeed, even to prohibit - the manufacture and sale of technology that facilitates the mass dissemination of expressive works. Although the concerns of copyright holders about the ease of digital copying are understandable, the expansion of copyright law to regulate - and, in some cases, to prohibit - technologies raises a troubling question. Can the government regulate under copyright law technologies that …

Jesus The Christ As A Jun-Zi In Confucian Perspectives, John Changjin Bai Jan 2009

Jesus The Christ As A Jun-Zi In Confucian Perspectives, John Changjin Bai

School of Theology and Seminary Graduate Papers/Theses

In this paper, I seek to understand who Jesus is, through the lenses of “jun-zi 君子” (best translated as gentleman), a discussion and comparison between the concept of personhood of the jun-zi in Confucianism perspectives and the story of Jesus in the New Testament, I believe there is the possibility and implication to present an excellent image of Jesus the Christ as a jun-zi within Confucian personhood. Jesus, his ethical norm, high moral standard and religious life are like Confucian jun-zi. If we evangelize or evaluate the concepts of traditional Chinese Confucian jun-zi, Jesus would appear as a …

A Green Room Experience: A Comparison Of Business & Leisure Travelers' Preferences, Michelle Millar, Seyhmus Baloglu Jan 2009

A Green Room Experience: A Comparison Of Business & Leisure Travelers' Preferences, Michelle Millar, Seyhmus Baloglu

Hospitality Management

To gain a better understanding of whether environmental consciousness of business and leisure travelers translates to like-minded preferences in the hotel industry, this study assessed the environmental attitudes of both types of travelers, their green behavior at home, and the importance they place on having different green attributes in a hotel. Results of an online survey indicated that business and leisure travelers are very similar when rating the importance of specific green attributes. They differ, however, in their environmental attitudes and green behavior performed at home. These results provide a clearer picture of the profile of the traveler that may …

Food Safety And The Role Of The Government: Implications For Csr Policies In China, R Dellios, Xiaohua Yang, N K. Yilmaz Jan 2009

Food Safety And The Role Of The Government: Implications For Csr Policies In China, R Dellios, Xiaohua Yang, N K. Yilmaz

Economics, Law, and International Business

This study investigates food scandals and the role of government in corporate social responsibility (CSR) in the food industry and explores strategies for the Chinese government to tackle the food safety problems that abound in China. Based on the theoretical discussion of four types of CSR and the empirical evidence from four case studies, we argue that government influence on CSR in the food industry is determined by the intensity and salience of its own behavior and actions including regulations. We further believe that a balanced CSR strategy covering economic, legal, ethical and philanthropic considerations would work best for China. …

Legal Taxonomy, Emily Sherwin Jan 2009

Legal Taxonomy, Emily Sherwin

Cornell Law Faculty Publications

This essay examines the ambition to taxonomize law and the different methods a legal taxonomer might employ. Three possibilities emerge. The first is a formal taxonomy that classifies legal materials according to rules of order and clarity. Formal taxonomy is primarily conventional and has no normative implications for judicial decision-making. The second possibility is a function-based taxonomy that classifies laws according to their social functions. Function-based taxonomy can influence legal decision-making indirectly, as a gatekeeping mechanism, but it does not provide decisional standards for courts. Its objective is to assist in analysis and criticism of law by providing an overview …

Burden Of Proof, Prima Facie Case And Presumption In Wto Dispute Settlement, John J. Barceló Iii Jan 2009

Burden Of Proof, Prima Facie Case And Presumption In Wto Dispute Settlement, John J. Barceló Iii

Cornell Law Faculty Publications

The essay maintains that the WTO Appellate Body's concepts and terminology concerning a claimant's burden of proof-the concepts of prima facie case, presumption, and burden shifting-are disturbingly ambiguous and potentially misleading. This is so whether one thinks of these terms from either a common law or a civil law perspective. In the face of the current ambiguity, a future panel might understand the AB's prima facie case concept to require an overwhelming level of proof from the claimant. On the other hand, a different panel might allow a rather weak level of claimant's proof to meet the prima facie requirement, …

Genetic And Environmental Contributions To Body Mass Index: Comparative Analysis Of Monozygotic Twins, Dizygotic Twins And Same-Age Unrelated Siblings, Nancy Segal, R. Feng, Shirley Mcguire, D. Allison, S. Miller Jan 2009

Genetic And Environmental Contributions To Body Mass Index: Comparative Analysis Of Monozygotic Twins, Dizygotic Twins And Same-Age Unrelated Siblings, Nancy Segal, R. Feng, Shirley Mcguire, D. Allison, S. Miller

Psychology

Background—Earlier studies have established that a substantial percentage of variance in obesity-related phenotypes is explained by genetic components. However, only one study has used both virtual twins (VTs) and biological twins and was able to simultaneously estimate additive genetic, non-additive genetic, shared environmental and unshared environmental components in body mass index (BMI). Our current goal was to re-estimate four components of variance in BMI, applying a more rigorous model to biological and virtual multiples with additional data. Virtual multiples share the same family environment, offering unique opportunities to estimate common environmental influence on phenotypes that cannot be separated from …

Movements, Distribution, And Abundance Of Great Argus Pheasants (Argusianus Argus) In A Sumatran Rainforest, Nurul L. Winarni, Timothy G. O'Brien, John P. Carroll, Margaret F. Kinnaird Jan 2009

Movements, Distribution, And Abundance Of Great Argus Pheasants (Argusianus Argus) In A Sumatran Rainforest, Nurul L. Winarni, Timothy G. O'Brien, John P. Carroll, Margaret F. Kinnaird

School of Natural Resources: Faculty Publications

We used radiotelemetry, habitat sampling, camera trapping, and line-transect surveys to explore movement patterns, distribution, and abundance of Great Argus Pheasants (Argusianus argus) in Sumatra, Indonesia. We radiotracked six adult and one subadult males. Territories averaged 14.5 ± 8.5 ha, and home-range size did not vary by month or by relative abundance of selected plant foods. Daily travel distance (849 ± 211 m) varied significantly between months but did not reflect changes in plant foods. Territories were used almost exclusively by resident males. Males preferentially used undisturbed forest (habitat I). Vegetation structure at male display sites and random points indicated …

A Phylogenetic Supertree Of The Fowls (Galloanserae, Aves), Soo Hyumg Eo, Olaf R.P. Bininda-Emonds, John P. Carroll Jan 2009

A Phylogenetic Supertree Of The Fowls (Galloanserae, Aves), Soo Hyumg Eo, Olaf R.P. Bininda-Emonds, John P. Carroll

School of Natural Resources: Faculty Publications

The fowls (Anseriformes and Galliformes) comprise one of the major lineages of birds and occupy almost all biogeographical regions of the world. The group contains the most economically important of all bird species, each with a long history of domestication, and is an ideal model for studying ecological and evolutionary patterns. Yet, despite the relatively large amount of systematic attention fowls have attracted because of their socio-economic and biological importance, the species-level relationships within this clade remain controversial. Here we used the supertree method matrix representation with parsimony to generate a robust estimate of species-level relationships of fowls. The supertree …
