Rethinking Patent Fraud Enforcement In A Reform Era, Kali Murray, Dmitriy Vinarov

Marquette Intellectual Property Law Review

This Article contends that, while the defense of inequitable conduct offers an avenue to combat fraudulent patent applications, the doctrine suffers from shortcomings that spring from two compromises. First, the amorphous nature of the equitable defense prompts institutional conflict between the United States Patent and Trademark Office and the Federal Circuit. Second, by relegating enforcement solely to a patentee's market competitors, the defense fails to protect the public interest adequately. In light of these compromises, the authors propose two goals to guide current reform efforts in Congress. A Continent-Wide Clone: Population Genetic Variation Of The Invasive Plant Hieracium Aurantiacum (Orange Hawkweed; Asteraceae) In North America, Eli S. Loomis, Lila Fishman

We investigated the population genetic structure of the invasive plant Hieracium aurantiacum (Asteraceae), a facultative apomict. We generated amplified fragment length polymorphism fingerprints for H. aurantiacum samples from across its invasive range in North America (N = 226) and from six other North American native and invasive Hieracium species (N = 60). Almost no genetic variability was found in the North American H. aurantiacum across locations from Alaska and Oregon to Pennsylvania and Ontario (clonal diversity = 0.035). In contrast, other Hieracium species showed a range of clonal diversities (range = 0.154-1.0). The single H. aurantiacum genotype that dominated the …

An understanding of how communities are organized is a fundamental goal of ecology but one which has historically been elusive for microbial systems. We used a bar-coded pyrosequencing approach targeting the V3 region of the bacterial small-subunit rRNA gene to address the factors that structure communities along the thermal gradients of two alkaline hot springs in the Lower Geyser Basin of Yellowstone National Park. The filtered data set included a total of nearly 34,000 sequences from 39 environmental samples. Self-Love And Forgiveness: A Holy Alliance?, Patrick Mckinley Brennan

Forgiving is not pardoning, excusing, condoning, forgetting, or reconciling, nor is forgiving just about a change in emotions on the part of a victim. This paper pursues a virtue-theoretic account of the human person in the context of the theology of Thomas Aquinas, arguing that human forgiveness is the form love takes by an offended toward her offender. The paper argues, first, for the priority of the offended person's self-love and, second, for such self-love's extension into love of the offender as another self. Expression of key metabolic genes and proteins involved in mRNA translation, energy sensing, and glucose metabolism in liver and skeletal muscle were investigated in a late-gestation fetal sheep model of placental insufficiency intrauterine growth restriction (PI-IUGR). PI-IUGR fetuses weighed 55% less; had reduced oxygen, glucose, isoleucine, insulin, and IGF-I levels; and had 40% reduction in net branched chain amino acid uptake. In PI-IUGR skeletal muscle, levels of insulin receptor were increased 80%, whereas phosphoinositide-3 kinase (p85) and protein kinase B (AKT2) were reduced by 40%. Expression of eukaryotic initiation factor-4e was reduced 45% in liver, suggesting a unique mechanism limiting …

Literacy, Language and Culture Faculty Publications and Presentations

Schools have the potential to be places where students can come to understand how and why knowledge and power are constructed (Aronowitz & Giroux, 1993). This paper provides an overview of critical literacy from a critical theory/Freirian perspective. Within it, critical literacy is posited as a necessary component of all classroom practices, one that is elemental to Dewey’s (1916) view of democracy, social justice, and what it means to be literate. Features of a critical literacy approach to instruction are provided along with rationales for the necessity of its inclusion in a democratic society.

FY 2009 was the 4th year of operations for the UNL Digital Commons, which again established new records for recruitment, participation, and usage.

During the year, the repository grew from being the 4th largest in the United States to the 2nd largest, overtaking MIT’s DSpace and Ohio State’s KnowledgeBank repositories. Nebraska now trails only Michigan’s Deep Blue in number of documents in a traditionally configured institutional repository.

8,393 new open access articles were deposited, an increase of 1,275 (18%) over the previous year. At June 30, 2009, the repository held 23,885 open-access documents, plus 10,965 ETDs in the ProQuest database, …

The apical domain of the embryo is partitioned into distinct regions that will give rise to the cotyledons and the shoot apical meristem. In this article, we describe a novel screen to identify Arabidopsis thaliana embryo arrest mutants that are defective in this partitioning, and we describe the phenotype of one such mutant, bobber1. bobber1 mutants arrest at the globular stage of development, they express the meristem-specific SHOOTMERISTEMLESS gene throughout the top half of the embryo, and they fail to express the AINTEGUMENTA transcript normally found in cotyledons. Puncture-Resistance Of Gloves For Handling Bats, Patricia W. Freeman, Cliff A. Lemen

University of Nebraska State Museum: Mammalogy Papers

We quantified protection given by a variety of gloves against bat bites by using steel indenters to simulate teeth and measuring forces needed to puncture the gloves. Level of protection given by gloves was compared to expected bite forces and tooth sharpness of bats. Cotton, plastic-coated synthetic fabric, and proprietary materials advertised as puncture- and cut-resistant were easy to penetrate compared to leather gloves. Split leather gives the highest level of protection, but with reduced dexterity. These are best for handling larger bats (>40 g) or if higher safety is preferred. Deerskin gives reasonable protection without much loss in …

In this study, I investigated my classroom of sixth grade mathematic students on how journal writing influences students’ writing and learning and how journal writing influences my mathematics teaching. I discovered that students enjoyed writing in their journals and reading my responses. Students could openly communicate their questions, thoughts, and opinions. They shared with me what it was like for a sixth grade math student. They also pointed out the concepts they understood or the ones that challenged them. In this action research study of my eighth grade mathematics classroom, I investigated what would happen when I shifted part of my instruction to focus on students writing original word problems. I also investigated whether students could show measureable growth in the quality of word problems they wrote throughout the research project.
