Rights Of The Dead, Kirsten Rabe Smolensky Jan 2009

Rights Of The Dead, Kirsten Rabe Smolensky

Hofstra Law Review

This article examines how decedents are treated across a variety of legal disciplines and asks why the law gives the dead certain legal rights but not others. For example, survival statutes allow certain tort claims to be brought after death, most non-personal contracts (except those personal in nature) survive death, and at least one court has suggested that the dead have a nascent constitutional right to reproductive liberty. In contrast, testamentary directions concerning the disposal of property are sometimes ignored and some states disallow posthumous right of publicity or defamation claims. Many legal rules favoring the dead could be explained …

Summer Burrows Of Ord's Kangaroo Rats (Dipodomys Ordii) In Western Nebraska: Food Content And Structure, Jeremy A. White

Biology Faculty Publications

Extent of larder hoarding differs among species of kangaroo rats, and limited information is available for food stored in burrows by Ord's kangaroo rat (Dipodomys ordii)—the most widespread species of Dipodomys. I excavated 9 burrows recently used by adult D. ordii during summer in the Sandhill Region of Nebraska. I observed only small quantities of food stored in burrows. Eight of 9 burrows contained segments of sand dropseed (Sporobolus cryptandrus) in limited quantities. These segments consisted of upper leaves with fruits (containing seeds) housed in sheaths. My observations represent the first documentation of D. ordii storing food in burrows under …

Energy And The Environment: Empowering Consumers, Katrina Fischer Kuh Jan 2009

Energy And The Environment: Empowering Consumers, Katrina Fischer Kuh

Hofstra Law Review

Individual consumers and the local governments that serve them are at the center of the energy-environment equation. Consumers experience the fruits of energy and environmental policies--whether those policies damage the environment and imperil environmental goods or protect the environment but perhaps impose higher costs on consumers--and are in a unique position to influence energy policy and environmental outcomes through their political, behavioral, and consumption choices. In the United States, the individual and household sector generates, by some estimates, thirty to forty percent of GHG emissions. And the harms from individual behaviors and consumption with respect to a wide range of …

Farming Systems Education: Case Study Of Swedish Test Pilots, Lennart Salomonsson, Anna Nilsson, Sofia Palmer, Adam Roigart, Charles A. Francis Jan 2009

Farming Systems Education: Case Study Of Swedish Test Pilots, Lennart Salomonsson, Anna Nilsson, Sofia Palmer, Adam Roigart, Charles A. Francis

Department of Agronomy and Horticulture: Faculty Publications

We describe and analyze a pedagogical experiment that introduced a broad and holistic perspective on complete farming systems, systemic learning tools, and a participatory learning strategy at an early stage in agronomy education. The paper describes the adventure of three students, who came from a conventional agronomy program at the Swedish University of Agricultural Sciences (SLU), who were frustrated with the lack of integrated approaches to the study of agricultural systems and a strong focus on molecular-level processes in their first year of education. They encountered a narrow focus in most courses and the overall curricula of agricultural education that …

Molecular Decay Of The Tooth Gene Enamelin (Enam) Mirrors The Loss Of Enamel In The Fossil Record Of Placental Mammals, Robert Meredith, John Gatesy, William J. Murphy, Oliver A. Ryder, Mark S. Springer Jan 2009

Molecular Decay Of The Tooth Gene Enamelin (Enam) Mirrors The Loss Of Enamel In The Fossil Record Of Placental Mammals, Robert Meredith, John Gatesy, William J. Murphy, Oliver A. Ryder, Mark S. Springer

Department of Biology Faculty Scholarship and Creative Works

Vestigial structures occur at both the anatomical and molecular levels, but studies documenting the co-occurrence of morphological degeneration in the fossil record and molecular decay in the genome are rare. Here, we use morphology, the fossil record, and phylogenetics to predict the occurrence of "molecular fossils" of the enamelin (ENAM) gene in four different orders of placental mammals (Tubulidentata, Pholidota, Cetacea, Xenarthra) with toothless and/or enamelless taxa. Our results support the "molecular fossil" hypothesis and demonstrate the occurrence of frameshift mutations and/or stop codons in all toothless and enamelless taxa. We then use a novel method based on selection intensity …

Apparent Hybridization Between Trimerotropis Agrestis And Trimerotropis Maritima (Orthoptera: Acrididae) In A Recently Disturbed Habitat, Mathew L. Brust, W. Wyatt Hoback, Robert J. Wright

Department of Entomology: Faculty Publications

In Nebraska, the ranges of Trimerotropis maritima (eastern species) and T. agrestis (western species) overlap but populations usually remain separated by habitat preferences. The morphological and color differences between the species are described. However, around Lake McConaughy, a reservoir on the North Platte River which has declined markedly in depth as a result of recent drought, a habitat was created in which the two species coincide and hybridize frequently. The water level in this reservoir had dropped in excess of 20 meters as of 2007, resulting in large expanses of dunes grading into beach habitats. Grasshoppers were collected in the …

Human Rights, American Exceptionalism, And The Stories We Tell, Natsu Taylor Saito Jan 2009

Human Rights, American Exceptionalism, And The Stories We Tell, Natsu Taylor Saito

Faculty Publications By Year

The Universal Declaration of Human Rights represents a remarkable expansion in the recognition of the fundamental rights of all peoples. Nonetheless, consensus on the implementation of these rights is elusive. Two commonly referenced obstacles to achieving such a consensus are: (1) the United States’ practice of unilaterally exempting itself from international human rights treaties, i.e., American exceptionalism; and (2) resistance from those who see the international human rights movement as a means of imposing Western values on non-Western cultures. Considering these as related issues, both deriving from the Eurocentric nature of contemporary international law, this essay suggests that a truly …

Aquaculture Stakeholders' Perceptions, Actions, And Implications For Its Future: A Comparison Of The U.S.A. And Norway, Jingjie Chu Jan 2009

Aquaculture Stakeholders' Perceptions, Actions, And Implications For Its Future: A Comparison Of The U.S.A. And Norway, Jingjie Chu

Open Access Dissertations

Aquaculture has been promoted as an industry that will stimulate economic development, create employment opportunities, supply high-quality protein, and potentially enhance the stocks of the commercially/recreationally important fish species. Yet, despite considerable aquaculture expertise and technology in the U.S.A., the growth of this sector has remarkably underperformed relative to the rest of the world. The dissertation attempts to understand why aquaculture has not been so widely adopted in the U.S.A. in this dynamic aquaculture industry. It investigates the relationship between aquaculture stakeholders' perceptions and their intended actions. The data used in this dissertation were collected via an original online survey …

Exposing The Myth Of Homo Economicus, Ronald J. Colombo Jan 2009

Exposing The Myth Of Homo Economicus, Ronald J. Colombo

Hofstra Law Faculty Scholarship

The prevalence of the "homo economicus" model of humanity has crowded out considerations of important non-economic aspects of human nature - most importantly, the moral dimension of human thought and conduct. As a result, our understanding of the present ills besetting the business world and the market economy is incomplete, and the policy prescriptions flowing therefrom are often suboptimal (if not counterproductive).

This book review situates Moral Markets within this larger debate over human nature generally. I show how, through the presentation of biological evidence and evolutionary theory, Moral Markets repudiates the "homo economicus" model of humankind, and supports the …

Stressed Sexuality : How Props, Stage Directions And Setting Convey Tormented Male Protagonists In Selected Plays Of Tennessee Williams, Sara Temme

Theses, Dissertations and Culminating Projects

This thesis examines how the stage directions, props, and setting are patterned to create themes in character development in selected Tennessee Williams plays. This analysis focuses on four plays from a successful period in Williams’ life from 1955-1961 in which the playwright had established a pattern in developing sexually desirable male characters using symbolism and space: Cat on a Hot Tin Roof (1955), Suddenly Last Summer (1958), Sweet Bird of Youth (1959), and The Night of the Iguana (1961). All four illustrate how Williams shapes the structure of the scenes by directing the space the characters reside in. Characters are …

Algebra Rules Object Boxes As An Authentic Assessment Task Of Preservice Elementary Teacher Learning In A Mathematics Methods Course, Audrey C. Rule, J. E. Hallagan Jan 2009

Algebra Rules Object Boxes As An Authentic Assessment Task Of Preservice Elementary Teacher Learning In A Mathematics Methods Course, Audrey C. Rule, J. E. Hallagan

Open Educational Resources

The purpose of this study was to describe elementary preservice teachers’ difficulties with understanding algebraic generalizations that were set in an authentic context. Fifty-eight preservice teachers enrolled in an elementary mathematics methods course participated in the study. These students explored and practiced with authentic, hands-on materials called “object boxes,” then created sets of their own object box materials. Each algebra rules object box contained materials to illustrate and describe four different algebraic generalizations, or “rules.” The variables “n” and “z” were used in each of the generalizations. For each generalization, there was a set of objects attached to a piece …

Development And Evaluation Of A Novel Automated Physchophysical Instrument For The Investigation Of Nyctalopia Using Multiple Stimulus Light Emitting Diode Matrix Display Arrays., David M.C. O'Brien

Doctoral

Vitamin A deficiency primarily affects young children in developing countries, the symptoms of which initially present as nyctalopia, an inability of the eyes of ‘see’ in low luminance levels, specifically at twilight or at night. Vitamin A deficiency is a major cause of blindness in developing countries and is associated with significant increases in child morbidity and mortality. Nyctalopia may be examined using dark adaptometry; however, current methods of dark adaptometry have many practical limitations, including their unsuitability for use with children. This thesis reports on the design, construction, testing and evaluation of a novel automated dark adaptometer for use …
