The Living Constitution Of Ancient Athens: A Comparative Perspective On The Originalism Debate, Mark J. Sundahl Jan 2009

The Living Constitution Of Ancient Athens: A Comparative Perspective On The Originalism Debate, Mark J. Sundahl

Law Faculty Articles and Essays

This article provides a fresh perspective on the originalism debate by undertaking a comparative study of constitutional interpretation in the United States and ancient Athens. By observing how the ancient Athenians resolved the same interpretational problems that face the Supreme Court today, we are able to gain a better understanding of the issues that drive the originalism debate. The study focuses on Athenian practice in 350 B.C., which falls late in the history of the Athenian democracy, well after the legal system had achieved its final form. Like the United States, Athens had a strong tradition of judicial review and …

Application Of Discrete-Event Simulation In Health Care: A Review, Michael Thorwarth, Amr Arisha

Reports

The acceptance of applying process simulation in health care has significantly increased during the last decade, leading to an increase of publication in this area. Health care managers and researchers that are attracted by the idea of applying simulation in their field, desire to view methodologies and results of different simulation projects, yet may be overstrained by the large volume of the diverse literature. Thus, this paper, structured as a quick reference guide, presents a comprehensive review of process simulation applications in healthcare areas, which summarises projects applied in health care facilities like hospitals, emergency departments, intensive care units, surgical …

Convergence In Human Dialogues Time Series Analysis Of Acoustic Feature, Spyros Kousidis, David Dorran, Ciaran Mcdonnell, Eugene Coyle Jan 2009

Convergence In Human Dialogues Time Series Analysis Of Acoustic Feature, Spyros Kousidis, David Dorran, Ciaran Mcdonnell, Eugene Coyle

Conference papers

Convergence of acoustic/prosodic (a/p) features between two speakers is a well-known property of human dialogue. It has been suggested that this particular aspect of human interaction should be implemented in spoken dialogue systems, so that they can be perceived as more “humanlike”. This paper presents a quantitative analysis method that can provide information required for modeling the phenomenon of convergence. The analysis is a combination of TAMA, a previously introduced data extraction method, and bivariate time series analysis. Results show significant correlation of a/p features between speaker dyads in the recorded dialogues analyzed, and indicate a significant, amount of feedback, which …

Monitoring Convergence Of Temporal Features In Spontaneous Dialogue Speech, Spyros Kousidis, David Dorran Jan 2009

Monitoring Convergence Of Temporal Features In Spontaneous Dialogue Speech, Spyros Kousidis, David Dorran

Conference papers

This paper presents ongoing research on convergence of speech features in human dialogues, in view of simulating this behaviour in spoken dialogue systems. The TAMA method (time-aligned moving average), previously used on monitoring convergence of acoustic prosodic (a/p) features, is applied to temporal properties of speech (between-turn pauses and overlaps). The results are compared to those of an older study on the same features.

TLR4 is the primary sensor of LPS. In this study, we describe for the first time TLR4 interactor with leucine-rich repeats (TRIL), which is a novel component of the TLR4 complex. TRIL is expressed in a number of tissues, most prominently in the brain but also in the spinal cord, lung, kidney, and ovary. TRIL is composed of a signal sequence, 13 leucine-rich repeats, a fibronectin domain, and a single transmembrane spanning region. TRIL is induced by LPS in the human astrocytoma cell line U373, in murine brain following i.p. injection, and in human PBMC. Endogenous TRIL interacts with TLR4 …

Is Jove A Rock Or Leaner? Interpreting The Central Paintings Of Pompeii's House Of The Tragic Poet, Rachel Newberry Jan 2009

Is Jove A Rock Or Leaner? Interpreting The Central Paintings Of Pompeii's House Of The Tragic Poet, Rachel Newberry

Inquiry: The University of Arkansas Undergraduate Research Journal

When confronting a piece of ancient Roman artwork, the modern viewer faces the question, "How do we see like the Romans did?" Geographical, temporal, and cultural differences combine to make the process of understanding ancient art particularly complex. This piece attempts to bridge the gap between ancient Rome and the present through an analysis of the central mythological paintings located in region VI, insula 8 of Pompeii. A three-dimensional model of the insula, created in the honors research colloquium "Digital Pompeii" at the University of Arkansas, is essential to the examination of the complex interaction between the paintings and their …

Democratic Discussion, Kinder R. Donald, Don Herzog Jan 2009

Democratic Discussion, Kinder R. Donald, Don Herzog

Book Chapters

In this piece one of the country’s most accomplished survey researchers joins forces with a major democratic theorist (they happen to be colleagues at the same institution, the University of Michigan)—and together they try to reconcile what might seem irreconcilable: survey research findings about voter ignorance, on the one hand, with John Stuart Mill’s ideal of government by discussion, on the other. Read them carefully to ascertain the basis of reconciliation, for it is subtle: they extrapolate from John Dewey’s concept of “contingent social practices.” That is undoubtedly a mouthful, but it implies—as you will see—that the relative political sophistication …

China's Restructured Commercial Banks: Nomenklatura, Nicholas C. Howson

Book Chapters

In the wake of the Asian Financial Crisis of 1997-98, and accelerating after 2003 the People's Republic of China (PRC or China) has implemented an ambitious reform program directed at the commanding heights of what once pa ed for China ' financial system-the large state-owned and state-managed commercial banks. Contrary to a good deal of advice offered by policy and finance specialists, China did not liquidate or fully privatize these institutions. Instead, the PRC sought to avoid the significant social (and no doubt political) cost associated with liquidation, or real privatization, by instead changing (1) the internal dynamics of, and …

The Resilience Of Law, Joseph Vining Jan 2009

The Resilience Of Law, Joseph Vining

Book Chapters

One of the striking developments in academic law in the past half century is the reconception of law as one of the social sciences. The idea at work in this movement, as Joseph Vining says in this essay, is not that the law should use the findings of other disciplines for its own purposes and in its own way, but that in some deep way law itself - legal thinking, legal life - can and ought to proceed on the premises of social science, indeed of science itself. This is in one sense obviously impossible: a scientific rule is a …

Targeting Tuberculars: Social Stigma And Public Health Campaigns, Filomeno V. Aguilar Jr Jan 2009

Targeting Tuberculars: Social Stigma And Public Health Campaigns, Filomeno V. Aguilar Jr

History Department Faculty Publications

In the fight against tuberculosis one major obstacle is the social stigma associated with the disease. Stigma, which is both relational and contextual, marks the body of the tubercular as a site of danger. This essay reflects on the social history of tuberculosis and proposes that stigma’s contingent history in the Philippines can be traced to public health campaigns carried out during the twentieth century, which sought to segregate and isolate the tubercular to limit contagion but could not provide an effective cure. The stigmatization of tuberculosis persists at present, and public health campaigns may need to address stigma directly.

In Part II, using a post-colonialist theoretical framework, the work of legal scholars from the past twenty years on the subject of ICA is explored. This analysis exposes the centrality of MonoHumanism to our discourse on ICA. In Part III, this Article illustrates how our discourse regarding intercountry adoption contributes to our violating the rights of children (and families) as they are defined in the CRC. Lastly, in Part IV, this Article explores how this argument fits into the current and somewhat polarized debate on ICA and how the …

What Factors Can An Agency Consider In Making A Decision?, Richard J. Pierce Jr Jan 2009

What Factors Can An Agency Consider In Making A Decision?, Richard J. Pierce Jr

GW Law Faculty Publications & Other Works

In State Farm, the Supreme Court said that an agency decision is arbitrary and capricious if the agency did not consider adequately a relevant factor or did consider an impermissible factor. The Court did not indicate how courts should distinguish among three categories of potential decision making factors: mandatory, discretionary but permissible, and impermissible. Until 2007, the case law in both the D.C. Circuit and the Supreme Court addressed these questions in sensible ways. In particular, both courts held consistently that congressional silence with respect to a logically relevant factor rendered the factor a permissible factor that an agency could …

Process Simulation Of Dilute Acid Pretreatment Of Coastal Bermudagrass For Bioethanol Production, Arthur Redding, Deepak R. Keshwani, Jay J. Cheng

Department of Agricultural and Biological Systems Engineering: Presentations and White Papers

Coastal bermudagrass is a promising lignocellulosic feedstock for bioethanol production. It is well suited for the Southeastern United States where it is currently grown for hay production and nutrient management in animal farming operations. Prior experiments have generated sugar and sugar degradation data from the dilute acid pretreatment and enzymatic hydrolysis of bermudagrass over a range of pretreatment conditions. Experimentally, the yield of total glucose and xylose was maximized at 93 % of the theoretical value for the pretreatment conditions 140 °C and 1.2 % sulfuric acid (w/w) for a residence time of 30 minutes. To explore further potential optimum …

Development Of A Quantitative Pasture Phosphorus Management Tool Using The Swat Model, Michael J. White, Daniel E. Storm, Michael D. Smolen, Hailin Zhang

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Assessment tools to evaluate phosphorus loss from agricultural lands allow conservation planners to evaluate the impact of management decisions on water quality. Available tools to predict phosphorus loss from agricultural fields are either: (1) qualitative indices with limited applicability to address offsite water quality standards, or (2) models which are prohibitively complex for application by most conservation planners. The purpose of this research was to develop a simple interface for a comprehensive hydrologic ⁄ water quality model to allow its usage by farmers and conservation planners. The Pasture Phosphorus Management (PPM) Calculator was developed to predict average annual phosphorus (P) …

Phylogenetic Classification Of Escherichia Coli O157:H7 Strains Of Human And Bovine Origin Using A Novel Set Of Nucleotide Polymorphisms, Michael L. Clawson, James Keen, Timothy Smith, Lisa Durso, Tara G. Mcdaneld, Robert Mandrell, Margaret Davis, James Bono

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Background: Cattle are a reservoir of Shiga toxin-producing Escherichia coli O157:H7 (STEC O157), and are known to harbor subtypes not typically found in clinically ill humans. Consequently, nucleotide polymorphisms previously discovered via strains originating from human outbreaks may be restricted in their ability to distinguish STEC O157 genetic subtypes present in cattle. The objectives of this study were firstly to identify nucleotide polymorphisms in a diverse sampling of human and bovine STEC O157 strains, secondly to classify strains of either bovine or human origin by polymorphism-derived genotypes, and finally to compare the genotype diversity with pulsed-field gel electrophoresis (PFGE), a …

Sorption Of Phosphorus From Swine, Dairy, And Poultry Manures, Carl H. Bolster, Karamat R. Sistani Jan 2009

Sorption Of Phosphorus From Swine, Dairy, And Poultry Manures, Carl H. Bolster, Karamat R. Sistani

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

In most phosphorus (P) sorption studies, P is added as an inorganic salt to a predefined background solution such as calcium chloride (CaCl2) or potassium chloride (KCl); however, in many regions, the application of P to agricultural fields is in the form of animal manure. The purpose of this study, therefore, was to compare the sorption behavior of dissolved reactive P (DRP) in monopotassium phosphate (KH2PO4)–amended CaCl2 and KCl solutions with sorption behavior of DRP in three different animal manure extracts. Phosphorus single-point isotherms (PSI) were conducted on eight soils with the following …

Enzymatic Quantification Of Phytate In Animal Manure, Zhongqi He, Heidi W. Waldrip, C. Wayne Honeycutt, M. Susan Erich, Zachary N. Senwo

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Phytate (inositol hexaphosphate) has been identified as a major organic phosphorus (P) form in soil, animal manure, and other environmental samples. Although a number of methods are available for quantitative isolation and determination of phytate, they are time-consuming and not amenable to routine analysis. We developed a simple, rapid method for enzymatic determination of phytate in animal manure. Animal manure was extracted by H2O, 1M hydrochloric acid (HCl), 0.1M sodium acetate (NaOAc, pH5.0) with or without 0.05M ethylenediaminetetraacetate (EDTA), and 0.25M or 0.5M sodium hydroxide (NaOH)–0.05M EDTA. Extracts were diluted (1/10–1/150) and adjusted to pH5.0 in sodium acetate …

Natural Enemies Of The Coccinellidae: Parasites, Pathogens, And Parasitoids, E. W. Riddick, T. E. Cottrell, K. A. Kidd

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

We review aspects of the life histories of representative enemies of coccinellids (both entomophagous and phytophagous species) and expose both potential and real effects that they have on life parameters of their hosts. Lady beetles are attacked by a variety of natural enemies (bacteria, fungi, mites, nematodes, protozoa, wasps, flies). Few of these enemies have the ability to alter significantly the population dynamics of their hosts. This review should encourage further research to help define the role of natural enemies in the population dynamics of coccinellids. Ultimately, the conservation of beneficial lady beetles and the management of nuisance and pestiferous …

From Parasite Genomes To One Healthy World: Are We Having Fun Yet?, Dante Zarlenga, Louis C. Gasbarre

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

In 1990, the Human Genome Sequencing Project was established. This laid the ground work for an explosion of sequence data that has since followed. As a result of this effort, the first complete genome of an animal, Caenorhabditis elegans was published in 1998. The sequence of Drosophila melanogaster was made available in March, 2000 and in the following year, working drafts of the human genome were generated with the completed sequence (92%) being released in 2003. Recent advancements and next-generation technologies have made sequencing common place and have infiltrated every aspect of biological research, including parasitology. To date, sequencing of …
