Daniel Defoe And The Written Constitution, Bernadette Meyler Nov 2008

Daniel Defoe And The Written Constitution, Bernadette Meyler

Cornell Law Faculty Publications

Today, as constitutionalism spreads around the globe, it is embodied de rigueur in written documents. Even places that sustained polities for centuries without a written constitution have begun to succumb to the lure of writtenness. America, we think, spawned this worldwide force, inaugurating a radically new form of political organization when it adopted the U.S. Constitution as its foundational text. Yet the notion of the written constitution had, in fact, received an earlier imprimatur from the pen of Daniel Defoe, English novelist, political pamphleteer, and secret agent. Plying his trades in the early eighteenth century, Defoe, now known largely as …

Leaving The House: The Constitutional Status Of Resignation From The House Of Representatives, Josh Chafetz Nov 2008

Leaving The House: The Constitutional Status Of Resignation From The House Of Representatives, Josh Chafetz

Cornell Law Faculty Publications

Do members of the House of Representatives have a constitutional right to resign their seats? This Article uses that question as a window onto broader issues about the relationship between legislators and citizens and the respective roles of liberalism and republicanism in the American constitutional order. The Constitution explicitly provides for the resignation of senators, presidents, and vice presidents, but, curiously, it does not say anything about resigning from the House of Representatives. Should we allow the expressio unius interpretive canon to govern and conclude that the inclusion of some resignation provisions implies the impermissibility of resignation when there is …

Federalism And Horizontality In International Human Rights , Margaret E. Mcguinness Nov 2008

Federalism And Horizontality In International Human Rights , Margaret E. Mcguinness

Missouri Law Review

The advent of the international human rights system is one of the many changes to international law since the time Missouri v. Holland was decided. As other contributions to this symposium note, one of the challenging federalism questions raised by Holland in this new era is the effect of international human rights treaties and emerging customary international human rights law on U.S. states. And just as the creation of the international human rights regime has affected domestic analysis of federalism, the international human rights system has itself adjusted to the processes of federalism. The human rights regime is largely structured …

Pseudomonas Aeruginosa Elastase Induces Il-8 Production In The Lung Cells Via The Epidermal Growth Factor/Extracellular Signal-Regulated Proteins/Nfîºb Pathway, Ali Azghani Nov 2008

Pseudomonas Aeruginosa Elastase Induces Il-8 Production In The Lung Cells Via The Epidermal Growth Factor/Extracellular Signal-Regulated Proteins/Nfîºb Pathway, Ali Azghani

Biology Faculty Publications and Presentations

Background: The induction of chemokine secretion by fibroblasts is crucial for the migration of leukocytes into the parenchyma of the injured lung. Several bacterial products activate the lung’s structural as well as immune cells to produce pro inflammatory cytokines and chemokines. We report that elastase from Pseudomonas aeruginosa (PE) evokes IL-8 mRNA expression and protein secretion in nonmalignant culture of human lung fibroblasts by activating the receptor for epidermal growth factor (EGFR) and downstream mitogen-activated protein kinases (MAPK) pathway. Methods: We utilized western blot analysis to detect phosphorylation of EGFR and signal transduction intermediates. Northern blot and ELISA analyses were …

The Urgent Reawakening Of The Assyrian Question In An Emerging Iraqi Federalism: The Self-Determination Of The Assyrian People, Paul A. Isaac Nov 2008

The Urgent Reawakening Of The Assyrian Question In An Emerging Iraqi Federalism: The Self-Determination Of The Assyrian People, Paul A. Isaac

Northern Illinois University Law Review

This article introduces the contemporary significance of the Assyrian Question--the longstanding inquiry over the rights of a small religious and ethnic minority in Iraq. Recently, Assyrians have been violently targeted and disproportionately driven from postwar Iraq in massive numbers, threatening to obliterate their presence from their ancestral homeland forever. Addressing their legal rights, the author argues that Assyrians are an indigenous people under international law and are, therefore, entitled to the full exercise of their political, social, and cultural self-determination. The article surveys the international law of self-determination alongside provisions of Iraqi law that have been created to protect Assyrians. …

University of Minnesota, Morris production Our Town by Thornton Wilder and directed by Ray Schultz.

Synopsis: A landmark in American drama, Thornton Wilder’s Pulitzer Prize-winning Our Town tells the story of a small town, Grover’s Corners, New Hampshire, in order to tell us the story of every town, the whole world over. Narrated by the “Stage Manager”, we follow the Gibbs and Webb families, residents of Grover’s Corners, through twelve years of life changes -- from the mundane in Act I, “Daily Life,” to the romantic in Act II, “Love and Marriage,” to the devastating in Act III, “Death and …

Image Analyses Of Two Crustacean Exoskeletons And Implications Of The Exoskeletal Microstructure On The Mechanical Behavior, Liang Cheng, Liyun Wang, Anette M. Karlsson Nov 2008

Image Analyses Of Two Crustacean Exoskeletons And Implications Of The Exoskeletal Microstructure On The Mechanical Behavior, Liang Cheng, Liyun Wang, Anette M. Karlsson

Mechanical Engineering Faculty Publications

The microstructures of exoskeletons from Homarus americanus (American lobster) and Callinectes sapidus (Atlantic blue crab) were investigated to elucidate the mechanical behavior of such biological composites. Image analyses of the cross-sectioned exoskeletons showed that the two species each have three well-defined regions across the cuticle thickness where the two innermost regions (exocuticle and endocuticle) are load bearing. These regions consist of mineralized chitin fibers aligned in layers, where a gradual rotation of the fiber orientation of the layers results in repeating stacks. The exocuticle and endocuticle of the two species have similar morphology, but different thicknesses, number of layers, and …

2d Regional Correlation Analysis Of Single-Molecule Time Trajectories, Xuefei Wang, H. Peter Lu Nov 2008

2d Regional Correlation Analysis Of Single-Molecule Time Trajectories, Xuefei Wang, H. Peter Lu

Chemistry Faculty Publications

We report a new approach of 2D regional correlation analysis capable of analyzing fluctuation dynamics of complex multiple correlated and anticorrelated fluctuations under a noncorrelated noise background. Using this new method, by changing and scanning the start time and end time along a pair of fluctuation trajectories, we are able to map out any defined segments along the fluctuation trajectories and determine whether they are correlated, anticorrelated, or noncorrelated; after which, a cross-correlation analysis can be applied for each specific segment to obtain a detailed fluctuation dynamics analysis. We specifically discuss an application of this approach to analyze single-molecule fluorescence …

Aquatic Perceived Competence Analysis In Children: Development And Preliminary Validation Of A Pictorial Scale, Juan Antonio Moreno Murcia, Luis Miguel Ruiz Pérez Nov 2008

Aquatic Perceived Competence Analysis In Children: Development And Preliminary Validation Of A Pictorial Scale, Juan Antonio Moreno Murcia, Luis Miguel Ruiz Pérez

International Journal of Aquatic Research and Education

The aim of this study was to develop and validate a scale for measuring perceived motor of children in the water (also known as aquatic perceived competence). One hundred boys and girls four and five years old took part in the study and were given a picture questionnaire featuring a series of images of children engaged in a variety of water tasks. Factor analyses were conducted to test whether the ten-item scale is made up of two major dimensions, the first of them referring to willingness (predisposition or attitudes of the children towards water) and the second to the perceived …

Overcoming Lifeguard Shortages: Strategies To Effectively Recruit And Retain Lifeguard Candidates, Brook Macmillan

International Journal of Aquatic Research and Education

A day at the pool or beach can be unpredictable, yet aquatic environments continue to be a major recreation attraction. While most of these families experience a fun-filled adventure and participate in activities such as swimming, sun bathing and boating, others can experience tragedy. Lifeguards are essential to maintaining safety at public pools. They protect lives and provide first response in emergencies. In recent years, like many organizations have faced a shortage of lifeguards available for hire. This article explores the components of a comprehensive lifeguard recruitment and retention strategy that organizations can utilize in order to overcome their staffing …

Centralized College Client Database Creation From Diverse Interrelated Sources, George Hogan

Masters Theses & Doctoral Dissertations

This "Centralized College Client Database Creation from Diverse Interrelated Sources" project was undertaken as a solution for a requirement that exists for the college that I am employed. This requirement was to provide a complete (technology asset wise) profile of college employees, administrative and faculty, which I have called "clients". This is due to the fact that they are clients for the services of the Information Technology Department, for which this system was designed. The main problem to address is that there is no concise information readily available to the Help Desk and Technical Support areas, for which I am …

Curved, Precast, Pretensioned Concrete I-Girder Bridges, Wilast Amorn, Christopher Y. Tuan, Maher K. Tadros

Civil Engineering Faculty Publications

Modern highway construction frequently requires bridges with horizontally curved alignments. Such bridges can be created by superimposing a curved deck slab onto straight girders or by splicing segmental straight girders on the chords of a curved roadway. Of these two methods, a curved superstructure usually results in simpler construction and better appearance.

The Persistence Of Sleep Disturbance In Children Evaluated For Autism Spectrum Disorders: Predictive Factors And The Impact Of Co-Occurring Diagnoses, Celeste Elana Flachsbart Nov 2008

The Persistence Of Sleep Disturbance In Children Evaluated For Autism Spectrum Disorders: Predictive Factors And The Impact Of Co-Occurring Diagnoses, Celeste Elana Flachsbart

Doctor of Psychology (PsyD)

Mounting research suggests that children with autism spectrum disorders (ASDs) and other clinical diagnoses demonstrate a higher prevalence of sleep problems than typically-developing children. Additionally, sleep problems are related to a number of cognitive, emotional, and behavioral concerns in pediatric populations. Limited research exists comparing sleep problems in children with ASDs with sleep problems in other clinical populations, or exploring the length of these sleep problems.

The current study sought to explore the development and improvement of sleep problems over one year, as well as predictors to help identify children at high risk for persistent sleep problem. Impact of age, …

Redefining Terrorism: Why Mexican Drug Trafficking Is More Than Just Organized Crime, Sylvia M. Longmire, Lt. John P. Longmire Nov 2008

Redefining Terrorism: Why Mexican Drug Trafficking Is More Than Just Organized Crime, Sylvia M. Longmire, Lt. John P. Longmire

Journal of Strategic Security

Mexican drug traffickers are more than criminals. They are terrorists. And that's not hyperbole. The tactics, strategy, organization, and even (to a limited extent) the goals of the Mexican drug cartels are all perfectly consistent with those of recognized terrorist organizations. Admittedly, the cartels lack the motivating political or religious ideology most terrorist groups display, and some argue this precludes the application of the "terrorist" label. However, we will show this objection is inclusive at best. Were the United States government to formally recognize the Mexican cartels as the terrorists they are—or at least hybrid organizations that employ terrorist tactics—a …
