This study was conducted to examine the design and implementation of an intensive English-as-a-Second-Language (ESL) program to help students with limited English proficiency improve their English skills and obtain a passing score on the Test of English as a Foreign Language (TOEFL). How the ESL course set high expectations for English-language learners and supported them by linking TOEFL courses with academic content was explored.

Reinventing Eugenics: Reproductive Choice And Law Reform After World War Ii, Mary Ziegler

The article argues that eugenic ideologies did not disappear from American law after World War II but instead evolved and were repackaged in response to shifting political and social norms. The article contends that the concept of reproductive choice became a key tool for redefining eugenic goals, allowing them to influence law and policy in more subtle ways.

This paper is an evaluation of the decision in Novartis AG v. Union of India, where the Madras High Court decided on both, the constitutionality of s. 3(d) of the Indian Patents Act, 1970 and its compatibility with the TRIPS regime. The authors agree with the Court insofar as the court upheld the constitutionality of the section. They are, however, critical of the Court's decision to 'duck' out of deciding TRIPS compatibility on jurisdictional grounds. Direct Price Control On Patented Drugs In India: The Probable Effects On Innovations And Access To Medicines, Ajay Prasad, Varsha Iyengar

Addressing the growing concern stemming from the issue of access to and affordability of drugs, this article argues for the use of a direct price control mechanism to prevent the abuse of monopoly rights emerging from the patenting of pharmaceutical products. The article also demonstrates the limited utility of compulsory licensing in achieving access to medicines, and explodes the myth of direct price control necessarily hindering innovation, consequently putting forward a persuasive case for reformulating and rigorously implementing India's hitherto impotent price control regime.

Pearl millet [Pennisetum glaucum (L) R. Br.] is an important cereal crop in Niger, West Africa and a potential crop for the United States of America (USA). This quasiexperimental study investigated the effects a trust-building intervention had on employee trust specifically in such areas as transparency, responsiveness, understanding and caring, sincerity, and trustworthiness. Specifically, this study addressed the research questions about whether a trust-building intervention with supervisors led to improved working relationships with nonmanagement employees and whether improvements in the working relationships persisted and remained detectable for 6 weeks following the intervention.

Preintervention and postintervention questionnaires were administered to nonmanagement experimental and control groups to measure the dimensions of transparency, responsiveness, understanding and caring, sincerity, and trustworthiness. Purpose – This paper seeks to understand how users determine credibility in the internet environment from a conceptual level and the implications of these new methods of credibility determination on internet tools (primarily software) and services.

Design/methodology/approach – The author first examines the underlying reasons for increased dependence on the internet for information, using electronic commerce as a starting point. The central concept of “information self-sufficiency” is introduced and then examined through the lens of the internet and conversation theory.

In recent years, a subtle shift in constitutional tort doctrine has quietly begun to take root. In Bivens actions, the Supreme Court has recently implied that constitutional tort plaintiffs must seek relief under state law when it is available, rather than invoke their federal constitutional rights. This marks a dramatic change from past practices. Many observers consider the Food and Drug Administration (FDA) vital for the protection of consumer health and safety. One hundred years ago, Congress established the entity that would become the FDA and authorized it to regulate foods and drugs, critical responsibilities that the agency has long discharged carefully. Throughout the past century, the FDA's regulatory power has expanded systematically, albeit gradually, while legislatures and courts in the fifty American jurisdictions broadened liability exposure for manufacturers that sold defective products that injured consumers. Several species of bacteria are involved in the production of cheese, including Lactobacillus brevis and Lactococcus lactis. A custom-designed Affymetrix microarray was recently developed to study gene expression in three organisms on a single chip. This array contains only perfect match features for the coding and non-coding regions in the genomes of all three sequences. The multi-species nature of this array version raises interesting questions regarding the preprocessing or normalization strategies for the analysis of gene expression data. We present and evaluate several possible strategies using both cDNA dilution data and experimental expression data from a repeated measures design. …

The story of Nancy Temple ("Temple") and Arthur Andersen ("Andersen") is infamous in legal ethics. Temple was the in-house lawyer that advised Andersen's employees to shred documents on the eve of the Security and Exchange Commission's ("SEC") investigation of Enron Corporation ("Enron"). Temple's advice triggered a string of events that culminated in the needless demise of America's fifth-largest accounting firm. By contrast, my Arthur Andersen story is unknown, until now that is. In late 1999, I was offered the position on Andersen's in-house staff that Temple ultimately accepted. I declined the offer, for I suspected that Andersen was not seeking …

The article presents a study which demonstrates the effectiveness of an online post baccalaureate teacher certification program developed by a Wisconsin university. The case method approach employing multiple methods and multiple data sources were used to investigate the degree to which pre-service teachers were prepared to teach. It was concluded that the study supports online delivery as an effective means of teacher preparation, but it was limited in the number of students followed into their first year of teaching.

The utility of bulk ground conductivity (BGC) measurements in the estimation of submarine groundwater discharge (SGD) was investigated at four sites covering a range of hydrogeological settings, namely Cockburn Sound (Australia); Shelter Island (USA); Ubatuba Bay (Brazil) and Flic-en-Flac Bay (Mauritius). At each of the sites, BGC was surveyed in the intertidal zone, and seepage meters were used for direct measurements of SGD flow rates. In the presence of detectable salinity gradients in the sediment, a negative correlation between SGD and BGC was recorded. Project Limulus is a long-term study of the population dynamics of the horseshoe crab population in Long Island Sound (LIS). We have tagged over 20,000 spawning adults from >20 beaches ranging from Greenwich to Stonington, CT since 1997. Cumulative recapture rates have reached 9%. On average 90% of the crabs are recaptured within a few miles of their original tag site within the first season. Between seasons, on average, 45% of crabs are recaptured within the same locality of where they were tagged. Of all recaptures, 99% of recaptured individuals are found within LIS. In A Textual-Historical Theory of the Ninth Amendment, 60 Stanford Law Review, I explain how some of the most common theories of the Ninth Amendment either have nothing to do with the actual text of the Amendment or place the text in conflict with similar terms in the Tenth Amendment. Focusing on the actual words of the Amendment, I argue that the text of the Ninth point towards a federalist rule of construction in which the people's retained rights are necessarily left to the control of the collective people in the several states.
