This thesis uses a case study of the process of conducting a systematic review in the field of substance misuse in order to analyse critically how knowledge is cumulated for the purposes of informing social policy. The analysis is grounded in two areas of social research that are seldom drawn together; the methodological (in this instance, the work of the social research methodologist Donald Campbell) and the linguistic (in the form of a measured application of discourse analysis). Impact Of Metal Mining On The Water Quality In The Tamar Catchment, Krongkaew Mighanetara

This study discusses the effects of past mining activities on sediment and water quality in streams and rivers in the Tamar catchment. High trace element concentrations, both in water and sediments, were observed in streams and rivers draining areas associated with abandoned mine sites. Maximum concentrations were observed in the Gunnislake/Calstock mining district, where intense metalliferous mining took place during the 19th century. Mine waste from abandoned mine sites in this area contained up to 6.3% arsenopyrite, 5.8% pyrite, 0.3% chalcopyrite and 24% scorodite. As a result, high concentrations of trace elements of up to 180000 mg kg‾¹ As, 6500 …

The recent spate of cases in which reporters have been subpoenaed, fined, jailed, or otherwise disciplined has laid bare the divisions among the courts over the existence and scope of the “reporter’s privilege.” The cases have also exposed the doctrinal, historical, and theoretical infirmities of the broader law of newsgathering, which encompasses not only source relationships, but also rights of access to places and records, protections against civil and criminal liability for torts and crimes committed in the pursuit of news, and protections against government searches of newsrooms and phone records, among other things. It is generally assumed that financial apportionment between cohabiting parties, when the relationship ends, is determined by the law of property, in which the institution of the trust has a large role to play. Until recently, it has also been assumed that the ordinary law applies, rather than a special law for cohabitants. The trust developed to deal with fact situations far removed from those of modern cohabitation, and it may not be the most appropriate device for the resolution of what are essentially financial disputes between cohabitants. This article examines the limitations of the trust concept in this regard.

In 2001 the Halliday Report, Making Punishments Work: A Review of the Sentencing Framework for England & Wales devised a sentencing framework where sentences – custodial and non-custodial - meant what they said, benefited offenders and society, and ultimately made sense. The new framework was designed to successfully rehabilitate offenders, reduce re-offending and reserve prison for those offenders that justify it by creating novel but ingenious ways of changing the attitudes and behaviours of offenders. The UK government's reforms to the legal aid system were about to be implemented and appeared to be affecting the work undertaken as well as the morale of the solicitors working there. Data Mining Techniques In Fraud Detection, Rekha Bhowmik

The paper presents application of data mining techniques to fraud analysis. We present some classification and prediction data mining techniques which we consider important to handle fraud detection. There exist a number of data mining algorithms and we present statistics-based algorithm, decision treebased algorithm and rule-based algorithm. We present Bayesian classification model to detect fraud in automobile insurance. Naïve Bayesian visualization is selected to analyze and interpret the classifier predictions. We illustrate how ROC curves can be deployed for model assessment in order to provide a more intuitive analysis of the models.

To License Or Not To License: An Examination Of State Statutes Regarding Private Investigators And Digital Examiners, Thomas Lonardo, Doug White, Alan Rea

In this paper the authors examine statutes that regulate, license, and enforce investigative functions in each US state. After identification and review of Private Investigator licensing requirements, the authors find that very few state statutes explicitly differentiate between Private Investigators and Digital Examiners. After contacting all state agencies the authors present a distinct grouping organizing state approaches to professional Digital Examiner licensing. The authors conclude that states must differentiate between Private Investigator and Digital Examiner licensing requirements and oversight.

The proper generation and preservation of digital data from Event Data Recorders (EDRs) can provide invaluable evidence to automobile crash reconstruction investigations. However, data collected from the EDR can be difficult to use and authenticate, complicating the presentation of such information as evidence in legal proceedings. Indeed, current techniques for removing and preserving such data do not meet the court’s standards for electronic evidence. Experimentation with an EDR unit from a 2001 GMC Sierra pickup truck highlighted particular issues with repeatability of results. Kurt Lash believes that, in addition to individual natural rights, the Ninth Amendment protects collective or majoritarian rights as well. In this essay the author explains why Lash’s majoritarian vision is contrary to the antimajoritarianism of the man who devised the Ninth Amendment, James Madison, and those who wrote the Constitution. Not coincidentally, it is contrary to the individualism of the other amendments constituting the Bill of Rights, and the public meaning of the Ninth Amendment as it was received during its ratification. The white-collar criminal defense bar has never been reticent to complain about U.S. Department of Justice (DOJ) policies that threaten its clients or the viability of its practice. But nothing--at least in the author's twenty-plus years of involvement in white-collar issues--has consumed the bar as much as the threats posed to the corporate attorney-client privilege and work-product doctrine. While commentators have identified a variety of assaults on these protections, the bar is most vocally outraged by the DOJ policy, pursuant to which, it charges, federal prosecutors regularly insist that corporations waive these protections to secure cooperation credit, declination of criminal …

In Massachusetts v. Environmental Protection Agency, the Supreme Court confronted the issue of climate change for the first time. The Court held that the Clean Air Act gives the Environmental Protection Agency the authority to regulate greenhouse gases and that the agency may not decline to exercise this authority based either on factors not present in the statute or inconclusive gestures toward uncertainty in the science of climate change. A recent study undertaken by the authors (2007) highlighted that undergraduate nursing students were subjected to varying experiences in clinical practice, which were mediated by a number of factors. Mediating factors included continuity of preceptors, student attitudes, the clinical setting environment, student and preceptor expectations of the clinical practice experience and interactions between the student and preceptor.

Of note, interactions with preceptors were seen to 'make or break' the practical experience. Therefore, the relationship that is forged between preceptor and student is vital in shaping the student's experience of the clinical area and of the real world of nursing work. …
