The Vision Of Enoch: Structure Of A Masterpiece, Terrence L. Szink

The seventh chapter of the Book of Moses portrays Enoch’s vision of the history and future of the world within a specific literary framework. The text, coming from the Joseph Smith Translation of the Bible, outlines three periods of time: (1) the days of Noah, (2) the meridian of time, and (3) the last days. The portrayal of each of these time periods contains five similar characteristics. Szink also compares this text with accounts in the Bible and other nonbiblical sources to further understand the vision and the significance of its framework. Identifying Our Best Candidate For Nephi's Bountiful, Warren P. Aston

Scholars have presented and defended different viewpoints concerning the Lehite journey and the location of Nephi’s Bountiful. Aston explains that some of these arguments contain factual errors, such as claims regarding fertility and timber for Nephi’s ship and a lack of accounting for all possibilities. Discrepancies in theories and differences in opinion do not lessen the worth of all that has been found in Arabia and the supported theories, but acknowledging the sometimes contrary data will aid the search for the best candidate for Nephi’s Bountiful.

Several maps from the seventeenth and eighteenth centuries support details of Lehi’s journey as recorded in the Book of Mormon. In 1751, the renowned cartographer Jean Baptiste Bourguignon D’Anville became the first to include Nahom (or Nehem), Ishmael’s burial place in the Book of Mormon, in his map of Asia. This map and a 1771 map of Yemen are the basis for most accurate maps of Arabia from 1751 to 1814. The spelling varies among the subsequent maps, with most using either D’Anville’s Nehem or Niebuhr’s Nehhm, but the location of Nahom does not differ between those maps that include …

During a recent telephone conversation, a colleague and I discussed whether the United States Supreme Court bears some resemblance to a quasi administrative agency. Of course, the Supreme Court is an Article III court, not an administrative agency. Yet, in more than 50% of the cases on the Court's docket, non parties are permitted to offer legal and/or factual information to supplement the legal and factual arguments made by the parties to the suit. This essay considers how patent law doctrine clouds the historical record of technological development. The essay first surveys a recent book that relied heavily on patent records to reexamine acutely the role of intellectual property in economic development, "The Democratization of Invention," by B. Zorina Khan. The essay's second part discusses how patent law today likely distorts patents as primary historical sources. The law encourages an inventor not to accurately disclose her invention and its place in technological development, but rather to submit vague and overbroad invention descriptions and claims. Old Blood, Bad Blood, And Youngblood: Due Process, Lost Evidence, And The Limits Of Bad Faith, Norman C. Bay

Under the law of lost evidence, absent a showing of bad faith, no due process violation occurs when the police lose potentially exculpatory evidence. This is so even though the evidence may be critical to the defense and even though post-conviction DNA testing has exonerated more than 200 individuals. Ironically, the case that developed that rule of law, Arizona v. Youngblood, is founded on the conviction of an innocent man. This Article critically examines Youngblood and provides a conceptual framework for examining the constitutional right of access to evidence. Taxation Without Liquidation: Rethinking "Ability To Pay", Sergio Pareja

This Article proposes a novel way to tax wealth transfers. Specifically, it suggests that we divide all assets transferred by gift or bequest into two classes--illiquid assets and liquid assets. The recipient should include those assets in income but be allowed two options. With respect to illiquid assets, the recipient should be able to avoid immediate income inclusion if he takes the property with an income-tax basis of zero. With respect to liquid assets, the recipient should be allowed a full income-tax deduction if he rolls the gift or bequest into a deductible IRA. The combination of these simple rules …

Though it is enshrined in the Constitution, the grand jury is one of the least respected institutions in American criminal justice today. Scholars regard the grand jury just as doctors regard the appendix: an organic part of our constitutional makeup, but not of much use. While scholars have proposed reforms, most of them seem only loosely related to the fundamental purpose of the grand jury. This Article places Bryan v. Itasca County in historical context and gives credit where credit is due. From the perspective of three decades, it describes the litigation and its ramifications, and highlights the work of the legal services attorneys who brought Indian tribes this landmark victory. Part I briefly describes the litigation through the state supreme court. Part II discusses, in much greater detail, the appeal to the U.S. Supreme Court. Part II of this Article briefly examines the history of discrimination against persons with mental retardation. Growth, Mortality, And Reproduction Of Poor Cod (Trisopterus Minutus Linn., 1758) In The Central Aegean Sea, Gülnur Meti̇n, Akin Türker İlkyaz, Hasan Tuncay Kinacigi̇l

A total of 1527 of poor cod (Trisopterus minutus Linn., 1758) were collected by trawl hauls between April 2001 and March 2002 from İzmir Bay (central Aegean Sea). The size of the fish (total length) ranged from 10.6 cm (minimum, September) and 24.8 cm (April). The population was composed of 53% males, 41% females, and 6% immature individuals, with a female to male ratio of 1:1.3. The age composition of the samples was from I to V. The von Bertalanffy growth parameters were L_{\infinity} = 28.1 cm, W_{\infinity} = 254.0 g, K = 0.26 y^{-1}, and t_{o} = -1.52 y. …

Lead (Pb) And Copper (Cu) Concentration In The Eggshells Of Audouin´S Gull (Larus Audouinii) In Turkey, Zafer Ayaş, Hüseyi̇n Çeli̇kkan, Mehmet Levent Aksu

Audouin´s gull (Larus audouinii) eggshells from 2 archipelagos (Karaburun-İzmir and Aydıncık-Mersin) in Turkey were collected between 2002 and 2003, and analyzed for lead (Pb) and copper (Cu) content. According to the results, mean Cu level of the eggshells was 1.855 ppm for the Aydıncık colony and 10.202 ppm for the Karaburun colony. Mean Pb level of the eggshells was 0.954 ppm for the Aydıncık colony and 4.601 ppm for the Karaburun colony. The detected metal levels did not seem to have any toxic effects on the Audouin´s gull populations. It is suggested that eggshells from abandoned nests of Audouin´s gulls …

Hibernation Pattern And Importance Of Superoxide Dismutase For The Turkish Hamster, Mesocricetus Brandti (Mammalia: Rodentia), Nuri̇ Yi̇ği̇t, Di̇dem Erten, Nursel Gül

Specimens of Mesocricetus brandti were observed in order to assess the onset of hibernation and the inhibition rate of superoxide dismutase (SOD). The first individual began to hibernate on November 2 and the last animal awoke on May 5. Individual hibernation bouts varied from 8 to 63 days, and the longest uninterrupted hibernation was 4 days. In the hibernation period, the animals lost an average of 27.1 g, ranging from 2.7% to 38% of total body weight. In hibernating animals, the average inhibition rate of SOD was 82.3% while it was 77.5% in active animals. The inhibition rate of SOD …

Interest in the repertory grid technique has been growing in the IS field. This article seeks to inform the reader on the proper use and application of the technique in IS research. The methodology has unique advantages that make it suitable for many research settings. In this tutorial, we describe the technique, its theoretical underpinnings, and how it may be used by IS researchers. We conclude by detailing many IS research opportunities that exist in respect to the repertory grid technique.

Vietnam's sustained investment in primary healthcare since the onset of socialism has lowered infant and childhood mortality rates and improved life expectancy, exceeding progress achieved in other poor countries with comparable levels of income per capita. Genetic testing can be used to identify disease susceptibility, establish diagnostic status, and design therapeutic regimens in medical care. The opportunities to apply genetic knowledge to medical problems have expanded rapidly in the DNA-based era of molecular genetics. Two legal realities are also shaping the development of the genetic testing field in the U.S. First, there is no FDA premarket review of most commercially available genetic tests. Second, many DNA sequences and genetic testing methods are patented. The intersection of these two realities explains some of the clinical dilemmas that have arisen in genetic testing.

Conservation easements are not property arrangements between private parties. They are assets that are conveyed to government entities and charitable organizations to be held and enforced for the benefit of the public. The Politics Of Policing: Ensuring Stakeholder Collaboration In The Federal Reform Of Local Law Enforcement Agencies, Kami Chavis Simmons

Title 42 U.S. C. § 14141 authorizes the United States Department of Justice ("DOJ") to seek injunctive relief against local law enforcement agencies to eliminate a pattern or practice of unconstitutional conduct by these agencies. Rather than initiate lawsuits to reform these agencies, DOJ's current strategy is to negotiate reforms using a process that involves only DOJ representatives, municipality officials, and police management officials. While there are many benefits of negotiating the reforms, the current process excludes important stakeholders directly impacted by the reforms, including community members, who are the consumers of police services, and the rank-and-file police officers, whom …
