What Is The Erie Doctrine - (And What Does It Mean For The Contemporary Politics Of Judicial Federalism), Adam N. Steinman Nov 2008

What Is The Erie Doctrine - (And What Does It Mean For The Contemporary Politics Of Judicial Federalism), Adam N. Steinman

Notre Dame Law Review

As when Erie Railroad Co. v. Tompkins was decided seventy years ago, federal courts today are seen as more favorable to corporate and business interests than many of their state-court brethren. The current situation is due in no small part to federal courts' comparatively pro-defendant approaches to summary judgment, class certification, and other procedural issues. The Court's decision in Bell Atlantic Corp. v. Twombly, which tilts federal pleading standards in favor of defendants, will likely have similar federalism implications. This Article presents a straightforward argument that the Erie doctrine may require federal courts to follow state-law standards on summary judgment, …

The Effect Of Blakely V. Washington On Upward Departures In A Sentencing Guideline State, Brian Iannacchione, Jeremy Ball

Criminal Justice Faculty Publications and Presentations

One of the problems facing the criminal justice system is unwarranted disparity as a result of unbridled discretion. Although disparity, by itself, does not necessarily indicate a problem in the criminal justice system, disparity unwarranted does present a problem. Disparity becomes unwarranted when, controlling for legal factors, extralegal factors such as race/ethnicity, gender, and age influence court processing decisions. The greater the discretion one possesses, the higher the likelihood of unwarranted disparity in one’s decisions (Albonetti, 1991; Meeker, Jesilow, & Aranda, 1992; Bushway & Piehl, 2001). Within the criminal court system, judicial discretion in sentencing has received the most scrutiny.

Distributional Ecology Of The Anemone Shrimp Periclimenes Rathbunae Associating With The Sea Anemone Stichodactyla Helianthus At Tobago, Neville A. Trimm, Floyd E. Hayes Nov 2008

Distributional Ecology Of The Anemone Shrimp Periclimenes Rathbunae Associating With The Sea Anemone Stichodactyla Helianthus At Tobago, Neville A. Trimm, Floyd E. Hayes

Faculty Works

We studied the distributional ecology of the anemone shrimp Periclimenes rathbunae associating with the anemone Stichodactyla helianthus in Tobago, West Indies. The shrimps occupied 83.1% of the anemones (n = 83), with mean densities of 2.8 shrimps per anemone in the population and 3.4 shrimps per occupied anemone, and up to 11 inhabiting a single anemone. Shrimp density was significantly correlated with anemone size. Because the density of shrimps was not significantly correlated with the distance to the nearest neighboring anemone or the number of anemones in a cluster, colonization appears to be related to chance or some unknown factor …

Neuroendocrine Peptides Neuropeptide-Y (Npy) And Peptide-Yy (Pyy) Suppress Cl- Secretion And K+ Secretion In Guinea Pig Distal Colon Through Action At Y2-Receptors, Susan T. Halm, Jin Zhang, Dan R. Halm Nov 2008

Neuroendocrine Peptides Neuropeptide-Y (Npy) And Peptide-Yy (Pyy) Suppress Cl- Secretion And K+ Secretion In Guinea Pig Distal Colon Through Action At Y2-Receptors, Susan T. Halm, Jin Zhang, Dan R. Halm

Neuroscience, Cell Biology & Physiology Faculty Publications

Electrogenic Cl– and K+ secretion in isolated mucosa from guinea pig distal colon measured as short-circuit current (Isc) and transepithelial conductance (Gt) were stimulated by epinephrine (epi), prostaglandin-E2 (PGE2) and carbachol (CCh). neuropeptide-Y (NPY) and peptide-YY (PYY) inhibited by 60% Cl– secretion activated by either PGE2 or PGE2+CCh with EC50’s of 16nM and 6nM, respectively. Neither peptide markedly inhibited the transient component of the PGE2+CCh response. Immunoreactivity (IR) for NPY was present in enteric ganglia and in proximity with crypts. Basolateral membranes of …

Multicolor Conjugated Polymer Dots For Biological Fluorescence Imaging, Changfeng Wu, Barbara Bull, Craig Szymanski, Kenneth Christensen, Jason Mcneill

Publications

Highly fluorescent conjugated polymer dots were developed for demanding applications such as fluorescence imaging in live cells. These nanoparticles exhibit small particle diameters, extraordinary fluorescence brightness, and excellent photostability. Single particle fluorescence imaging and kinetic studies indicate much higher emission rates (∼108 s−1) and little or no blinking of the nanoparticles as compared to typical results for single dye molecules and quantum dots. Analysis of single particle photobleaching trajectories reveals excellent photostability—as many as 109 or more photons emitted per nanoparticle prior to irreversible photobleaching. The superior figures of merit of these new fluorescent probes, together …

Protecting Investment, Profit, And Personnel: Corporations As Social Change Agents, Carole C. Fotino

Electronic Theses and Dissertations

This paper describes a three-level toolkit - The Investment Sustainability Toolkit. The Toolkit assists firms in improving the efficacy of one segment of Corporate Social Responsibility (CSR) initiative by creating at the first level, a strategy of conflict prevention. This strategy is followed by Common Elements of Conflict that Resolves/Becomes Violent, and Key Areas for Stabilization as Level II. The third and final level of the toolkit describes specific initiatives for increasing success, through The Screening Checklist.

The paper assesses through case study, the efforts of Firestone, Inc. in Liberia regarding regional development, stabilization, and economic development. This is done …

It's In Your Nature: A Pluralistic Folk Psychology, Kristin Andrews Nov 2008

It's In Your Nature: A Pluralistic Folk Psychology, Kristin Andrews

Sentience Collection

I suggest a pluralistic account of folk psychology according to which not all predictions or explanations rely on the attribution of mental states, and not all intentional actions are explained by mental states. This view of folk psychology is supported by research in developmental and social psychology. It is well known that people use personality traits to predict behavior. I argue that trait attribution is not shorthand for mental state attributions, since traits are not identical to beliefs or desires, and an understanding of belief or desire is not necessary for using trait attributions. In addition, we sometimes predict and …

Behavioural Analysis Of A Nociceptive Event In Fish: Comparisons Between Three Species Demonstrate Specific Responses, Siobhan C. Reilly, John P. Quinn, Andrew R. Cossins, Lynne U. Sneddon Nov 2008

Behavioural Analysis Of A Nociceptive Event In Fish: Comparisons Between Three Species Demonstrate Specific Responses, Siobhan C. Reilly, John P. Quinn, Andrew R. Cossins, Lynne U. Sneddon

Sentience Collection

Nociception is the sensory mechanism by which potentially harmful stimuli are detected in animals and humans. The behavioural responses to noxious stimulation have been studied in two fish species thus far. However, since species-specific differences are seen in mammals, more species need to be examined to determine whether nociceptive responses are generic in fish. The present study investigated the behavioural and respiratory response to an acute noxious or potentially painful stimulus in common carp (Cyprinus carpio), zebrafish (Danio rerio) and rainbow trout (Oncorhynchus mykiss). Behavioural parameters such as frequency of swimming, use of cover and any anomalous behaviour were measured …

Selective Screenability In Topological Groups, Liljana Babinkostova Nov 2008

Selective Screenability In Topological Groups, Liljana Babinkostova

Mathematics Faculty Publications and Presentations

We examine the selective screenability property in topological groups. In the metrizable case we also give characterizations of Sc(Onbd,O) and Smirnov-Sc(Onbd,O) in terms of the Haver property and finitary Haver property respectively relative to left-invariant metrics. We prove theorems stating conditions under which Sc(Onbd,O) is preserved by products. Among metrizable groups we characterize the countable dimensional ones by a natural game.

Culture Or Adaptation: Milling Stone Reconsidered, Terry L. Jones Nov 2008

Culture Or Adaptation: Milling Stone Reconsidered, Terry L. Jones

Social Sciences

Of interest to D. L. True throughout his career was the California Milling Stone Horizon, the artifact complex dominated by handstones, millingslabs, and crude core tools most frequently associated with the early Holocene in southern California. The basic Milling Stone pattern, identified in 1929 by David Banks Rogers in the Santa Barbara Channel and formally defined by Treganza (1950) and Wallace (1955), was brought to the attention of American archaeologists outside of California by Wallace (1954) and True (1958). Over the next 30 years, D. L. True authored a number of articles and reports on Milling Stone (Basgall and True …
