Procedural Path Dependence: Discrimination And The Civil-Criminal Divide, Julie C. Suk

Procedural path dependence occurs when the particular features of the procedural system that is charged with enforcing a given legal norm determine the substantive path of that norm. This Article shows how the limits of employment discrimination law in two different national contexts can be explained by procedural dynamics. In France, as in several European countries, employment discrimination law is enforced predominantly in criminal proceedings. French criminal procedure enables the discovery of information necessary to prove the facts of discrimination, whereas the limits of French civil procedure make it impossible for such information to be revealed. This presentation will provide an overview of the impact of the European human rights regime on language rights of minorities. I will focus on the most comprehensive legal instrument in the area of minority rights, the Framework Convention for the Protection of National Minorities ("Framework Convention"), and on its monitoring mechanism.1 This treaty, which entered into force approximately ten years ago, has provoked a number of improvements in the protection of language and other rights of national minorities. I believe that it can be a source of inspiration for those working on minority rights outside Europe, even though, within the …

The National Geographic Society's Enduring Voices project notes that about every two weeks another language dies, taking millennia of human knowledge and history with it. Writing in The Wall Street Journal, John J. Miller declared that the increasing pace of language death is "a trend that is arguably worth celebrating ... [because] age-old obstacles to communication are collapsing" and primitive societies are being brought into the modern world.2 However, many speakers of these languages lament their losses and see their identities threatened, as their mother tongues represent their links to their Creators. While technology continues to advance in many countries, the developing countries of the world are still playing catch-up. Technological progress is a key element of economic development, but only when adapted properly and affordably to meet the needs of the recipient country and population. However, development plans involving technology transfers to developing countries often encounter difficulties in the form of conflicting private sector patent' interests, inter-governmental bureaucratic inertia and misplaced or minimal technological investment. Is There A Role For Public Support Of Incumbent Worker On-The-Job Training?, Kevin Hollenbeck
Upjohn Institute Working Papers
States have begun to use training subsidies as a policy tool for employment retention and business competitiveness. This paper summarizes a survey of states concerning their investments in incumbent worker training. Altogether, states are investing about $550 to $800 million, which is perhaps one percent or less of total private sector training costs. The paper further discusses a study conducted for one state in which we found significant fiscal returns implying that underinvestment of public funds for incumbent worker training may be occurring. In this state, primary sector jobs were created or retained at a public cost of less than …
