Neuroimaging And Capital Punishment, O. Carter Snead
Neuroimaging And Capital Punishment, O. Carter Snead
Journal Articles
Can brain scans be used to determine whether a person is inclined toward criminality or violent behavior?
This question, asked by Senator Joseph Biden of Delaware at the hearing considering the nomination of John Roberts to be Chief Justice of the United States, illustrates the extent to which cognitive neuroscience - increasingly augmented by the growing powers of neuroimaging, the use of various technologies to directly or indirectly observe the structure and function of the brain - has captured the imagination of those who make, enforce, interpret, and study the law.
The attraction of the legal community to cognitive neuroscience …

Privacy, Visibility, Transparency, And Exposure, Julie E. Cohen
Privacy, Visibility, Transparency, And Exposure, Julie E. Cohen
Georgetown Law Faculty Publications and Other Works
This essay considers the relationship between privacy and visibility in the networked information age. Visibility is an important determinant of harm to privacy, but a persistent tendency to conceptualize privacy harms and expectations in terms of visibility has created two problems. First, focusing on visibility diminishes the salience and obscures the operation of nonvisual mechanisms designed to render individual identity, behavior, and preferences transparent to third parties. The metaphoric mapping to visibility suggests that surveillance is simply passive observation, rather than the active production of categories, narratives, and, norms. Second, even a broader conception of privacy harms as a function …

In January 1968, the New York Times Magazine printed a speech prepared by George F. Kennan for the dedication of a new library at Swarthmore College under the title "Rebels Without a Program." The response from students and teachers on the campuses was so great that a book was prepared, titled "Democracy and the Student Left." Among the student respondents was the young Bob Oakley.

Review Of The Examination Processes For Membership And Fellowship Of The Australian College Of Veterinary Scientists, Gabrielle Matters
Monitoring Learning
This paper deals with examinations administered by the Australian College of Veterinary Scientists (ACVSc) (herein referred to as ‘the College’) to veterinarians at two levels – membership and fellowship. Membership examinations are set at a level that denotes an above-average level of expertise of the candidate in a particular field, signifying advisory status but no specialist status. Fellowship examinations are set at a very high standard and are intended to signify specialist status. The system of examinations administered by the College involves two components –written and oral/practical. Candidates, for both memberships and fellowships, sit the written examination in early June …

Developing Tests And Questionnaires For A National Assessment Of Educational Achievement, Prue Anderson, George Morgan
Developing Tests And Questionnaires For A National Assessment Of Educational Achievement, Prue Anderson, George Morgan
Assessment and Reporting
This book addresses the design of two types of data collection instruments: student achievement tests and background questionnaires. Part 1 covers the development of an assessment framework and a test blueprint, item writing, pretesting, and final test layout. Part 2 delineates comparable stages and activities in the construction of background questionnaires, which are used to gather information from students, teachers, head teachers, or parents on variables that might help explain differences in student performance on the achievement test. Part 3 describes how to design a manual for test administration to help ensure that all students take the test under standardised …
Radical Anti-Invariant Lightlike Submanifolds Of Semi-Riemannian Product Manifolds, Erol Kiliç, Bayram Şahi̇n
Radical Anti-Invariant Lightlike Submanifolds Of Semi-Riemannian Product Manifolds, Erol Kiliç, Bayram Şahi̇n
Turkish Journal of Mathematics
We introduce radical anti-invariant lightlike submanifolds of a semi Riemannian product manifold and give examples. After we obtain the conditions of integrability of distributions which are involved in the definition of radical anti-invariant lightlike submanifolds, we investigate the geometry of leaves of distributions. We also obtain the induced connection is a metric connection and a radical anti-invariant lightlike submanifold is a product manifold under certain conditions. Finally, we study totally umbilical radical anti-invariant lightlike submanifolds and observe that they are totally geodesic under a condition.

Climate Change, Vulnerability And Adaptation For South-West Western Australia: Phase One Of Action 5.5, Western Australian Greenhouse Strategy, Luke Morgan, Jo Anne Molin, Ross George, Richard Mckellar, Janet Conte
Bulletins 4000 -
This report outlines preliminary findings about the impacts of climate changes that occurred during 1975 to 2005 on the South West’s people, its economy and natural ecosystems. The report focuses on vulnerability and adaptation, identifying useful pointers for future work, particularly in relation to how well the community, stakeholders and decision-makers understand climate change as an issue and a threat.
The Impact Of Biofuel Production On The Western Australian Livestock Industry, Wim Burggraaf, Anne Wilkins
The Impact Of Biofuel Production On The Western Australian Livestock Industry, Wim Burggraaf, Anne Wilkins
Bulletins 4000 -
The Western Australian biofuels industry is in its infancy. There is currently only one small commercial biodiesel manufacturer in the State but there have been several announcements of new biofuel projects in 2006 that will be commercialised by 2010. The projected growth of a new biofuels industry in Western Australia (WA), will create greater competition with other industries that rely on grain as an input in their enterprises. Intensive livestock industries such as beef cattle lot feeding, pig rearing, fattening lambs, growing poultry for meat and eggs and feeding dairy cows depend on a consistent supply of high quality whole …
The European Union’S Shareholder Voting Rights Directive From An American Perspective: Some Comparisons And Observations, Arthur R. Pinto
The European Union’S Shareholder Voting Rights Directive From An American Perspective: Some Comparisons And Observations, Arthur R. Pinto
Fordham International Law Journal
The European Union (“EU”) has recently celebrated its 50th anniversary. This Article is based upon my presentation in the Symposium celebrating the anniversary held at Fordham Law School and sponsored by the Fordham International Law Journal. The Article will look at how the European Union has recently approached company law issues (usually referred to as corporate law in the United States) and particularly shareholder voting rights through the recent EU directive on the exercise of certain rights of shareholders in listed companies (“Voting Rights Directive” or “Directive”). My focus is on company law with regard to the corporate governance of …
The Limitation Of Intellectual Property In The Name Of Competition, Paul Nihoul
The Limitation Of Intellectual Property In The Name Of Competition, Paul Nihoul
Fordham International Law Journal
Intellectual property (“IP”) is often credited with providing an incentive for inventors to develop their creativity. Through IP protection, inventors can recoup their investment and make a profit. That idea, which has inspired legislators worldwide, is currently challenged in the European case law on competition. In the last twenty years, five cases have limited, in the name of competition, the possibility for firms to use IP rights acquired in conformity with applicable laws. These cases are examined in this article. I analyze the scope of the emerging jurisprudence and investigate the arguments articulated, in support of their position, by the …

Filling Some Of The Gaps: The International Law Association (American Branch) Law Of The Sea Definitions Project, George K. Walker
Filling Some Of The Gaps: The International Law Association (American Branch) Law Of The Sea Definitions Project, George K. Walker
Fordham International Law Journal
The Law of the Sea Committee (“LOS Committee” or “Committee”) of the International Law Association's American Branch (“ABILA”) will complete its project, Terms in the 1982 U.N. Convention on the Law of the Sea or in Convention Analysis that the Convention Does Not Define (“Report”), in 2009. If the U.S. Senate gives advice and consent, and President Barack Obama exchanges ratifications, the U.N. Convention on the Law of the Sea (“UNCLOS” or “Convention”) and its 1994 protocol will, belatedly in the view of many, become law for the United States, as they already are for much of the world. It …
The Role Of Informal Legal Institutions In Economic Development, Kevin J. Fandl
The Role Of Informal Legal Institutions In Economic Development, Kevin J. Fandl
Fordham International Law Journal
The purveyance of the rule of law in developing countries has frequently been associated with positive economic development. Better clarity, scope, transparency and enforcement of the laws will promote confidence and trust in the formal legal system, the argument suggests. At its core, this argument misses a fundamental yet widely recognized tangent to the rule of law – the role of informal legal institutions. The perception of legal systems perpetrated by the state - formal legal systems - is negative in many developing countries. Corruption, high costs and lengthy time periods for issue resolution limit the ability and willingness of …
Beyond Contract – The Case For Default Arbitration In International Commercial Disputes, Gilles Cuniberti
Beyond Contract – The Case For Default Arbitration In International Commercial Disputes, Gilles Cuniberti
Fordham International Law Journal
The thesis of this Article is that arbitration should become the default mode of resolution of international commercial disputes. In Part I, I first address the critical issue of the legitimacy of international arbitrators. In the traditional model of voluntary arbitration, the legitimacy of arbitrators flows from the agreement of the parties. By agreeing to have their dispute settled by way of arbitration, the parties have not only empowered the arbitrators, but also abided by the power that they have conferred on them. In the model that I propose, however, arbitration loses its contractual foundation. Would arbitrators also lose all …
