When Obscenity Discriminates, Elizabeth M. Glazer

When public indecency statutes outlaw gender nonconformity, obscenity discriminates; when movie ratings censor representations of sexual minorities, obscenity discriminates, and discriminates on the basis of their status as sexual minorities. This Article addresses obscenity doctrine's infliction of first generation, or status discrimination against sexual minorities by conflating "sex" - and the prurient representation of sex that constitutes obscenity - and "sexual orientation." Civil rights lawyers and scholars have turned their attentions away from "first generation" discrimination," where groups experience discrimination on the basis of their status, and toward "second generation" discrimination, where groups experience discrimination for failing to downplay or …

State of the Region Reports: Hampton Roads

The two most respected rankings of the livability of metropolitan areas are David Savigeau’s Places Rated Almanac (PRA) and Bert Sperling’s and Peter Sander’s Cities Ranked and Rated (CRR). In their most recent editions, PRA ranked Hampton Roads 20th in the nation among 370-plus metro areas, while CRR ranked our region 137th. We analyze where these ratings come from and how we compare to other areas.

Someone insists on the right of national culture against globalism, others wish to bridge cultures.[1] Apparently opposing one another, they share the same gaze on the individual character of every culture. To confirm or transcend our cultural or national affiliation through art there exists the common dimension of aesthetic persuasion: that is the subject of this paper.

This was an exploratory study to understand the lived experience of those involved in mentoring relationships within a formal mentoring program in a corporate context. The researcher looked for rich detail about the nature of the relationship from the perspective of the mentor and mentee. To achieve a holistic perspective, the experience of organizational managers was deliberately included in the research. Exploration of this triadic relationship of mentor, mentee, and organizational manager has been neglected in the empirical literature. An exploration of where meaning intersected and diverged among the triad relationship members gave depth to the dimensional frame. Findings suggested …

This dissertation is an arts-based qualitative study in Leadership and Change that describes the qualities of dialogue revealed through the felt experience of Native and non-Native American music composers engaged in a dialogue through music composition. The fifteen co-collaborators who participated in the study range in age from three-years-old to elders. The study is theoretically embedded within Performance Studies, Dr. Carolyn Kenny’s music therapy model Field of Play, and aesthetic philosophy. Methodologically, this work is expressed through performance ethnography and autoethnography and privileges textual and non-textual modes of account including photographs, video excerpts, poetry, and music manuscript. "The Little State Department": Hollywood And The Mpaa's Influence On U.S. Trade Relations, Kevin Lee

Northwestern Journal of International Law & Business

In this article, I argue that the U.S. government has actively advocated domestic film industry interests in bilateral and multilateral trade agreements because of Hollywood's importance to the U.S. economy, and also because of the MPAA's influential lobbying efforts. Furthermore, I show that the MPAA has intervened directly in bilateral trade relations to protect its interests, even when such interests may run counter to the benefit of the U.S. economy.

The current research was qualitative in nature, exploring the experience of having killed in combat from a constructivist and phenomenological framework. The researcher used semi-structured interviews to examine the lived experiences of U.S. soldiers who have killed in combat and how those experiences relate to fundamental assumptions such as benevolence of the world, meaningfulness of the world, and inherent self worth as proposed by Janoff-Bulman. Participants were four men and one woman who served in Operation Iraqi Freedom. The changing nature of armed conflict has had a dramatic impact on the security risks facing humanitarian personnel. Historically, the safety of humanitarian aid delivery was secured through the consent of the relevant Parties to the conflict. However, non-international ethnically-motivated armed conflicts, failed and failing states, and insurgency-based warfare have fundamentally challenged the viability of this traditional security paradigm. In confronting today's complex security climate, humanitarian organizations are faced with a diverse menu of alternatives to enhance their security. August Wilson’s The Piano Lesson features a debate between an African American brother and sister over the ownership of a richly symbolic piano, a family heirloom that represents the Charles family’s slave heritage and its endurance through Reconstruction. Ownership questions like the one presented in The Piano Lesson can usually be resolved in the courts, but Wilson’s play suggests that the law might be unable to resolve property disputes so problematically entangled with the legacy of slavery. Wilson offers, instead, a non-legal resolution to the piano debate presented in his play.
