Aldebaran {Alpha Tauri}, For Symphony Orchestra, Eric Michael Akers Jan 2008

Aldebaran {Alpha Tauri}, For Symphony Orchestra, Eric Michael Akers

Theses, Dissertations and Capstones

Aldebaran {Alpha Tauri} is presented as a programmatic work for symphony orchestra. The eight movements of the piece correspond with a different theme represented by various details of each particular film scene. Notably, the piece centers on a protagonist and antagonistic relationship that is characterized by the titles of the movements. This relationship can be examined by a closer study of excerpts from the piece. The “galactic” premier was held at the Keith Albee Theatre in Huntington, WV on April 13, 2007. The duration of the work is 5’55”.

Plausibility Pleading, A. Benjamin Spencer

Scholarly Articles

Last Term, in Bell Atlantic Corp. v. Twombly, the U.S. Supreme Court dramatically reinterpreted Federal Rule of Civil Procedure 8(a) (2), which requires a "short and plain" statement of a plaintiffs claim. The Court was unabashed about this change of course: it explicitly abrogated a core element of its 1957 decision in Conley v. Gibson, which until recently was the bedrock case undergirding the idea that ours is a system of notice pleading in which detailed facts need not be pleaded. Departing from this principle, the Court in Twombly required the pleading of facts that demonstrate the plausibility of the …

Taking The Guesswork Out Of Lightning-Caused Wildfire, Marjie Brown Jan 2008

Taking The Guesswork Out Of Lightning-Caused Wildfire, Marjie Brown

Joint Fire Science Program Briefs (2007-2012)

Lightning is a natural source of wildfi re ignitions and causes a substantial portion of large wildfi res across the globe. Simple predictions of lightning activity don’t accurately determine fi re ignition potential because fuel conditions must be considered in addition to the fact that most lightning is accompanied by signifi cant rain. Fire operations managers need improved tools for prediction of widespread dry thunderstorms, which are those that occur without signifi cant rainfall reaching the ground. It is these dry storms that generate lightning most likely to result in multiple fi re ignitions, often in remote areas. In previous …

Are They For Real? Activism And Ironic Identities, Amber Day Jan 2008

Are They For Real? Activism And Ironic Identities, Amber Day

English and Cultural Studies Journal Articles

A new breed of political activist has begun to appear on the streets and in the news. They are no longer trying to out-shout their opponents, but are agreeing with them instead, enthusiastically taking their adversary’s position to exaggerated extremes. It is a practice here termed “identity-nabbing,” in which participants pretend to be someone they are not, appearing in public as exaggerated caricatures of their opponents or ambiguously co-opting some of their power. This paper focuses on three groups in particular: The Billionaires for Bush, Reverend Billy, and the Yes Men. Each group stages elaborate, ironically humorous stunts as a …

Whatever Happened To Jane's Baby? Still Another Examination Of 'The Yellow Wall-Paper', Charlie Sweet, Hal Blythe, Barbara Szubinska

English Faculty and Staff Research

Despite all the critical ink spilled over Charlotte Perkins Gilman's classic story, one complex question still persists in college classroom and critical journals: what is the precise condition of the story's narrator and why is the baby presented in such a cursory manner?

Keeping Mason's 'Shiloh' C.R.I.S.P., Charlie Sweet, Hal Blythe

English Faculty and Staff Research

As Kansas foreshadowed for us in "Dust in the Wind" (1978), "nothing lasts forever but the earth and sky." This past year the two of us have transitioned from teachers into our new roles as co-directors of the university's Teaching & Learning Center, but we have still spent a lot of time in the classroom-as observers. One of our unit's services is assessing the classroom presentation of instructors, especially that of new faculty, and we have been overwhelmed by one major pedagogical problem shared by over 90% of the teachers. In short, no matter the discipline, a common problem stands …

Using Knowledge Surveys And Tests To Teach Literature: Do We Assess And Make Asses Of Ourselves, Charlie Sweet, Hal Blythe

English Faculty and Staff Research

Even before the end of the twentieth century, literature teachers were under a great deal of pressure to join the assessment movement, but recently the screws have been tightened, this time by the federal government through the six regional accrediting agencies.

First Grade Fairy Tale Thematic Unit: Improving Writing, Chelsi Gross Jan 2008

First Grade Fairy Tale Thematic Unit: Improving Writing, Chelsi Gross

Regis University Student Publications (comprehensive collection)

This project integrated writing and literature to better teach first grade students how to write. The thematic unit utilizes a variety of learning styles and ties varying schools of thought together into one succinct unit through 14 lessons, one being a celebration. Each lesson is designed to incorporate Colorado State Writing Standards, Step Up to Writing, 6 Trait Writing, and the Writing Process. Upon review, this project was found to be well laid out, successful in addressing a range of learning styles, and easy to implement. However, the project may be at times too difficult for struggling writers and may …

How To Entrench A De Facto State Church In Russia: A Guide In Progress, Robert C. Blitt Jan 2008

How To Entrench A De Facto State Church In Russia: A Guide In Progress, Robert C. Blitt

Scholarly Works

The Russian Orthodox Church's (ROC) assertion of a constitutionally inappropriate role in affairs of state has severely compromised Russia's secular constitutional framework. This gradual but steady erosion of the barrier between church and state is evidenced by a series of contemporary developments that are inexorably linked to the Church's vision of its traditional place in Russian history.

Disturbingly, each successive post-communist regime has further enabled this behavior, and there is no indication that the political transition from President Vladimir Putin to his hand-picked successor, Dmitry Medvedev, will change anything.

This paper argues that the emerging pattern of collusion presents a …
