Deregulating Guilt: The Information Culture Of The Criminal System, Alexandra Natapoff
Deregulating Guilt: The Information Culture Of The Criminal System, Alexandra Natapoff
Cardozo Law Review
The criminal system has an uneasy relationship with information. On the one hand, the criminal process is centrally defined by stringent evidentiary and information rules and a commitment to public transparency. On the other, largely due to the dominance of plea bargaining, criminal liability is determined by all sorts of unregulated, non-public information that never pass through the quality control of evidentiary, discovery, or other criminal procedure restrictions. The result is a process that generates determinations of liability that are often unmoored from systemic information constraints. This phenomenon is exemplified, and intensified, by the widespread use of criminal informants, or …
Self-Incrimination And The Epistemology Of Testimony, Michael S. Pardo
Self-Incrimination And The Epistemology Of Testimony, Michael S. Pardo
Cardozo Law Review
The Supreme Court's limitation of the privilege against self-incrimination to evidence of a testimonial nature has been controversial. The doctrinal reliance on a distinction between physical and testimonial evidence has proven difficult to apply in practice, and it has been criticized as being descriptively inaccurate, analytically incoherent, and normatively indefensible. This article offers a defense of the distinction on epistemological grounds. The philosophical focus on testimony as a source of knowledge provides some insight into what makes testimony distinct as an epistemic source. These considerations are used to provide a coherent and principled way to distinguish what evidence to treat …

Defensive Relationship Marketing: Avoiding Decreasing Sales From Customers In Consumer Goods Mass Markets, Sabine Moeller, Martin Fassnacht, Sonja Klose
Defensive Relationship Marketing: Avoiding Decreasing Sales From Customers In Consumer Goods Mass Markets, Sabine Moeller, Martin Fassnacht, Sonja Klose
Research Collection Lee Kong Chian School Of Business
Enhancing customers' positive attitude towards a company does not exploit the whole potential of what can be done to increase sales. A more defensive approach focuses on the avoidance of customers' negative attitudes and behavior of withdrawal. Since research on this approach is scarce we aim to contribute by developing a model of how retailers can avoid decreasing sales in consumer goods mass markets. According to our aim we focus on customers who have already begun to decrease their sales. Our results show that core performance and trust in the future performance are the silver bullets to avoid decreasing sales.

The Day We All Became Hokies: An Exploratory Uses And Gratifications Study Of Facebook Use After The Virginia Tech Shootings, Sabrena Michelle Carter
Masters Theses
Facebook has been incorporated into the regular activities of over 100 million users. After the Virginia Tech Shootings, individuals began interacting with Facebook in a unique way. This exploratory project analyzed uses and gratifications of Facebook use in the time following the Virginia Tech shootings. In-depth qualitative interviews were conducted with seven college students whose Facebook profiles acknowledged the event in at least one area.
The study found preliminary evidence of Blumler's categories of Surveillance, Diversion, Personal Identity, and Personal Relationships. The category of Curiosity was not substantiated in the findings. New categories were suggested based on the results. These …

A qualitative research design was used to gather data from in-depth interviews of 10 at risk students at an east-central Georgia high school. The students met at least two of the following at risk characteristics: low SES, failing at least one grade and/or in danger of failing four or more courses this year, and high rate of suspension or absenteeism and/or on probation. The instruments for this study consisted of structured interviews that contained questions to elicit the students' views on school with the aim of determining what they identify as critical to their success. The interviews were guided by …

Unto The Third & Fourth Generation Of African-Americans: Kaleb Norris's Stories Of Generational Poverty And Inequality In The South, Derrick Marcel Tennial
College of Graduate Studies: Theses & Dissertations
This is an inquiry that explores the cross-generational lived affects of educational, political, and public policies on my paternal family from 1899 to the present in Northern Mississippi and West Tennessee. It is an exploration of my family's history and my lived experience as the first person in the family to obtain an undergraduate degree, a graduate degree, and a doctorate, who has attempted to use education in a substantive way to break the cycle of generational poverty. Members of six generations of my family are the main characters in the stories collected. Using oral history, I document their experiences. …

Blinded By The White: Soul-Searching For The Pedagogical Possibilities Of Otherness In The White Hearts Of Parents Raising Children Of Color, Debra Clark Sukaratana
College of Graduate Studies: Theses & Dissertations
This study explores the possibilities for those who have been Otherized (minorities). I refer to possibilities in this study as the potential for minority children to prevail in the aspects of life that have been hindered by those who are white. My own personal whiteness is explored as a mother and an educator. Additional exploration in this study comes from the voices and experiences of those white parents who are raising children of color and how they are dealing with their own whiteness as it relates to the upbringing of their children. This study takes a glance at the educational …

Lightness Of Being And The Burden Of Gravity, Emily Don Mixon
Lightness Of Being And The Burden Of Gravity, Emily Don Mixon
College of Graduate Studies: Theses & Dissertations
The challenge of the human condition is to bear the loss that comes with every second, moving forward, breathing without thinking; moving forward, through moments that pass so uneventfully that we will not recall them, along with moments that we experience so profoundly that we begin to use them as landmarks in our personal histories. My view of time is of something that surrounds me and becomes a part of my identity. Yet, as I contemplate what it means to BE, I must face the constancy with which that being also changes. Regardless of the things that I remember, or …

Examination Of The Influence Of Single Sex Instruction On Student Achievement And Behavior At Sixth Grade Level At Two Middle Schools, James Craig Outlaw
Examination Of The Influence Of Single Sex Instruction On Student Achievement And Behavior At Sixth Grade Level At Two Middle Schools, James Craig Outlaw
College of Graduate Studies: Theses & Dissertations
In 2002, the Bush administration inaugurated its signature educational program, No Child Left Behind which included a provision to relax the restrictions of Title IX regarding single sex instruction. Opponents responded by contending there was a lack of credible research on single sex instruction and the proposed modifications were based strictly on the desire to make available to public education the same instructional flexibility exercised by private schools. Supporters of single sex instruction assert that separating the sexes, during middle grades will reduce classroom disruptions allowing increased time on task. Supporters also hold that instructors will employ instructional strategies that …
Relationship Between Teacher Personality Type And Burnout In Rural Middle School Teachers, Melinda Mullis Dennis
Relationship Between Teacher Personality Type And Burnout In Rural Middle School Teachers, Melinda Mullis Dennis
College of Graduate Studies: Theses & Dissertations
Personality type impacts so much of who an individual is and how he/she relates to various life situations and events. Teacher burnout is a contributing factor to ones stress, satisfaction, and continuation in the career of education. Because of the existing teacher shortage in the United States, administrators and policy makers need to understand the factors that contribute to burnout. Stressors that contribute to burnout in teaching include emotional exhaustion, a lack of professional guidance and peer support, and conflict with parents, peers, administrators, and students. Research into burnout suggests that some personality types may be more resilient to these …

Why Are Women With Leadership Certification Not Pursuing School-Level Leadership Positions, Daphney Denise Ivery
College of Graduate Studies: Theses & Dissertations
The purpose of the present study was to understand why women with leadership certification do not seek formal administrative roles. More specifically, the study examined why women with leadership certification choose to pursue a program in administrative preparation; assessed the reasons certified women educators are not moving into formal administrative roles; and identified conditions and structural support systems that these women need in order to help them transition to formal administrative roles. In order to answer the study's major questions, the researcher employed a qualitative research approach with thematic analysis as a major strategy. The researcher then conducted an in-depth …
University Students' Perceptions Of Their Parents' Childrearing Styles Associated With Their Inclinations To Become Parents, Judi Mccracken
University Students' Perceptions Of Their Parents' Childrearing Styles Associated With Their Inclinations To Become Parents, Judi Mccracken
Graduate Theses, Dissertations, and Problem Reports (ETD)
Researchers have associated Diane Baumrind's parenting styles (Baumrind, 1967; Baumrind, 1966; Baumrind, 1968; Baumrind, 1971) with countless outcomes among children, adolescents, and adults. However, few, if any, have investigated an age group's perceptions of their childrearing compared with their inclination to become parents. This study examined 67 West Virginia University students' responses to the Adapted Parenting Attribute Questionnaire (APAQ) completed by Child Development and Family Studies majors in 2007. The purpose was to determine patterns of perceptions in guardians' parenting styles, then compare the participants' inclinations to become parents and their rankings of importance (low, medium, or high; low and …

Determination Of Free Catecholamines In Urine By Tandem Affinity/Ion-Pair Chromatography And Flow Injection Analysis, David H. Thomas, Jay D. Taylor, Omar S. Barnaby, David S. Hage
David Hage Publications
Background—A system was developed for the simultaneous measurement in urine of free catecholamines (i.e., dopamine, norepinephrine, epinephrine) and creatinine (i.e., an indicator of urine output and volume). This method was based on the use of tandem affinity/ion-pair HPLC and flow injection analysis.
Methods—The free catecholamines were extracted directly from urine by using an on-line phenylboronic acid affinity column. The extracted solutes were then separated and measured by ionpair chromatography followed by amperometric detection. Creatinine was measured by an on-line flow injection analysis system based on the Jaffe reaction, which analyzed creatinine as it eluted nonretained from the phenylboronic …
Spiral Of Silence And The Iraq War, Jessica Drake
Spiral Of Silence And The Iraq War, Jessica Drake
Theses
Discussing controversial issues may be hard for some individuals because they fear they may become isolated. The Iraq War serves as one such controversy in which some individuals might avoid publicly expressing their opinion. Spiral of silence, a communication theory set forth by Elisabeth Noelle-Neumann can be used to explain why some individuals will publicly express their opinion of the Iraq War while others will not. A Web-based survey was distributed to Rochester Institute of Technology faculty, staff and students. This study investigated public opinion expression through interactive forms of media such as discussion forums, blogs and Web sites.
Experiences Influencing Degree Completion Articulated By Doctoral Students In Education Administration., David Lee Barnett
Experiences Influencing Degree Completion Articulated By Doctoral Students In Education Administration., David Lee Barnett
Electronic Theses and Dissertations
Educational literature indicates that approximately half of all doctoral students persist to degree completion. The literature indicates persistence rates among the social sciences are even lower. This study examined factors influencing doctoral student persistence in education administration programs. Tinto's theory of graduate student persistence framed four research questions: Do the demographics of doctoral students persisting to degree completion in education administration differ from those not completing their programs? Do doctoral students in education administration programs articulate experiences of academic integration as influencing their persistence? Do doctoral students in education administration programs articulate experiences of social integration as influencing their persistence? …
Piano Study And Gender Associations: A Query Into The Perceptions Of Children Ages Five To Fourteen, Richard C. Winfree
Piano Study And Gender Associations: A Query Into The Perceptions Of Children Ages Five To Fourteen, Richard C. Winfree
Music Theses & Dissertations
From its inception, male composers and performers such as Bach, Mozart, Beethoven, Brahms, Rachmaninoff, Cliburn, and Kempffhad dominated piano performance. Recent research suggests, however, that the piano has been designated with a feminine gender stereotype. The purpose of this study was to examine the perceptions of public school children ages five to fourteen years old relative to gender association and piano study to determine if a gender stereotype existed and at what age, if any, the stereotype stabilized.
To achieve this purpose, two surveys were created and implemented by the researcher. The first survey was administered to 879 students in …
Obesity And Spatial Context In Appalachia, Roberta J. Alt
Obesity And Spatial Context In Appalachia, Roberta J. Alt
Graduate Theses, Dissertations, and Problem Reports (ETD)
The prevalence of obesity has increased substantially over the past 30 years. Obesity is a multi-factorial disorder, which is often associated with many other significant diseases such as diabetes, hypertension and other cardiovascular diseases, osteoarthritis and certain cancers. For these reasons, it is a complex health issue to address. The objective of this study is to identify the factors which are responsible for the spatial variation of adult obesity throughout the Appalachian region. In addition, preliminary examinations are made to identify potential associations between geographic variability in the prevalence of obesity and the characteristics of individuals and places with variable …

The Myth And The Reality Of American Constitutional Exceptionalism, Stephen Gardbaum
The Myth And The Reality Of American Constitutional Exceptionalism, Stephen Gardbaum
Michigan Law Review
This Article critically evaluates the widely held view inside and outside the United States that American constitutional rights jurisprudence is exceptional. There are two dimensions to this perceived American exceptionalism: the content and the structure of constitutional rights. On content, the claim focuses mainly on the age, brevity, and terseness of the text and on the unusually high value attributed to free speech. On structure, the claim is primarily threefold. First, the United States has a more categorical conception of constitutional rights than other countries. Second, the United States has an exceptionally sharp public/private division in the scope of constitutional …

Into The Great Wide Open: The West-German Modernist Bungalow Of The 1960s As A Psycho-Political Re-Creation Of Home, Carola Ebert
RIT Digital Archives
It was in the late the 1950s—on the brink of a prospering, forward-looking era after the re-building of destroyed cities—that the term ‘Bungalow’ arrived in West-Germany, where it took on specific cultural connotations that differ from those in the Anglo-American world. Paradoxically, in Germany the term itself is understood in reference to this world until today, even if the West- German bungalow differs greatly in its architecture. The West-German bungalow marks the intersection of two global phenomena: bungalow culture and modern architecture. Its cultural significance however, can only be understood in relation to the particulars of German history. I will …

Introduction: Telling Places, Nicholas Beech
RIT Digital Archives
I don’t think it is desirable, or possible, in this introduction to a small selection of papers (four) from the conference Telling Places: Narrative and identity in art and architecture, to attempt a complete summary of its proceedings (which included twenty papers, including Davison 2008). Along with the paper presentations, the conference included an exhibition of work produced in the PhD programs at the Bartlett School of Architecture and the Slade School of Fine Art, curated by Christiana Ioannou, Christos Papastergiou, and Laura Cinti; a workshop (that included, most disconcertingly and significantly, actual singing by academics) provided by the artist …
Regulation With Placebo Effects, Anup Malani
Regulation With Placebo Effects, Anup Malani
Duke Law Journal
A growing scientific literature supports the existence of placebo effects from a wide range of health interventions and for a range of medical conditions. This Article reviews this literature, examines the implications for law and policy, and suggests future areas for research on placebo effects. In particular, it makes the case for altering the drug approval process to account for, if not credit, placebo effects. It recommends that evidence of placebo effects be permitted as a defense in cases alleging violations of informed consent or false advertising. Finally, it finds that tort law already has doctrines such as joint and …
