The Many Masks Of Louisa May Alcott’S Gothic Heroines, Lisa Poggi Jan 2008

The Many Masks Of Louisa May Alcott’S Gothic Heroines, Lisa Poggi

Theses, Dissertations and Culminating Projects

Many of the female characters in the Gothic thrillers of Louisa May Alcott wear masks or are or portrayed as “actresses” who conceal their passion with the appearance of being the typical domestic woman. This idea is most clearly presented in “Behind a Mask” and “Pauline’s Passion and Punishment.” In these thrillers, hidden passion causes problems in each heroine’s life, either because her strong will is an unacceptable female characteristic and she will therefore be shunned in some way by society or by those dear to her; or, expressing her passion will result in disaster of some kind. This representation …

Of Persons And The Criminal Law: (Second Tier) Personhood As A Prerequisite For Victimhood, Luis E. Chiesa Jan 2008

Of Persons And The Criminal Law: (Second Tier) Personhood As A Prerequisite For Victimhood, Luis E. Chiesa

Elisabeth Haub School of Law Faculty Publications

The trial of Michael Vick illustrates how our current criminal laws increasingly treat nonhuman creatures as "victims," with all of the consequences that this entails, including the possibility to order that restitution be paid to the animals. In light of these considerations, it is fair to say that from a purely descriptive point of view, nonhuman creatures can qualify for victimhood. This does not mean, however, that this conclusion is normatively appealing. Some have argued that this approach is profoundly misguided, given that the criminal law should only aim to safeguard the rights of humans.

The Enduring Legacy Of Wood V. Lucy, Lady Duff-Gordon, James J. Fishman Jan 2008

The Enduring Legacy Of Wood V. Lucy, Lady Duff-Gordon, James J. Fishman

Elisabeth Haub School of Law Faculty Publications

To mark the ninetieth anniversary of the decision, Pace University School of Law sponsored a Symposium, The Enduring Legacy of Wood v. Lucy, Lady Duff-Gordon, to reconsider the case and to appreciate the accomplishments of Lucy, Lady Duff-Gordon, who as Lucile, became one of the twentieth century's most innovative fashion designers. The Symposium brought together leading contracts scholars from as far away as Australia and England as well as experts on Lucile from the worlds of fashion, museums and fashion scholarship.

The Symposium examined legal issues raised by the decision through panels that focused upon: implication, interpretation and default terms; …

A Post-Morse Framework For Students' Potentially Hurtful Speech (Religious And Otherwise), Emily Gold Waldman Jan 2008

A Post-Morse Framework For Students' Potentially Hurtful Speech (Religious And Otherwise), Emily Gold Waldman

Elisabeth Haub School of Law Faculty Publications

In this Article, I weave together strands from Tinker, Fraser, and Morse, as well as from lower court decisions taking varying approaches to this issue, to propose a new standard for student speech that is potentially hurtful to other students. This approach encompasses, without being limited to, speech that is religiously-motivated in nature. I argue that student speech that is hurtful to other students (whether religiously-motivated or not) should first be divided into two categories: (1) speech that identifies particular students for attack; and (2) speech, such as the message on Harper's T-shirt, that expresses a general opinion without being …

Re-Defining Pro Bono: Professional Commitment To Public Service, Gary A. Munneke Jan 2008

Re-Defining Pro Bono: Professional Commitment To Public Service, Gary A. Munneke

Elisabeth Haub School of Law Faculty Publications

This article suggests that the current version of Rule 6.1 of the Model Rules of Professional Conduct has not achieved its objective of fostering universal public and pro bono service among lawyers, and proposes a change to the current rule that hopefully will be more successful in achieving these laudable objectives. From the earliest days of the Anglo-American legal profession, lawyers have understood public, or pro bono publico, service to be fundamental to their identity as professionals. During the last half of the 20th century, however, this evolution became a revolution, as pro bono increasingly came to be identified with …

Child Pornography's Forgotten Victims, Audrey Rogers Jan 2008

Child Pornography's Forgotten Victims, Audrey Rogers

Elisabeth Haub School of Law Faculty Publications

The goal of this paper is to demonstrate that possession of child pornography is not a victimless crime. It will illustrate the problem and explain the harm suffered by its victims. It will then trace factors that may have contributed to the perception that possession of child pornography is a victimless offense. The first factor is the dual nature of the child pornography laws that addresses both actual and future harm. When this duality is applied to possessors, their link to actual harm appears attenuated because the possessor is not involved in the acts of sexual abuse inherent in producing …

The Teaching And Learning Cycle: Integrating Curriculum, Instruction, And Assessment, Donna L. Jones Jan 2008

The Teaching And Learning Cycle: Integrating Curriculum, Instruction, And Assessment, Donna L. Jones

Christian Perspectives in Education

The philosophies of educators and government entities guide the teaching and learning cycle of curriculum, instruction, and assessment. The educator’s worldview plays an important part in developing these concepts which is demonstrated throughout history. Studying the history of the educational philosophers reveals their beliefs about curriculum, instruction, and assessments and the effects on education today. It shows the importance of integrating all three concepts in the educational process creating the teaching and learning cycle.

Failure To Replicate Evidence Of Decapod Crustacean Nociception, Sakshi Puri, Zen Faulkes Jan 2008

Failure To Replicate Evidence Of Decapod Crustacean Nociception, Sakshi Puri, Zen Faulkes

School of Integrative Biological & Chemical Sciences (Formerly Dept. of Biology)

Introduction Here, we attempt to replicate their experiments with two other species of decapod crustaceans that bracket P. elegans phylogenetically: white shrimp (Litopenaeus setiferus) and Louisiana red swamp crayfish (Procambarus clarkii). Litopenaeus setiferus have a similar ecology to prawns. Procambarus clarkii is widely used in the study of neurobiology, and would be an excellent candidate for further neurophysiological studies.

Discussion We found no behavioral evidence of nociception in either L. setiferus or P. clarkii. This outcome contrasts sharply with results that indicated P. elegans had nociception (Barr et al. 2007).

Federal Fairness To State Taxpayers: Irrationality, Unfunded Mandates, And The 'Salt' Deduction, Brian Galle Jan 2008

Federal Fairness To State Taxpayers: Irrationality, Unfunded Mandates, And The 'Salt' Deduction, Brian Galle

Georgetown Law Faculty Publications and Other Works

By sheer dollars alone, the largest impact of the Alternative Minimum Tax is to deny many taxpayers the deduction for the taxes they paid to their state and local governments under § 164 of the Internal Revenue Code. This Article provides a fine-grained analysis of the overall fairness of the state- and local-tax deduction ¿ and, by implication, the fairness of its partial repeal through the Alternative Minimum Tax. I offer for the first time a close examination of how newly understood limits on taxpayer mobility and rationality might affect individuals' choices of bundles of local taxes and local government …
