Accessing Substance Abuse Treatment: Issues For Parents Involved With Child Welfare Services, Anna Rockhill, Beth L. Green, Linda Newton-Curtis
Accessing Substance Abuse Treatment: Issues For Parents Involved With Child Welfare Services, Anna Rockhill, Beth L. Green, Linda Newton-Curtis
School of Social Work Faculty Publications and Presentations
The complex issues associated with barriers to treatment entry for parents who are involved with child welfare has not been well explored. Accessing timely treatment is now critical for these parents since the introduction of the Adoption and Safe Families Act of 1997, limiting the time until a permanency decision is made. Using a longitudinal, qualitative approach, substance-abusing parents from 15 families, their relevant family members, and service providers were interviewed approximately every 3 months over an 18-month period. The experiences of these parents add to our knowledge of the unique barriers this population faces, and expands our understanding of …

A Retrospective Look At A Sample Of Juvenile Sex Offenders From Two Level Six Residential Treatment Centers In Utah: 1998-2007, Miriam Elizabeth Gunn
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
The study and treatment of juvenile sex offenders (JSOs) has been steadily growing since its separation from the adult sex offender category in the early 1980s. Although many studies concern themselves with one specific research variable, this study looked at the presence of twelve characteristics historically associated with JSOs: sexual abuse, early exposure to sexuality, conduct disorder problems, exposure to crime in the family of origin, personal substance abuse, family substance abuse, school performance difficulties, school behavior problems, mental health difficulties, social skills deficits, changes in family structure, and nonsexual forms of abuse. This was an effort to see if …
The Culpability Of Felony Murder, Guyora Binder
The Culpability Of Felony Murder, Guyora Binder
Journal Articles
Legal scholars are almost unanimous in condemning felony murder as a morally indefensible form of strict liability. This Article provides the long-missing principled defense of the felony murder doctrine. It argues that felony murder liability is deserved for killing negligently by means of a violent or apparently dangerous felony involving an additional malign purpose independent of physical injury to the victim killed. This claim follows from the simple idea that the guilt incurred in attacking or endangering others depends on one’s reasons for doing so. The article develops this idea into an expressive theory of culpability that assesses blame for …

Effective Implementation Of The Trafficking Of Persons And Involuntary Servitude Articles: Lessons From The Criminal Justice System Response To The Illinois Domestic Violence Act, Alison L. Stankus, Jennifer A. Kuhn
Northern Illinois University Law Review
When the Illinois Domestic Violence Act was enacted in 1986, the General Assembly acknowledged that "the legal system has ineffectively dealt with family violence in the past . . . and has not adequately acknowledged the criminal nature of domestic violence; that, although many laws have changed, in practice there is still widespread failure to appropriately protect and assist victims." However, despite these stated purposes, the criminal justice system response to the Act in the last twenty years has been slow to correct this failure. In 2006, the Trafficking of Persons and Involuntary Servitude Articles were added to the Illinois …

The $62 Million Question: Is Virginia's New Center To House Sexually Violent Prisoners Money Well Spent?, Molly T. Geissenhainer
University of Richmond Law Review
This comment examines Virginia's current civil commitment statute for sexual predators and attempts to identify areas where Virginia should concentrate its limited resources in order to address more adequately the ever-increasing problem of what to do with sex offenders. Part II briefly describes why sex offenders present law enforcement with unique problems in prevention and deterrence. Part III details the history of civil commitment legislation. Part IV examines Supreme Court of the United States jurisprudence regarding the constitutionality of sex offender civil commitment statutes. Part V examines the Virginia Sexually Violent Predator Act. Part VI briefly considers current violent sexual …
Truth And Innocence Procedures To Free Innocent Persons: Beyond The Adversarial System, Tim Bakken
Truth And Innocence Procedures To Free Innocent Persons: Beyond The Adversarial System, Tim Bakken
University of Michigan Journal of Law Reform
Through innocent pleas and innocence procedures, this Article urges a fundamental change to the adversarial system to minimize the risk that factually innocent persons will be convicted of crimes. The current system, based on determining whether the prosecution can prove guilt beyond a reasonable doubt, results in acquittals of guilty persons when evidence is sparse and convictions of innocent persons when evidence is abundant. It might be easier philosophically to accept that guilty persons will go free than to know that some innocent persons will be convicted and imprisoned, especially in the American justice system where erroneous jury verdicts based …

The Unrecognized Right Of Criminal Defendants To Admit Their Own Pretrial Statements, Stephen A. Saltzburg, Daniel J. Capra
The Unrecognized Right Of Criminal Defendants To Admit Their Own Pretrial Statements, Stephen A. Saltzburg, Daniel J. Capra
William & Mary Law Review
In Agard v. Portuondo, the United States Supreme Court held that a prosecutor did not violate a testifying defendant's constitutional rights by inviting the jury to infer from the defendant's presence at trial that the defendant altered his own version of events to accord with other witnesses' testimony. Justice Scalia's opinion for the Court emphasized that jurors might well draw the inference even without a prosecutor asking them to do so. Although Agard is viewed as giving an advantage in a criminal trial to the government, this Article considers how Agard might be used to allow defense counsel to introduce …

The Bounds Of Necessity, Jens David Ohlin
The Bounds Of Necessity, Jens David Ohlin
Cornell Law Faculty Publications
The current controversy surrounding the legality of torture can only be understood through an analysis of the distinction between justified necessity and excused necessity. Although there may be strong prudential reasons for international criminal courts to declare torture unlawful under any circumstance, this would not necessarily prevent a court from recognizing that an excuse may apply. However, the hallmark of the necessity excuse should not be understood, as it is in German law, as an exception that only applies when a defendant breaks the law to save someone close to him. Rather, the basic principle of the excuse ought to …

Law, Women And Health In Nigeria, Philomena I. Ozo-Eson
Law, Women And Health In Nigeria, Philomena I. Ozo-Eson
Journal of International Women's Studies
This paper attempts to analyse sexual inequality as it affects the health of women in Nigeria. Various theories that inform the study of women are briefly discussed along with specific areas of women’s health concerns. These include: female genital mutilation, violence against women, sexual harassment, and widowhood practices. Other areas of discourse involve women and law, and here, we emphasised the need to re-examine both the customary and statutory laws to reflect justice, dignity and fair play for all members of the society irrespective of their gender. Also, special attention should be paid to some laws that encourage the brutality …

The Democratic Purpose Of Postsecondary Education: Comparing Public, Private Nonprofit, And Private For-Profit Mission Statements For Expression Of Democratic Social Purpose, Lon Youngberg
All Graduate Theses and Dissertations, Spring 1920 to Summer 2023
Thomas Jefferson envisioned a symbiotic relationship between democracy and public education because he considered educated citizens to be the critical ingredient of a successful democracy. Nevertheless, political and educational reforms over the past two centuries have not always been kind to the relationship that Jefferson envisioned. This study examines frequency that postsecondary education institutions declare a democratic social purpose in their mission statements. The DSP definition, data instrumentation, and theoretical lens for this study were situated from the Jeffersonian perspective.
Although the primary concern for this study was publicly funded/subsidized postsecondary education, recent enrollment growth in private education and privatization …
Effects Of Protégé-Mentor Gender Mix On Organisational Commitment, David E. Okurame
Effects Of Protégé-Mentor Gender Mix On Organisational Commitment, David E. Okurame
Journal of International Women's Studies
This study examined the interaction effects of protégé and mentor gender on organisational commitment in the Nigerian work setting. Data was collected from one hundred and sixty-one dyads in four gender combinations through a survey of a large government owned health institution. Results revealed that mean scores of all-male, all female, and the female protégé-male mentor dyads were comparable while that of male protégé-female mentor was significantly low. Whereas organisational commitment was better for male protégés when their mentors were males, it was better for females when mentors were females. The study narrows the gap created by the dearth of …
Organizational Role Stress Indices Affecting Burnout Among Nurses, Jinky Leilanie Lu
Organizational Role Stress Indices Affecting Burnout Among Nurses, Jinky Leilanie Lu
Journal of International Women's Studies
This was a cross sectional study, which aimed to determine the interaction between situational, factors, role stressors, hazard exposure and personal factors among 246 nurses consisting most of females (78.5%) from the different wards and units in the Philippine General Hospital (PGH). The dominance of female sin the profession reinforce the prevailing notion that the caring professions such as nursing are relegated to women. This gives the study its gender perspective. Almost half (49.6%) of the respondents reported being ill due to work in the past year, and 56.1% missed work because of an illness. Correlation statistics using the Spearman’s …
Deconstructing Islamization In Pakistan: Sabiha Sumar Wages Feminist Cinematic Jihad Through A Documentary Lens, Rahat Imran
Deconstructing Islamization In Pakistan: Sabiha Sumar Wages Feminist Cinematic Jihad Through A Documentary Lens, Rahat Imran
Journal of International Women's Studies
Over half a billion Muslim women live in vastly different lands, cultures, societies, economies, and political systems. Yet, as Iranian scholar Mahnaz Afkhami points out, Muslim women’s oppressions are similar due to gender-discrimination under Islamic Sharia laws and patriarchal doctrines that are exercised in the name of religion and culture. Pakistan has been a prime example of how religious fundamentalism and politicization of religion can transform a secular society into one held hostage by Islamic extremist doctrines and gender-specific laws. It is a cause for hope and celebration then that its progressive and secular elements, particularly educated, urban women, have …

Violence Against Women In Northern Uganda: The Neglected Health Consequences Of War, Helen Liebling-Kalifani, Ruth Ojiambo-Ochieng, Angela Marshall, Juliet Were-Oguttu, Seggane Musisi, Eugene Kinyanda
Journal of International Women's Studies
This article presents a summary of research intervention work carried out in war-affected Northern Uganda by Isis-WICCE, a women’s international non-government organisation, in conjunction with the Ugandan Medical Association and funded by Medica Mondiale, a German-based foundation. The findings of this research demonstrate the serious effects of sexual violence and torture experienced on women’s physical and psychological health. However, this paper also describes women’s key role in trying to bring peace to this region, as well as their resistance and survival strategies. It is recommended that funding is urgently required for the provision of sustainable, gender sensitive physical and psychological …
