Sentence Reduction As A Remedy For Prosecutorial Misconduct, Sonja Starr
Sentence Reduction As A Remedy For Prosecutorial Misconduct, Sonja Starr
Faculty Scholarship
Current remedies for prosecutorial misconduct, such as reversal of conviction or dismissal of charges, are rarely granted by courts and thus do not deter prosecutors effectively. Further, such all-or-nothing remedial schemes are often problematic from corrective and expressive perspectives, especially when misconduct has not affected the trial verdict. When granted, such remedies produce windfalls to guilty defendants and provoke public re-sentment, undermining their expressive value in condemning misconduct. To avoid such windfalls, courts must refuse to grant any remedy at all, either re-fusing to recognize violations or deeming them harmless. This often leaves significant non-conviction-related harms unremedied and egregious prosecu-torial …

The Organizational, Community And Programmatic Characteristics That Predict The Effective Implementation Of After-School Programs, Todd A. Armstrong, Gaylene Armstrong
The Organizational, Community And Programmatic Characteristics That Predict The Effective Implementation Of After-School Programs, Todd A. Armstrong, Gaylene Armstrong
Criminology and Criminal Justice Faculty Publications
To identify characteristics predicting the effective implementation of after-school programs, in-depth interviews were conducted at five sites randomly selected from a subset of 16 ACE after-school sites serving high risk youth in a southwestern city. Qualitative data from structured in-depth interviews, follow-up telephone conversations with personnel as well as researcher observations during site visits were synthesized. Data identified three constellations of characteristics associated with effective implementation: staffing, community and programmatic. Staffing characteristics included limited staff turnover and sufficient training. Community characteristics included cultural sensitivity and community integration. Programmatic characteristics included clearly defined program goals and specific program content. Researcher observations …

The Dilemma Of The Criminal Defendant With A Prior Record - Lessons From The Wrongfully Convicted, John H. Blume
The Dilemma Of The Criminal Defendant With A Prior Record - Lessons From The Wrongfully Convicted, John H. Blume
Cornell Law Faculty Publications
This article examines challenges the conventional wisdom that an innocent defendants will testify on their own behalf at trial. Data gathered from the cases of persons subsequently exonerated due to DNA evidence demonstrates that factually innocent defendants do not testify on their own behalf at substantially higher rates than criminal defendants generally. Why? The primary reason is that many of these individuals had been previously convicted of a crime, and they did not testify at trial because of the risk that their credibility would be impeached with evidence of the prior record and, despite any limiting instruction the court might …

Organised Crime In Ireland: A Policy Analysis Of The Introduction Of Organised Crime To The Irish Statute Book, Elizabeth Davey
Organised Crime In Ireland: A Policy Analysis Of The Introduction Of Organised Crime To The Irish Statute Book, Elizabeth Davey
Dissertations
This thesis is an examination of the policy process employed in the introduction of organised crime to the Irish Statute Book. Part 7 of the Criminal Justice Act 2006 creates, for the first time in Irish criminal law, specific organised crime offences. This thesis examines the different definitions of organised crime that have been proffered by various academics since the 1960s and highlights the difficulties that exist in coining an all-encompassing yet specific definition for the phenomenon. The methods by which Part 7 of the Criminal Justice Act 2006 became law are also scrutinised. The views of various interest groups …
Risky Business: An Examination Of Probation Officers' Attitudes Towards Risk Assessment, Michelle Richardson
Risky Business: An Examination Of Probation Officers' Attitudes Towards Risk Assessment, Michelle Richardson
Dissertations
Over the past ten years, the concept of risk has moved to centre stage in criminological spheres. Risk assessment and the concern for effective management of offenders while safe guarding public safety has become a core issue for criminal justice agencies. This research focuses on risk assessment and probation practice in Ireland. In particular, the attitudes of practicing basic grade probation officers' working on adult community teams in Dublin are examined to gain insight into the complexities experienced by probation officers. Specifically, the research aims to highlight the consequences of adopting standardised risk tools on probation practice. The research discusses …
