Guatemala As A National Crime Scene: Femicide And Impunity In Contemporary U.S. Detective Novels, Susana S. Martínez
Guatemala As A National Crime Scene: Femicide And Impunity In Contemporary U.S. Detective Novels, Susana S. Martínez
Journal of Interdisciplinary Feminist Thought
This paper examines the representation of femicide and impunity in contemporary detective novels set in Guatemala. The Long Night of White Chickens by Francisco Goldman (1992), Body of Truth (1992) by David Lindsey, and Grave Secrets (2002) by Kathy Reichs portray Guatemala in the 1980s and 1990s as a distressing crime scene. The novels depict Guatemala as a dark, frightening place, plagued with inefficient bureaucracy, a chaotic legal system, and a crippled sense of justice where there are dangerous repercussions for searching for and revealing the truth. U.S. journalists, CIA agents, Peace Corps volunteers, forensic scientists, and private investigators navigate …

Academic Leadership: The Online Journal (2003-2012)
Data collected by the American Association of University Women indicated that students who are victims of educator sexual misconduct reported that they suffered emotional, educational, and developmental or health effects (Shakeshaft, 2004). At least one third of students reported behaviors that would negatively affect academic achievement. Larry Lezotte, Wilbur Brookeover, and Ron Edmonds found in their research that a safe and orderly environment was one lead indicator of school effectiveness, defined by high student achievement for all students (Lezotte, 2000). Therefore, if we know that a safe and orderly environment is essential to an effective school and we know that …

The [Capital] Punishment Fits The Crime: A Comparative Analysis Of The Death Penalty And Proportionality In The United States Of America And The People's Republic Of China, Ryan Florio
University of Miami International and Comparative Law Review
The governments of both the United States and China maintain the death penalty as a means of punishing its most dangerous criminals, but with an astounding 68 capital offenses, China perennially remains the world leader in executions. This article examines the theory of proportionality of criminal punishment and how it relates to the respective death penalty policies in the United States and China. A comparative analysis will reveal two extremely different societies with two different perspectives on proportionality. one that recognizes and protects fundamental freedoms and another that places emphasis on collective societal welfare over individual rights. The article will …

The Political Economy Of Criminal Law And Procedure: The Pessimists' View, Richard H. Mcadams
The Political Economy Of Criminal Law And Procedure: The Pessimists' View, Richard H. Mcadams
Public Law and Legal Theory Working Papers
In The Pathological Politics of Criminal Law, Bill Stuntz provides a powerful critique of the modern American criminal justice system. Other commentators have criticized legislatures for constantly adding to an already overbroad set of criminal prohibitions. Stuntz explains the political dynamic that makes this outcome inevitable. The ultimate result is that the modern prosecutor defines what is criminal by her selection of cases to charge, while criminal legislation is a mere “side-show.” Stuntz concludes that this state of affairs is “lawless” and pathological. As a solution, he proposes that courts resurrect or expand certain constitutional doctrines to reclaim some of …
Some Realism About Legal Certainty In The Globalization Of The Rule Of Law, James Maxeiner
Some Realism About Legal Certainty In The Globalization Of The Rule Of Law, James Maxeiner
All Faculty Scholarship
The rule of law is at the heart of globalization. It promises both international and domestic routes to peace, security, democracy, human rights and sustainable development worldwide. A central tenet of the rule of law is legal certainty. For most modern jurists, it is a matter of course that legal certainty is a systemic goal, even if that goal is not always fully realized. But for American jurists who count themselves legal realists, legal certainty is not even a flawed goal; it is a childish myth. This address seeks to raise awareness of this fundamental difference and to show its …
Supportive Housing: Implications For Its Efficacy As Intervention With Special Needs Low-Income African Americans, Carol S. Collard, Rufus Larkin
Supportive Housing: Implications For Its Efficacy As Intervention With Special Needs Low-Income African Americans, Carol S. Collard, Rufus Larkin
Faculty Articles
In this pilot study, the authors examine the efficacy of supportive housing, which combines affordable housing with social services, in helping low-income single mothers in substance abuse recovery with relapse prevention and acquiring life skills to improve their economic conditions. Study subjects were residents of Delowe Village Apartments, a supportive housing development in East Point, Georgia, who participated in Project GROW, an on-site program intended to help residents maintain sobriety and reduce their dependence on welfare. The authors hypothesize that the length of residency in supportive housing correlates to prolonged sobriety, improved functioning, and increased employment. Findings indicate a substantial …

Lessons From Hurricane Katrina: Prison Emergency Preparedness As A Constitutional Imperative, Ira P. Robbins
Lessons From Hurricane Katrina: Prison Emergency Preparedness As A Constitutional Imperative, Ira P. Robbins
University of Michigan Journal of Law Reform
Hurricane Katrina was one of the worst natural disasters ever to strike the United States, in terms of casualties, suffering, and financial cost. Often overlooked among Katrina s victims are the 8,000 inmates who were incarcerated at Orleans Parish Prison (OPP) when Katrina struck. Despite a mandatory evacuation of New Orleans, these men and women, some of whom had been held on charges as insignificant as public intoxication, remained in the jail as the hurricane hit, and endured days of rising, toxic waters, a lack of food and drinking water, and a complete breakdown of order within OPP Wien the …
Justice Kennedy's Short-Lived Libertarian Revolution: A Brief History Of Supreme Court Libertarian Ideology, Stephen O'Hanlon
Justice Kennedy's Short-Lived Libertarian Revolution: A Brief History Of Supreme Court Libertarian Ideology, Stephen O'Hanlon
Cardozo Public Law, Policy & Ethics Journal
This paper contends that Justice Anthony Kennedy did not initiate a libertarian jurisprudential revolution following Lawrence v. Texas. The article begins with an overview of constitutional fundamental rights jurisprudence and examines similarities with libertarian theory.
The paper then assesses the legal decisions of Justice Kennedy but concludes that Justice Kennedy is not a libertarian. This provides the basis for critiquing Professor Randy Barnett's assertion that Justice Kennedy was the instigator of a libertarian revolution in U.S. Supreme Court jurisprudence. The fact that Justice Kennedy is not a libertarian is apparent from his reasoning in the recent partial birth abortion …
Confessing In The Human Voice: A Defense Of The Privilege Against Selfincrimination, Andrew E. Taslitz
Confessing In The Human Voice: A Defense Of The Privilege Against Selfincrimination, Andrew E. Taslitz
Cardozo Public Law, Policy & Ethics Journal
The Fifth Amendment privilege against self-incrimination is a cornerstone of American constitutional law, yet it faces erosion through recent Supreme Court rulings and scholarly critiques. The article presents a novel defense of this privilege, focusing on the protection of the "literal voice" and "metaphorical voice," arguing that compelled speech uniquely harms dignity, identity, and autonomy. It critiques existing justifications as insufficient and proposes a framework rooted in social science and linguistic compulsion, emphasizing the privilege's role in preventing state overreach and safeguarding individual autonomy.
