Bearing False Witness: Perjured Affidavits And The Fourth Amendment, Stephen W. Gard
Bearing False Witness: Perjured Affidavits And The Fourth Amendment, Stephen W. Gard
Law Faculty Articles and Essays
The purpose of this Article is to articulate appropriate legal doctrine to govern the problem of false statements of fact by law enforcement officers in warrant affidavits. This Article addresses the issue in the context of actions brought pursuant to 42 U.S.C. § 1983 to redress such Fourth Amendment violations. This perspective promises to be interesting and unique for two reasons. First, the fact that the guilty are ordinarily the direct beneficiaries of the Fourth Amendment has long been a matter of grave concern. In contrast, rarely, if ever, will anyone except an innocent victim of a search based on …
Stepping Forward Or Stumbling Back? Command Responsibility For Failure To Act, Civilan Superiors And The International Criminal Court, Daniel Watt
Dalhousie Journal of Legal Studies
The application of the doctrine of command responsibility (“CR”) to civilian leaders is unsettled under international law. Jurisprudence which has applied CR to civilian leaders has been inconsistent, unprincipled and potentially unjust. International decisions such as the Celebici case at the ICTY suggest that CR can theoretically apply to civilians, but the subsequent Kordic decision indicates that international jurists are extremely wary of extending CR to civilian leaders. The Rome Statute of the nascent International Criminal Court is the first codified international law that explicitly provides for individual criminal liability for civilians on the basis of CR. This paper argues …

An Evaluation Of States’ Delivery Of Substance Abuse Treatment, Catherine Anne Collins
An Evaluation Of States’ Delivery Of Substance Abuse Treatment, Catherine Anne Collins
Master's Theses and Doctoral Dissertations
As the economic, political, and technological landscape of America’s healthcare management system changes, states are forced to grapple with the progressively arduous task of administering substance abuse treatment programs. Using the Open Systems Model, this research examines external and internal environmental factors that influence goal displacement as it is hypothesized to occur in states’ treatment delivery systems. The findings suggest that a mix of environmental characteristics affect states’ levels of goal displacement but the factors that predict displacement in alcohol treatment are different than for the delivery of drug treatment. The internal and external environment factors that contribute to goal …

Federal Rules Update: How Rules Are Made: A Brief Review, David A. Schlueter
Faculty Articles
In January 2008 and June 2008, the Standing Committee on the Rules of Procedure and Evidence authorized publication for comment on a number of rules of criminal procedure. The amendment to Criminal Rule 5 would include a requirement that, in deciding whether to release or detain a defendant, the court must consider the “right of any victim to be reasonably protected from the defendant.” The change to Criminal Rule 12.3 states that the name and address of the victim should not be automatically disclosed to the defense. Criminal Rule 15 would permit an unavailable witness to be deposed outside of …
All For One: A Review Of Victim-Centric Justifications For Criminal Punishment, Adam J. Macleod
All For One: A Review Of Victim-Centric Justifications For Criminal Punishment, Adam J. Macleod
Faculty Articles
Disparate understandings of the primary justification for criminal punishment have in recent years divided along new lines. Retributivists and consequentialists have long debated whether a community ought to punish violators of legal norms primarily because the violator has usurped communal standards (the retributivist view), or rather merely as a means toward some end such as rehabilitation or deterrence (the consequentialist view). The competing answers to this question have demarcated for some time the primary boundary in criminal jurisprudential thought.
A new fault line appears to have opened between those who maintain the historical view that criminal punishment promotes the common …
Overriding Mental Health Treatment Refusals: How Much Process Is “Due”?, Samuel Jan Brakel, John M. Davis M.D.
Overriding Mental Health Treatment Refusals: How Much Process Is “Due”?, Samuel Jan Brakel, John M. Davis M.D.
Saint Louis University Law Journal
Getting mental health treatment to patients who need it is today a much belegaled enterprise. This is in part because lawmakers have a skewed view of the enterprise, in particular regarding the treatment of patients with antipsychotic medications. The properties and uses of these medications are misunderstood by many in the legal community, with the drugs’ undesirable side effects typically overstated and the remedial effects undersold when not outright ignored. One specific legal effect has been to accord to mental patients a substantively outsized right to refuse treatment that comes with a correspondingly action-stifling dose of procedural safeguards, this despite …

Equal By Law, Unequal By Caste: The "Untouchable" Condition In Critical Race Perspective, Smita Narula
Elisabeth Haub School of Law Faculty Publications
Caste-based oppression in India lives today in an environment seemingly hostile to its presence: a nation-state that has long been labeled the “world's largest democracy;” a progressive and protective constitution; a system of laws designed to proscribe and punish acts of discrimination on the basis of caste; broad-based programs of affirmative action that include constitutionally mandated reservations or quotas for Dalits, or so-called “untouchables;” a plethora of caste-conscious measures designed to ensure the economic “upliftment” of Dalits; and an aggressive economic liberalization campaign to fuel India's economic growth.
This Article seeks to answer the question of how and why this …
The Rise Of Spanish And Latin American Criminal Theory, Luis E. Chiesa
The Rise Of Spanish And Latin American Criminal Theory, Luis E. Chiesa
Elisabeth Haub School of Law Faculty Publications
As the contributions to this two-part special issue demonstrate, Spanish and Latin American criminal theory has attained a remarkable degree of sophistication. Regrettably, Anglo-American scholars have had limited access to this rich body of literature. With this volume, the New Criminal Law Review has taken a very important first step toward rectifying this situation.
Although the articles written for this special issue cover a vast range of subjects, they can be divided into four main categories: (i) the legitimacy of the criminal sanction, (2) the punishability of omissions, (3) the challenges that international criminal law and the fight against terrorism …
