Distributing Discipline: Race, Politics, And Punishment At The Frontlines Of Welfare Reform, Richard Fording, Joe Soss, Sanford F. Schram

University of Kentucky Center for Poverty Research Discussion Paper Series

Numerous studies have confirmed that race plays an important role in shaping public preferences toward both redistribution and punishment. Likewise, studies suggest that punitive policy tools tend to be adopted by state governments in a pattern that tracks with the racial composition of state populations. Such evidence testifies to the enduring power of race in American politics, yet it has limited value for understanding how disciplinary policies get applied to individuals in implementation settings. To illuminate the relationship between race and the application of punitive policy tools, we analyze sanction patterns in the TANF program. Drawing on a model of …

Impacts Of ‘Three Strikes And You’Re Out’ On Crime Trends In California And Throughout The United States, Elsa Y. Chen

Political Science

The impacts of Three Strikes on crime in California and throughout the U.S. are analyzed using cross-sectional time series analysis of state-level data from 1986 to 2005. The model measures both deterrence and incapacitation effects, controlling for pre-existing crime trends and economic, demographic, and policy factors. Despite limited usage outside California, the presence of a Three Strikes law appears to be associated with slightly but significantly faster rates of decline in robbery, burglary, larceny, and motor vehicle theft nationwide. The Effect Of Blakely V. Washington On Upward Departures In A Sentencing Guideline State, Brian Iannacchione, Jeremy Ball

One of the problems facing the criminal justice system is unwarranted disparity as a result of unbridled discretion. Although disparity, by itself, does not necessarily indicate a problem in the criminal justice system, disparity unwarranted does present a problem. Disparity becomes unwarranted when, controlling for legal factors, extralegal factors such as race/ethnicity, gender, and age influence court processing decisions. The greater the discretion one possesses, the higher the likelihood of unwarranted disparity in one’s decisions (Albonetti, 1991; Meeker, Jesilow, & Aranda, 1992; Bushway & Piehl, 2001). Within the criminal court system, judicial discretion in sentencing has received the most scrutiny.

Students often have difficulty visualizing the practical application of criminological theory. The following activity assists instructors to develop students‘ abilities in evaluating behaviors and determining the theoretical perspectives that potentially could be used to explain those behaviors. It also is designed to assist students in comprehending how their own experiences impact their views on law-violating behavior and its etiology. This exercise facilitates students‘ awareness of how their beliefs about the causes of law-violating behavior inevitably impact their beliefs about potential solutions or responses to this type of behavior. Moving Ahead: Five Essential Elements For Working Effectively With Girls, Betsy Mattews, Dana Jones Hubbard

Quite a bit of literature these days addresses what is believed to be an increase in the frequency and severity of girls' problem behaviors and the need for gender-responsive treatment. The extent to which this literature has been translated into juvenile justice practices, however, appears limited by several factors. This article briefly discusses these impediments, and offers suggestions for five essential elements that reflect the current state of knowledge regarding effective intervention with girls involved in the juvenile justice system.

"Everybody Is Making Love Or Else Expecting Rain": Considering The Sexual Autonomy Rights Of Persons Institutionalized Because Of Mental Disability In Forensic Hospitals And In Asia, Michael L. Perlin

One of the most controversial policy questions in all of institutional mental disability law is the extent to which patients in psychiatric hospitals have a right to voluntary sexual interaction. The resolution of this matter involves difficult and sensitive questions of law, social policy, clinical judgment, politics, religion, and family structures. As difficult as these questions are in cases involving civil hospitals, the difficulties are exacerbated when the topic is the application of the right in forensic hospitals. While The Government Fiddled Around, The Big Easy Drowned: How The Posse Comitatus Act Became The Government's Alibi For The Hurricane Katrina Disaster, Candidus Dougherty

This article analyzes how the government's blame of the Posse Comitatus Act (PCA) for its late response to the Hurricane Katrina disaster was misplaced. In Part II, the author discusses the history of the Posse Comitatus Act, including a summary of some of its many judicial and congressional expansions. In Part III, the author applies the PCA to the Hurricane Katrina disaster to show that, under its proper application, the PCA does, in fact, permit the lawful use of the military for humanitarian purposes. An Argument For A Return To Plessy V. Ferguson: Why Illinois Should Reconsider The Doctrine Of "Separate But Equal" Public Schools, Rick Guzman

This Comment analyzes the steady erosion of the 1954 landmark Brown v. Board of Education case. Specifically, it argues that the millions of poor and overwhelmingly minority school children who are attending 99% single-race schools might actually have access to better teachers and more adequate educational funding under the long-abandoned principle that "separate" schools must be "equal," by some measure, than such students fare under today's watered down interpretation of the Brown case. Research has indicated that both technology use and cyber bullying behavior by teenagers are increasing. Despite the importance of the role of building-level school administrators in establishing climate and addressing violence, the research on cyber bullying to date has not included the perceptions of building-level school administrators. People have culturally been inclined to visualize a perpetrator simply based on the description of the crime. This experiment seeks to determine if a generalized criminal is expressed by the survey group for each crime. Simply put, it will identify if there exists a similar stereotype for each crime described. Each participant completed a questionnaire to identify their demographics. Next was given five crimes which were about robbery, shooting, rape, stolen identity, and murder to read over with the victim and location information omitted.
