Responsibility Status Of The Psychopath: On Moral Reasoning And Rational Self-Governance, Paul J. Litton
Responsibility Status Of The Psychopath: On Moral Reasoning And Rational Self-Governance, Paul J. Litton
Faculty Publications
This article does not aim to describe the opposing views and argue for one over the other. Rather, I propose to deflate the debate as far as possible, attempting to reduce the area of disagreement. Meaningful disagreement exists only if there are, or could be, agents who have an undiminished capacity for practical reasoning or rational self-governance, yet truly are incapable of moral reasoning. However, I suggest that the capacity for rational self-governance entails the capacity to comprehend and act on moral considerations; thus, to the extent that an individual truly is incapable of grasping moral reasons, we should expect …

Taking Stock: Adr Responses In Post-Disaster Situations, Maria R. Volpe
Taking Stock: Adr Responses In Post-Disaster Situations, Maria R. Volpe
Cardozo Journal of Conflict Resolution
As the use of innovative dispute resolution processes becomes more widespread and diverse, it is understandable and perhaps even inevitable that dispute resolvers will continue to explore ways to apply their knowledge, skills, and expertise in new and challenging settings. One of the contexts that dispute resolvers have paid increasing attention to since September 11th has been post-disaster situations. Despite this observation, however, dispute resolution experts continue to struggle with how to respond. While many professions, particularly those which provide emergency or essential rescue, evacuation, recovery, relocation, repair, rebuilding, and survival-related services have readily identified roles in post disaster situations, …

Immigrant Remittances, Ezra Rosser
Immigrant Remittances, Ezra Rosser
Connecticut Law Review
Remittances, the sending of money from immigrants back to their home countries, are the newest anti-poverty, development activity of the poor to be applauded by international institutions and economists. Exceeding foreign aid and private investment to many developing countries, remittances are being hailed as a new, untapped resource with powerful poverty alleviation and potential development attributes. After presenting the poverty, developmental, and economic characteristics of this new transnational connection between immigrants and their loved ones, as well as the dangerous effects of excessive remittance regulation, this Article argues that remittances should be understood as an anti-poverty tool, but not as …

The Charter Of Whiteness: Twenty-Five Years Of Maintaining Racial Injustice In The Canadian Criminal Justice System, David M. Tanovich
The Charter Of Whiteness: Twenty-Five Years Of Maintaining Racial Injustice In The Canadian Criminal Justice System, David M. Tanovich
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper examines the impact of the Canadian Charter of Rights and Freedoms on racial injustice in the Canadian criminal justice system. While there have been modest gains, we have seen very little systemic change over the Charter’s 25-year life. We continue to incarcerate Aboriginals and African Canadians at alarming rates, racial profiling at our borders and in our streets continues to flourish, and the federal government continues to propose legislation that will further entrench the problem. Why is this happening? is there any hope for the future? these are some of the fundamental questions explored. of course, some might …

Expanding Victims’ Rights In The Charter Era And Beyond, Joan Barrett
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper examines the influence of the Charter over the development of victims’ rights through provincial and federal legislative reform and related jurisprudence. It discusses how the role of the victim has evolved from one of silent observer to one with significant procedural protections, welfare rights and limited rights of standing in criminal proceedings. It the n examines the Charter’s role in this evolution and discusses how the Charter has served as a vehicle by which Parliament and the courts have advanced the procedural, substantive and welfare rights of victims in the criminal justice system. Particular attention is given to …

Let Her Be Taken: Sexual Violence In Medieval England, Lindsey Mcnellis
Let Her Be Taken: Sexual Violence In Medieval England, Lindsey Mcnellis
Electronic Theses and Dissertations
Rape and its impact on medieval women, as conceived by society and the law, have yet to receive extensive treatment. By analyzing not only rape cases, but evolving laws and the impact of the Church on views of sexuality and marriage and thus its influence on attitudes towards rape, this study shows that women were much more than victims and society, or the courts, reacted accordingly. Covering the years 1200 to 1250, this thesis examines secular court cases taken from the general eyre records of Yorkshire, Gloucestershire, Lincolnshire, Warwickshire, Berkshire, Wiltshire, Worcestershire and Staffordshire. Cases taken from the King's Bench …

Detained And Committed Youth: Examining Differences In Achievement, Mental Health Needs, And Special Education Status, Michael P. Krezmien, Candace A. Mulcahy, Peter E. Leone
Teaching, Learning and Educational Leadership Faculty Scholarship
Currently, there is limited research about the relationship between academic, mental health needs, and special education status among populations of incarcerated youth. Additionally, little is known about differences between special education and general education students, or about differences between detained and committed populations. This article reports the results of an investigation of the academic achievement, mental health history, and special education status of 555 detained and incarcerated boys in one mid-Atlantic state. Descriptive data and results from a logistic regression analysis are reported. We found that mean standard scores of participants on standardized achievement tests were one standard deviation below …
