The Emerging Death Penalty Jurisprudence Of The Roberts Court, Kenneth C. Haas Mar 2008

The Emerging Death Penalty Jurisprudence Of The Roberts Court, Kenneth C. Haas

The University of New Hampshire Law Review

[Excerpt] “In 1976, four years after finding the nation’s death penalty laws to be constitutionally flawed, the U.S. Supreme Court established the parameters of modern American death penalty jurisprudence. Since then the Court has gone through several phases. The Court proceeded cautiously from 1977 to 1982, limiting the death penalty to those who committed murder in a manner deemed especially heinous and despicable by judges and juries, requiring even-handedness and consistency in capital sentencing, and insisting that sentencing authorities examine the individual characteristics of each offender and the particular circumstances of his crime. From 1983 to 2001, however, the Court …

The Death Penalty And Reversible Error In Massachusetts, Alan Rogers

The University of New Hampshire Law Review

[Excerpt] “This article will survey Massachusetts homicide cases from 1805 to 1996 in which the SJC found reversible error. For comparative purposes, the data will be grouped into three periods: from 1805, the year the SJC began to publish its decisions, to 1891, the year original jurisdiction for homicide cases was transferred from the SJC to the Superior Court; 1892 to 1939, the year Massachusetts law allowed the SJC to review the facts as well as the law of capital cases; and from 1940 to 1996, the year Chief Justice Paul Liacos resigned from the court and the importance of …

Death Is Unconstitutional: How Capital Punishment Became Illegal In America—A Future History, Jur. Eric Engle Ph.D. Mar 2008

Death Is Unconstitutional: How Capital Punishment Became Illegal In America—A Future History, Jur. Eric Engle Ph.D.

The University of New Hampshire Law Review

[Excerpt] “A constitution is an organic fact of every state: it is a part of the being of the state. People, like the state, also have a constitution—a character. Just as people change over time, so do states. But just as there are natural limits on what people can or cannot become, so there are natural limits on what the state can and cannot fairly do. No man, nor any group of men, ex ante may justly take the life of another person, though perhaps their killing may be excused (or forgiven) ex post.”

"The death of Death would surely …

Human Welfare, Not Human Rights, Eric A. Posner Mar 2008

Human Welfare, Not Human Rights, Eric A. Posner

Coase-Sandor Institute for Law & Economics Research Paper Series

Human rights treaties play an important role in international relations but they lack a foundation in moral philosophy and doubts have been raised about their effectiveness for constraining states. Drawing on ideas from the literature on economic development, this paper argues that international concern should be focused on human welfare rather than on human rights. A focus on welfare has three advantages. First, the proposition that governments should advance the welfare of their populations enjoys broader international and philosophical support than do the various rights that are incorporated in the human rights treaties. Second, the human rights treaties are both …

Paradigms Of Restraint, Erin Murphy Mar 2008

Paradigms Of Restraint, Erin Murphy

Duke Law Journal

Incapacitation of dangerous individuals has conventionally entailed the exercise of physical control over an actual body: the state confines the person in jail. But advances in technology have changed that convention. A variety of new technologies-such as GPS tracking bracelets, biometric scanners, online offender indexes, and DNA databases-give the government power to control dangerous persons without relying on any exertion of physical control. The government can track the location of a person in real time, receive remote notification that an individual has ingested alcohol, or electronically zone someone into a home or out of a public park. It can prove …

Repairing Family Law, Clare Huntington Mar 2008

Repairing Family Law, Clare Huntington

Duke Law Journal

Scholars in the burgeoning field of law and emotion have paid surprisingly little attention to family law. This gap is unfortunate because law and emotion has the potential to bring great insights to family law. This Article begins to fill this void-and inaugurate a larger debate about the central role of emotion in family law-by exploring the intriguing and significant consequences for the regulation of families that flow from a theory of intimacy first articulated by psychoanalytic theorist Melanie Klein. According to Klein, individuals love others, inevitably transgress against those they love out of hate and aggression, feel guilt about …

Types Of Knowledge, Forms Of Practice, Margaret Arnd-Caddigan, Richard Pozzuto Mar 2008

Types Of Knowledge, Forms Of Practice, Margaret Arnd-Caddigan, Richard Pozzuto

The Qualitative Report

This study was designed to explore the way that us e of theory influenced a social worker’s conceptualization of a simulated case. The participant in this case study was a woman employed in child welfare, who holds an MSW. She was chosen because her response in a larger study represented a deviant case. Data analysis included both thematic analysis and an analysis of a written report based on ideas taken from institutional ethnography. The authors use this case example to illustrate the ways that one’s understanding of theory may impact social work practice.

Juror Comprehension And The Hard Case: Making Forensic Evidence Simpler, Mark Findlay

Research Collection Yong Pung How School Of Law

The complexity/comprehension nexus as it impacts on juror decision-making is addressed in the particular context of prosecution-led DNA evidence. Such evidence is for jurors the subject of pre-trial preconceptions, and is notoriously difficult to present and argue before a jury. The article looks at the comprehension of forensic evidence by jurors, a task qualified by the opinion of legal professionals whose responsibility it is to present and interpret such evidence in adversarial contexts.Jurors were surveyed post-verdict in trials where forensic evidence featured in circumstantial cases. These insights into comprehension were qualified by contesting views of legal professionals, and critical reflections …

Law Beyond Our Borders: Legal Resources From The Other 49 States, Maureen Cahill

Presentations

While there is some uniformity and predictability to what resources are available on the Web from the various agencies and branches of the federal government, much less comforting similarity exists for the resources provided by the various states. The universe of what is available is expanding, but there are still many gaps. In addition, many states have not yet stabilized their Web resources. They keep reorganizing or changing what they offer, usually changing Web addresses at the same time. Still, in most instances, today you can find the current code, without annotations, and at least a few judicial opinions. Often …
