Unconscious Bias And The 2008 Presidential Election, Gregory S. Parks, Jeffrey J. Rachlinski
Unconscious Bias And The 2008 Presidential Election, Gregory S. Parks, Jeffrey J. Rachlinski
Cornell Law Faculty Publications
The 2008 presidential campaign and election will be historic. It marks the first time a Black person (Barack Obama) and a woman (Hillary Clinton) have a real chance at winning the Presidency. Their viability as candidates symbolizes significant progress in overcoming racial and gender stereotypes in America. But closer analysis of the campaigns reveals that race and gender have placed enormous constraints on how these two Senators can run their candidacy. This is not surprising in light of the history of race and gender in voting and politics in America. But what is perhaps more surprising is how the campaigns …

A Call For The End Of Impunity For Multinational Corporations, Regina E. Rauxloh
Texas Wesleyan Law Review
In 2002, the first permanent International Criminal Court (ICC) was established. Based on the experience of the International Military Tribunal (the so-called Nuremberg Trials), the International Military Tribunal for the Far East (the so-called Tokyo Trials), the International Criminal Tribunal for the former Yugoslavia (ICTY), and the International Criminal Tribunal for Rwanda (ICTR), the new court is "determined to put an end to impunity for the perpetrators of these crimes and thus to contribute to the prevention of such crimes." Too often in the past the worst perpetrators of the worst crimes were able to hide behind the shield of …

Confronting Evil: Victims' Rights In An Age Of Terror, Wayne A. Logan
Scholarly Publications
This Article examines a unique facet of the victims' rights movement: the use of victim impact evidence in the prosecution of individuals accused of mass killings. The Article provides the first detailed analysis of victim impact evidence employed in the capital trials of those responsible for the bombings in Oklahoma City (168 deaths) and the U.S. Embassy in Kenya (213 deaths), as well as the events of September 11 (almost 3000 deaths), and explores the many difficulties its use presents. These difficulties, the Article argues, warrant attention not only with respect to future U.S. mass killing trials in civilian courts, …

Why Ratify? Lessons From Treaty Ratification Campaigns, Uta Oberdorster
Why Ratify? Lessons From Treaty Ratification Campaigns, Uta Oberdorster
Vanderbilt Law Review
n December 18, 1990, the United Nations ("UN") General Assembly approved the Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families ("Migrant Convention"). Several years later, international non-governmental organizations ("NGOs") initiated a global campaign to encourage states to ratify the Migrant Convention. Thirteen member organizations continue this campaign today, including Human Rights Watch, International Labour Office, and Amnesty International. The Mexican government and the UN generously funded the campaign for many years, and campaign members worked hard to produce campaign materials, organize awareness raising events, and release press statements. Despite these efforts, the …
