Misreading Justice: The Rhetoric Of Revenge In Feminist Texts About Domestic Violence, Kimberly Paige Bowers Apr 2008

Misreading Justice: The Rhetoric Of Revenge In Feminist Texts About Domestic Violence, Kimberly Paige Bowers

English Dissertations - Archive

Feminist legal theories of battering homicides pose a challenge to feminist critics of American literature. Legal theorists argue that many women who are tried for killing their abusive partners should be acquitted on the grounds of self-defense. While they have had some success, stereotypes suggesting that women who kill are vengeful result in the wrongful convictions of too many female defendants. Feminist narratives that depict women who kill their abusers abound in American literature. Too often the scholarship on these narratives conflates revenge and self-defense, contributing to the problems feminist lawyers face. Looking at literature and legal scholarship from the …

Perceptions Of Alcohol Consumption: An Examination Of Undergraduate Students' Perception Of Harmful Alcohol Consumption As A Social Problem And Its Relationship With Crime, Michael Chad Gann

Criminology & Criminal Justice Theses - Archive

The role of law enforcement in the United States has evolved such that police officers are expected to be problem solvers as well as crime fighters. To that extent, the author begins this study as a broad examination of a social problem that plagues the United States on a day to day basis and ultimately focuses more specifically on social problems locally. It is understood that alcohol-related offenses are the leading cause of negligent deaths in the United States but the problem goes deeper than most realize. Therefore, the purpose of this study is to examine undergraduate students' perceptions of …

The Right To Counsel: Policy Reasons For Fundamental Reforms To Promote Access To Justice, Adrian Scotchmer Apr 2008

The Right To Counsel: Policy Reasons For Fundamental Reforms To Promote Access To Justice, Adrian Scotchmer

Osgoode Hall Review of Law and Policy

This article argues that it is highly undesirable that legal costs impede, and often preclude access to counsel. Even if access to counsel is not a constitutional right in itself, as the Supreme Court of Canada held in Christie, the arguments advanced by the plaintiff in Christie when supplemented by other considerations, establish the importance of access to counsel as a matter of policy. As such, the law societies and the governments of Canada ought to do more to promote access to counsel. Specifically, the law societies ought to reduce market-entry and market-conduct restrictions and increase the use of existing …

Reconciling The Differences Between The “Gender-Responsive” And The “What Works” Literatures To Improve Services For Girls, Dana Jones Hubbard, Betsy Mattews Apr 2008

Reconciling The Differences Between The “Gender-Responsive” And The “What Works” Literatures To Improve Services For Girls, Dana Jones Hubbard, Betsy Mattews

Sociology & Criminology Faculty Publications

Recent increases in the delinquency and incarceration of girls have prompted juvenile justice professionals to search for effective, gender-specific prevention and treatment strategies. Given the dearth of research on girls' programming, these professionals are often left to sort out discrepancies between two major bodies of literature that address the needs of delinquent girls—the “what works” literature and the “gender-responsive” literature. This article culls the best of what is available within both these bodies of literature and suggests programmatic elements deemed essential for working effectively with girls.

Corrections, Margo Schlanger

Book Chapters

Over the past six years, the number of people in custody in the United States has continued to grow. By the middle of 2006, the nation's prison and jail population, including federal prisons, totaled 2,245,189 persons. The number of people under correctional supervision, including those incarcerated and on probation and parole, reached more than 7 million persons in 2006. For several years, corrections has been the fastest growing component of many states' budgets. The growing number of people in prison has begun to affect the apportionment of political power between urban and rural communities.

Out Of The Closet Or Under The Rug: An Analysis Of Same-Sex Domestic Violence In Idaho, Carol Mchann

Through a review of academic articles and an analysis of government statistical data, this paper will address the prevalence of reported incidents of domestic violence within same-sex couples in the state of Idaho as compared to those reported nationally. The incidents of same-sex domestic violence within the state of Idaho will also be compared to incidents within heterosexual couples at the state and national levels to access the …

Rethinking Child Advocacy After Roper V. Simmons: "Kids Are Just Different" And "Kids Are Like Adults" Advocacy Strategies, Elisa Poncz Apr 2008

Rethinking Child Advocacy After Roper V. Simmons: "Kids Are Just Different" And "Kids Are Like Adults" Advocacy Strategies, Elisa Poncz

Cardozo Public Law, Policy & Ethics Journal

The article examines the tension between two competing arguments in juvenile law: "kids are just different" and "kids are like adults." It critiques the binary approach often used in child advocacy and proposes a more nuanced, patchwork strategy that combines both perspectives to better serve the diverse needs of juveniles. The analysis focuses on key legal contexts, including the death penalty, life without parole, and minors' rights in medical decision-making, education, and internet access. The author argues that a balanced approach is essential to address the complexities of juvenile rights and responsibilities.

Crawford Confusion Marches On: The Confrontation Clause And Hearsay Laboratory Drug Reports, David A. Doellman Apr 2008

Crawford Confusion Marches On: The Confrontation Clause And Hearsay Laboratory Drug Reports, David A. Doellman

Missouri Law Review

Rapid advances in science and technology have influenced criminal prosecutions as police often utilize advanced technology to obtain evidence that is integral to the prosecution's case against a criminal defendant. Such practices are especially common in cases involving illegal drugs, in which slight variations in the precise measurements of such substances could add or subtract from the lengths of sentences. Often, prosecutors offer this crucial evidence in court through a laboratory report documenting the exact results of the tests performed on the alleged illegal substances. The admission of these lab reports seemingly complies with the rules of evidence of most …

The Sentencing Commission Takes On Crack, Again, David Yellen Apr 2008

The Sentencing Commission Takes On Crack, Again, David Yellen

Articles

We may be entering a new era of drug sentencing policy. For the first time, an effort by the United States Sentencing Commission to reduce the disparity in treatment between crack and powder cocaine offenders by somewhat reducing crack sentences has succeeded. Decisions of the United States Supreme Court, culminating most recently in Kimbrough v. United States and Gall v. United States, have clarified and expanded the flexibility federal judges have in sentencing under the post- United States v. Booker advisory sentencing guidelines. Political leaders have begun to accept the need for relaxation of at least some of the …

Review Of Crime Punishment And Justice: Selected Articles From A Scholarly Career (2007) By Ulla V. Bondeson, Gordon A. Crews

Criminal Justice Faculty Publications

Crime, Punishment and Justice: Selected Articles from a Scholarly Career by Dr. Ulla V. Bondeson offers the reader exposure to twelve selected writings which represent the life, evolution, cumulative-knowledge, philosophy, and research, of a veteran international scholar. The importance of the topics examined and their historical significance (spanning 1968 to 2006) need not be argued. The concepts of crime causation, truth, justice, and justifications for punishment, are not only international issues, but universal ones.
