Generals In Three-Piece Suits—Contractors In Camouflage: A Critical Assessment Of Contractors In Iraq, Wyman E. Shuler Iii Apr 2008

Generals In Three-Piece Suits—Contractors In Camouflage: A Critical Assessment Of Contractors In Iraq, Wyman E. Shuler Iii

Graduate Program in International Studies Theses & Dissertations

Contractors compose part of the total force for U.S. warfare capability in Iraq.

Some augment U.S. warfare capability; others do not. Some of the contractors are controlled by the military; others are controlled by civilian (nonmilitary/political) government agencies. The problem: Who are the contractors and how has the nature of government oversight and control over contractors determined whether contractor contributions augment or diminish U.S. warfare capability in the Iraq War?

Argument: It is the degree of government control over contractors that determines whether the contractors' contributions have a positive or negative impact on warfare capability. Ultimately the findings support …

Let Them Eat Smoke: The Case For Exempting The Tobacco Industry From Antitrust, Brian Dean Abramson Apr 2008

Let Them Eat Smoke: The Case For Exempting The Tobacco Industry From Antitrust, Brian Dean Abramson

Cardozo Public Law, Policy & Ethics Journal

The article argues that granting a carefully tailored antitrust exemption to the tobacco industry could have net positive effects on public health by reducing tobacco consumption and lowering healthcare costs. It examines the economic principles of antitrust regulation, the historical anticompetitive behavior of tobacco companies, and the FTC's opposition to the proposed exemption in the 1997 National Settlement Proposal. The author contends that while the FTC raised valid concerns about consumer harm, an exemption could still be structured to benefit public health without undermining competition.

Myspace In A Post-Grokster World: Digital Finger Pointing For Offenses Perpetrated Through Use Of Social Networking Sites After Mgm V. Grokster, Cheryl J. Eisner

Cardozo Public Law, Policy & Ethics Journal

The note examines the dismissal of a negligence lawsuit against MySpace, arguing that interactive computer services should not be held liable for offline harms committed by users. It emphasizes the importance of protecting such platforms under the Communications Decency Act (CDA) and highlights the need to balance free speech and technological development against concerns for user safety.

An Application Of The Theory Of Planned Behavior To Sorority Alcohol Consumption, Karen Huchting, Andrew Lac, Joseph W. Labrie Apr 2008

An Application Of The Theory Of Planned Behavior To Sorority Alcohol Consumption, Karen Huchting, Andrew Lac, Joseph W. Labrie

Heads Up!

Greek-affiliated college students have been found to drink more heavily and frequently than other students. With female student drinking on the rise over the past decade, sorority women may be at particular risk for heavy consumption patterns. The current study is the first to apply the Theory of Planned Behavior (TPB) to examine drinking patterns among a sorority-only sample. Two-hundred and forty-seven sorority members completed questionnaires measuring TPB variables of attitudes, norms, perceived behavioral control, and intentions, with drinking behaviors measured one month later. Latent structural equation modeling examined the pathways of the TPB model. Intentions to drink mediated the …

Too Little, Too Late: The Current Generation Of College Women And Sexual Health Education, Nicole C. Schumaker Apr 2008

Too Little, Too Late: The Current Generation Of College Women And Sexual Health Education, Nicole C. Schumaker

Masters Theses

This research was conceived when I acknowledged the ways in which women of my generation have been educated about their bodies and about their sexuality. In a review of the literature on adolescent female sexuality, there is substantial evidence to suggest that in regards to early female sex education, adolescent sexuality is linked with danger, victimization, and passivity. Accordingly, it is asserted that these understandings of female sexuality disallow young girls to see themselves as initiators and decision-makers thus compromising their development of sexual subjectivity and responsibility in adulthood.

Data for this project were collected through ten semi-structured interviews with …

A Study Of Body Scent As A Social Identifier Among Members Of The Arabic Culture, Mia M. Wilson Apr 2008

A Study Of Body Scent As A Social Identifier Among Members Of The Arabic Culture, Mia M. Wilson

Masters Theses

Body scent plays a major factor in how individuals interact with one another. While Americans have their own perception of what is "proper" body scent, they still remain uninformed about the various ways body scent is used to deliver social messages and form interpersonal relationships within other cultures. With many immigrants continuing to move to the United States (Frey, 2004), American societies need to become educated on other cultures' social aspects of body scent to avoid alienation of foreign communities. This qualitative research study explores how individuals of the Saudi Arabian culture use body scent as a social identifier to …

Predicting Attitude Toward Sex Education In Public Schools, Sarah A. Gibson Apr 2008

Predicting Attitude Toward Sex Education In Public Schools, Sarah A. Gibson

Sociology & Criminal Justice Theses & Dissertations

According to the National Center for Health Statistics, the teen pregnancy rate rose by 3% between 2005 and 2006, presenting the first increase since 1991. These findings are troubling in light of the consequences of teen pregnancy to teen mothers, their children, and society in general. Many commentators suggest that one method of reducing the rate of teen pregnancies is through sex education programs, particularly in the public school system. However, despite the fact that discussions of sex education in public school have been present since the 1920s, polls indicate that there is still a portion of the public that …

Notes From Tsinghua: Law And Legal Ethics In Contemporary China, Eli Wald Apr 2008

Notes From Tsinghua: Law And Legal Ethics In Contemporary China, Eli Wald

Connecticut Journal of International Law

This article contributes to the expanding body of literature studying Chinese law and the Chinese legal profession by exploring Chinese legal ethics from the unique perspective of a legal ethics professor in China. Based on the vast differences between Chinese and American law in general, and between Chinese and American legal ethics in particular, one may expect to find that Chinese law students differ from American law students in significant, ideological and explicit ways. This article argues, however, that differences between Chinese and American law students emerge in subtle and implicit details: methods of reasoning and arguing; habits of learning …

Palestinian Women's Roles After The First Intifada, 1987-1992, Bader Seetan Almadi Apr 2008

Palestinian Women's Roles After The First Intifada, 1987-1992, Bader Seetan Almadi

Theses and Dissertations

This dissertation is a study of Palestinian women’s roles following the First Intifada, or Palestinian uprising, which began in 1987. This study considers whether Palestinian women found greater participation in their social life outside of the home during the challenges of the Intifada. In Palestinian society, traditional family roles and the various interpretations of Islamic teachings about to the family have severely restricted the role of women in society, and these limitations have served to increase the desire of these women for greater participation outside of the home.

This dissertation will focus on how religious forces, in addition …

Practice Style And Successful Legal Mobilization, Anne Bloom Apr 2008

Practice Style And Successful Legal Mobilization, Anne Bloom

Law and Contemporary Problems

Bloom talks about the making of a great cause lawyer. Perhaps not surprisingly, dedication, strong political ties, and superb legal skills all play a role in the making of a great cause lawyer, but so does a somewhat less obvious quality, which Marc Galanter described several years ago as practice "style." However, in these case studies, it suggests that the making of a great cause lawyer depends, in part, on practice style. Put differently, how a lawyer approaches legal practice seems to matter for purposes of legal mobilization. In these cases, cause lawyers were more effective at using the law …

The Study Of Law And India’S Society: The Galanter Factor, Robert Moog Apr 2008

The Study Of Law And India’S Society: The Galanter Factor, Robert Moog

Law and Contemporary Problems

Moog pursues three related themes or lines of inquiry that have marked her own research, the roots of which are to be found in Marc Galanter's earlier works and the broader law-and-society movement. These include, the significance of lower courts, the role of the local bar, and the evolution of alternatives to formal court proceedings all represent essential areas for exploration in the attempt to understand the successes and failures of the Indian justice system.

An Appreciation Of Marc Galanter’S Scholarship, John Lande Apr 2008

An Appreciation Of Marc Galanter’S Scholarship, John Lande

Law and Contemporary Problems

Lande highlights three of Marc Galanter's works to illustrate qualities that seem especially worth emulating. He includes extended excerpts of his writing because his concepts and language are so evoctive that paraphrasing often does not do them justice. Galanter's works that Lande focuses, include the classic articles, "Why the "Haves" Come Out Ahead: Speculations on the Limits of Legal Change"; and "Case Congregations and Their Careers". The professor's recent book, Lowering the Bar: Lawyer Jokes and Legal Culture, is also featured. The book is the culmination of much of his work on American law.

Kurds In Turkey And In (Iraqi) Kurdistan: A Comparison Of Kurdish Educational Language Policy In Two Situations Of Occupation, Tove Skutnabb-Kangas

Genocide Studies and Prevention: An International Journal

This article describes, compares, and analyzes two educational situations for Kurds from the point of view of linguistic human rights, using prodigious exemplification. In Turkey, Kurdish-medium schools are not allowed, and Kurdish children do not even have the right to study their mother tongue as a subject in school. In addition to physical genocide through low-intensity warfare, including unacceptable living conditions, Turkey continues to commit linguistic and cultural genocide (according to definitions of genocide in articles 2(b) and 2(e) in the UN Convention on the Prevention and Punishment of the Crime of Genocide) in relation to the Kurdish nation/minority. Under …

The Working Lawyer As Subject And The Juridical Event, Kirk W. Junker Apr 2008

The Working Lawyer As Subject And The Juridical Event, Kirk W. Junker

Cardozo Law Review

When introducing the respective roles of the philosopher and the mathematician in Being and Event, Alain Badiou notes that when representing mathematics: "placing being in the general position of an object, would immediately corrupt the necessity, for any ontological operation, of de-objectification. Hence, of course, the attitude of those the Americans call working mathematicians: they always find general considerations about their discipline vain and obsolete. They only trust whomever works hand in hand with them grinding away at the latest mathematical problem. . . . Empirically, the mathematician always suspects the philosopher of not knowing enough about mathematics to have …
