A Reader's Companion To Against Prediction: A Reply To Ariela Gross, Yoram Margalioth, And Yoav Sapir On Economic Modeling, Selective Incapacitation, Governmentality, And Race, Bernard E. Harcourt

Articles

From parole prediction instruments and violent sexual predator scores to racial profiling on the highways, instruments to predict future dangerousness, drug-courier profiles, and IRS computer algorithms to detect tax evaders, the rise of actuarial methods in the field of crime and punishment presents a number of challenging issues at the intersection of economic theory, sociology, history, race studies, criminology, social theory, and law. The three review articles of Against Prediction: Profiling, Policing, and Punishing in an Actuarial Age by Ariela Gross, Yoram Margalioth, and Yoav Sapir, raise these challenges in their very best light. Ranging from the heights of poststructuralist …

A Schweitzer Approach To Higher Education: Utilizing Principles Drawn From The Life Of Albert Schweitzer To Develop A Holistic And Comprehensive Educational Model, John B. Miller

Theses and Graduate Projects

While quite young, Albert Schweitzer was already a well regarded philosopher, a gifted musician, and a groundbreaking theologian when he became a medical doctor and devoted his life to service in equatorial Africa where he received the inspiration for his central ethic of Reverence for Life. A Schweitzer-based higher educational approach draws upon Schweitzer's life example in interweaving elements of academics, arts, spirituality, service, and the direct experience of nature. The academic content is grounded in complexity theory, a post-moderm discipline which expands upon Schweitzer's recognition that, "l am life that wills to live in the midst of life that …

Exploring The Personal Reality Of Disability And Recovery: A Tool For Empowering The Rehabilitation Process, Ashley E. Kurz, Nicole Saint-Louis, Janice P. Burke, Margaret G. Stineman

Publications and Research

People experiencing disability and chronic disease often feel powerless, relinquishing medical control to “more knowledgeable” professionals. This article presents qualitative and quantitative results from three individual patients experiencing an emerging procedure called Recovery Preference Exploration (RPE). To inspire greater patient involvement, self-direction, and individual choice, we instructed participants to create an imagined recovery path, exposing recovery preferences while learning about clinical rehabilitation concepts. Results uncovered important values and feelings about disability, providing a richer context for patient evaluation and treatment goal modification. Applying mixed methods, RPE is presented as an explanatory process for quantifying recovery preferences in a way that …

In addition, this study identified common leadership traits and training methods within these programs. Using a randomized list of leadership traits, valued characteristics were identified. The traits chosen most often were empowerment, advocacy, and decision making skills.

Deaning For Whom? Means And Ends In Legal Education, Hon. Kristin Booth Glen Jan 2008

Deaning For Whom? Means And Ends In Legal Education, Hon. Kristin Booth Glen

Seattle University Law Review

I was an accidental dean. Law school deanship, or any kind of administration, was something that had never occurred to me. But after almost thirty happy and rewarding years as a constitutional litigator, state trial and appellate judge, and frequent law school professor, my dear friend, W. Haywood Burns, asked me to apply for the deanship at City University of New York School of Law (CUNY). Any request from Haywood was a good enough reason for complying. When, to my surprise, I was selected, I had to confront the more profound question of why I should become a law school …

HIV and AIDS

HIV prevalence in Maharashtra is one of the highest among Indian states. The specific objectives of this study were: to understand the patterns and drivers of migration/mobility of men who migrate for the purpose of work in the state of Maharashtra; to describe the characteristics of vulnerable subpopulations among migrant men; and to examine the determinants of high-risk sexual behavior among the subpopulations of migrant men with particular emphasis on the role of mobility in determining the sexual risk behavior. International Legal Practice Involving England And New York Following Adoption Of The United Kingdom Legal Services Act Of 2007, Sydney M. Iii Cone Jan 2008

International Legal Practice Involving England And New York Following Adoption Of The United Kingdom Legal Services Act Of 2007, Sydney M. Iii Cone

Northwestern Journal of International Law & Business

This article deals with the regulation of legal services in England and New York in the context of, first, multidisciplinary practice ("MDP") and, second, permitted investment in legal practice. The article summarizes both the background of and potential differences between the regulations in those two jurisdictions, and comments on the possible reconciliation of those differences. Because, chronologically, New York was the first of the two jurisdictions under consideration to adopt rules on MDP, the New York rules will be considered first, and the more recent statute, known as the United Kingdom Legal Services Act 2007 (hereinafter "U.K. Act"), will then …

"More Adversarial, But Not Completely Adversarial": Reformasi Of The Indonesian Criminal Procedure Code, Robert R. Strang

Fordham International Law Journal

This Article provides a perspective not normally available to U.S. legal scholars in the area of comparative law -- it is a firsthand account of criminal procedure reform in the Republic of Indonesia. Indonesia, the world’s fourth largest country by population and the largest civil law jurisdiction, has embarked on sweeping legal, political, and institutional reform in the ten years since the collapse of authoritarian rule. Half way around the world from the U.S., Indonesia is virtually unknown to Western legal scholars, yet the changes being made in Indonesian criminal procedure are fundamental: establishing a suspect’s right to remain silent; …

Art And Literature In A Servant-Leadership Curriculum For Undergraduate Female Students Who Are From Mexican Migrant Farm Worker Backgrounds, Patricia Valdes Jan 2008

Art And Literature In A Servant-Leadership Curriculum For Undergraduate Female Students Who Are From Mexican Migrant Farm Worker Backgrounds, Patricia Valdes

International Journal of Servant-Leadership

This paper proposes a university leadership curriculum for undergraduate female students who are from Mexican migrant farm worker backgrounds. The curriculum incorporates the philosophy of servant-leadership and utilizes literature and art to provide media that are congruent with the cultural background of the students. The curriculum's intent is three-fold: a) to improve the capacity of Latina migrant students to be leaders and fulfill leadership roles in organizations and communities; b) to contribute to the understanding of servant-leadership and its possible congruency with the culture of female Mexican migrant students; and c) to add to the current knowledge of leadership in …

An Examination Of Female Youth Gangs, Tiffiney Y. Barfield-Cottledge, Myrna Cintron, Jonathan Sorensen Jan 2008

An Examination Of Female Youth Gangs, Tiffiney Y. Barfield-Cottledge, Myrna Cintron, Jonathan Sorensen

Contemporary Issues in Juvenile Justice

Cohen's subculture of delinquency theory (1955) posits that male youth gangs exist largely as the result of the status frustration experienced by rejected adolescents in their search for middle class acceptance. Cohen concluded that social and structural factors, particularly neighborhood and school environments, impacted youth gang prevalence. While many studies related to the existence of youth gangs have been conducted, few have focused specifically on female youth gangs. In the current study, an examination of female youth gangs was conducted using self-report data gathered for the National Longitudinal Survey of Youth (1997-2001). Contrary to arguments that gendered-specific criminological theories are …
