Governments In Miniature: The Rule Of Law In The Administrative State, Mary Liston Jan 2008

Governments In Miniature: The Rule Of Law In The Administrative State, Mary Liston

All Faculty Publications

The concept of the rule of law ties together the seemingly disparate strands of administrative law. Indeed, the puzzles and tensions that administrative law evokes cannot be understood without recourse to this foundational concept. This chapter discusses several of the key attributes of the rule of law and explores their relevance for Canadian administrative law, for example: the rule of law as an unwritten constitutional principle; the rule of law as a political ideal which structures institutional relations and competencies; and, the rule of law as a distinctive political morality. The chapter assesses the Canadian articulation of the rule of …

Moral Philosophy, Information Technology, And Copyright, Wendy J. Gordon Jan 2008

Moral Philosophy, Information Technology, And Copyright, Wendy J. Gordon

Faculty Scholarship

A plethora of philosophical issues arise where copyright and patent laws intersect with information technology. Given the necessary brevity of the chapter, my strategy will be to make general observations that can be applied to illuminate one particular issue. I have chosen the issue considered in MGM v. Grokster,2 a recent copyright case from the U.S. Supreme Court Grokster, Ltd., provided a decentralized peer-to-peer technology that many people, typically students, used to copy and distribute music in ways that violated copyright law. The Supreme Court addressed the extent to which Grokster and other technology providers should be held …

Reviews In Medical Ethics: Stumbling On Options: A Review Of Readings In Comparative Health Law & Ethics, Frances H. Miller

Faculty Scholarship

Thanks to a series of storms sweeping up the eastern seaboard for three days, I found myself with four fivehour flight delays and two completely unrelated books in my briefcase. One of the books was the second edition of Professor Tim Jost's Readings in Comparative Health Law & Ethics,' which I was reviewing for this publication. The second was Daniel Gilbert's Stumbling on Happiness,2 which someone - no doubt thinking I could use a little wisdom on the subject - had given me for my birthday. I did not mind the delays, for they gave me time …

Together We Can: Imagining The Future Of Employee Pensions, Maria O'Brien

Faculty Scholarship

Reviewing Teresa Ghilarducci & Christian E. Weller, Eds. Employee Pensions: Policies, Problems & Possibilities (LERA 2007)

A little over thirty years ago Congress enacted the Employee Retirement Income Security Act (ERISA),1 a comprehensive reform of the existing system of pension regulation.2 Solidly into its fourth decade, ERISA has been the object of much commentary as the various federal courts have struggled to infuse its complicated and sometimes imprecise pieces with coherent meaning. 3 Some have suggested that ERISA's primary goal of reducing the risk to employees of employer default has largely been achieved.4 Others believe that almost …

Role-Based File Archiving, Jean Paul Bourget Jan 2008

Role-Based File Archiving, Jean Paul Bourget

Theses

A file server, one of the places where a company stores it data, is a goldmine. In the beginning, we had filing cabinets managed by individuals and departments who had policies for archiving and purging documents over time due to space limitations or organization. This paper explores possible solutions for archiving a network file system. When we switched from filing cabinets to digital data storage, two things were not added to file systems. First, there is a tendency for data to grow at a dramatic rate without the benefit of archiving. This leads to adding more disk space. Clearly, this …

The Impact Of Internet Social Networking Websites On The Gay Community: Behavior And Identity, Michael Cinquanti Jan 2008

The Impact Of Internet Social Networking Websites On The Gay Community: Behavior And Identity, Michael Cinquanti

Theses

The hypothesis of this thesis is that social networking website design can exert a mediating influence upon the culture of a site by supporting certain behaviors more than others; this influence can be analyzed in an active and structured way that takes into account the culture of the community it addresses. Evidence will be offered by case study, demonstration of specific mediations, and analysis. This hypothesis will be tested with specific reference to the gay male community. The scope of this paper will be limited to the analysis of gay-oriented social networking websites as new media, in general and through …

Land Use Law And Active Living: Opportunities For States To Assume A Leadership Role In Promoting And Incentivizing Local Options, Patricia E. Salkin, Amy Lavine Jan 2008

Land Use Law And Active Living: Opportunities For States To Assume A Leadership Role In Promoting And Incentivizing Local Options, Patricia E. Salkin, Amy Lavine

Scholarly Works

Obesity, asthma and nutrition are just three public health challenges facing children and adults that can be addressed through land use planning and zoning. States must take a leadership role in providing statutory authority and guidance for local governments to enact and implement laws and ordinances designed to promote active living. Land use policies, transportation policies, redevelopment policies and open space and recreation policies are key areas where reform is needed. This paper highlights existing examples from various states and offers lawmakers, policymakers and advocates options for reforming state laws to incentivize and influence local actions.

Understanding Community Benefits Agreements: Equitable Development, Social Justice And Other Considerations For Developers, Municipalities And Community Organizations, Patricia E. Salkin, Amy Lavine Jan 2008

Understanding Community Benefits Agreements: Equitable Development, Social Justice And Other Considerations For Developers, Municipalities And Community Organizations, Patricia E. Salkin, Amy Lavine

Scholarly Works

The opportunity to develop a Community Benefits Agreement (CBA) typically arises when a developer announces plans to construct a major project, such as a stadium or a theater complex. Local residents and business owners may often welcome these projects, but they may also have legitimate fears, such as: Will the project displace local residents and local businesses, either physically or through gentrification? Will it cause traffic problems and generate noise, pollution, or other nuisances? Will the economic development benefits espoused by the developer actually create jobs that pay a living wage and offer decent benefits for residents in the neighborhood …

The blog is updated daily with a review of a recent land use case decided by a state or federal court. In addition, the site has reported on relevant gubernatorial executive orders, offered book reviews, and occasionally starts a discussion on current events issues, such as climate change and has led to robust debate about …

Investigations Of Cellular Automata-Based Stream Ciphers, Joseph S. Testa Jan 2008

Investigations Of Cellular Automata-Based Stream Ciphers, Joseph S. Testa

Theses

In this thesis paper, we survey the literature arising from Stephan Wolfram's original paper, “Cryptography with Cellular Automata” [WOL86] that first suggested stream ciphers could be constructed with cellular automata. All published research directly and indirectly quoting this paper are summarized up until the present. We also present a novel stream cipher design called Sum4 that is shown to have good randomness properties and resistance to approximation using linear finite shift registers. Sum4 is further studied to determine its effective strength with respect to key size given that an attack with a SAT solver is more efficient than a bruteforce …

An Overview Of Packaging Sustainability Topics, Alexandros Astropekakis Jan 2008

An Overview Of Packaging Sustainability Topics, Alexandros Astropekakis

Theses

This thesis presents the global challenges behind the need of sustainable development. It links packaging to this need and describes the way packaging can positively contribute to this process. It presents industry examples of "green packaging" that claim to or may actually contribute to sustainable development. It monitors the understanding of packaging professionals for what is called "packaging sustainability" through a custom made on-line survey. Finally it presents a comparison of environmental impacts for different polymer materials used for the production of rigid containers (HDPE, PP, PET, PVC and PLA) through an analysis of Life Cycle Inventory (LCI) data for …

National Juries For National Cases: Preserving Citizen Participation In Large-Scale Litigation, Laura Dooley Jan 2008

National Juries For National Cases: Preserving Citizen Participation In Large-Scale Litigation, Laura Dooley

Scholarly Works

Procedural evolution in complex litigation seems to have left the civil jury behind. Reliance on aggregating devices, such as multidistrict litigation and class actions, as well as settlement pressure created by “bellwether” cases, has resulted in cases of national scope being tried by local juries. Local juries thus have the potential to impose their values on the rest of the country. This trend motivates parties to forum-shop, and some commentators suggest eliminating jury trials in complex cases altogether. Yet the jury is at the heart of our uniquely American understanding of civil justice, and the Seventh Amendment mandates its use …

Prosecution Of Process Crimes: Thoughts And Trends, Allison Caffarone, Karen Patton Seymour, Stephen R. Peikin Jan 2008

Prosecution Of Process Crimes: Thoughts And Trends, Allison Caffarone, Karen Patton Seymour, Stephen R. Peikin

Scholarly Works

The United States Department of Justice has come under attack in recent years because of its increased attention to, and prosecution of, crimes committed during the course of its investigations — obstruction of justice, perjury, and making false statements. These crimes have been labeled “cover-up” or “process crimes,” and the charging prosecutors have been criticized as bringing such charges only against high-profile defendants as to whom there is insufficient evidence to charge the “more serious” underlying offenses that prompted the initial investigation. Some critics have gone so far as to label these prosecutions “vindictive.” Much of this criticism is misplaced. …

Guidelines For Material Selection For Sustainable Packaging Solutions, Susan Parra Jan 2008

Guidelines For Material Selection For Sustainable Packaging Solutions, Susan Parra

Theses

With the growing concern on environmental issues, many companies are developing research studies to reduce its negative effects on the environment and become more sustainable. Packaging has been one of the most significant issues of concern because of its environmental impact and end-of-life cycle. The overall goal of this project is to quantify how packaging material selection plays a key role in developing sustainable practices in industry. This study will evaluate the importance of the selection of materials during the packaging design process and focus on the effects of material decisions in the life cycle of the package. In particular, …

Hydrologic Response To Extreme Warm And Cold Summers In The Mcmurdo Dry Valleys, East Antarctica, Peter T. Doran, Christopher P. Mckay, Andrew G. Fountain, Thomas H. Nylen, Diane M. Mcknight, Chris Jaros, John E. Barrett

Geography Faculty Publications and Presentations

The meteorological characteristics and hydrological response of an extreme warm, and cold summer in the McMurdo Dry Valleys are compared. The driver behind the warmer summer conditions was the occurrence of down-valley winds, which were not present during the colder summer. Occurrence of the summer down-valley winds coincided with lower than typical mean sea level pressure in the Ross Sea region. There was no significant difference in the amount of solar radiation received during the two summers. Compared to the cold summer, glaciological and hydrological response to the warm summer in Taylor Valley included significant glacier mass loss, and 3- …

Hiv-1 Tat Protein Alter The Tight Junction Integrity And Function Of Retinal Pigment Epithelium: An In Vitro Study., Ling Bai, Zhenping Zhang, Hui Zhang, Xiumei Li, Qiurong Yu, Haotian Lin, Wenhui Yang

Department of Medicine Faculty Papers

BACKGROUND: How HIV-1 enter into the eyes remains obscure. We postulated that HIV-1 Tat protein can alter the expression of specific tight-junction proteins and disturb the blood retinal barrier, and contributes to HIV trafficking into the eyes. This study is to determine the effects of HIV-1 Tat proteins on the barrier function and tight-junction protein expression of retinal pigment epithelial cell (RPE). METHODS: A human RPE cell line (D407) cultured on microporous filter-supports was used. After treating with HIV-1 Tat protein, transepithelial electrical resistance (TER) of confluent RPE cells was measured by epithelial voltmeter. The permeability of the RPE cells …

Hiv-1 Tat And Aids-Associated Cancer: Targeting The Cellular Anti-Cancer Barrier?, Giuseppe Nunnari, Johanna A Smith, René Daniel

Department of Medicine Faculty Papers

The acquired immunodeficiency syndrome (AIDS) is accompanied by a significant increase in the incidence of neoplasms. Several causative agents have been proposed for this phenomenon. These include immunodeficiency and oncogenic DNA viruses and the HIV-1 protein Tat. Cancer in general is closely linked to genomic instability and DNA repair mechanisms. The latter maintains genomic stability and serves as a cellular anti-cancer barrier. Defects in DNA repair pathway are associated with carcinogenesis. This review focuses on newly discovered connections of the HIV-1 protein Tat, as well as cellular co-factors of Tat, to double-strand break DNA repair. We propose that the Tat-induced …

Changing The Rules Of Establishment Clause Litigation: An Alternative To The Public Expression Of Religion Act, Christopher D. Tomlinson Jan 2008

Changing The Rules Of Establishment Clause Litigation: An Alternative To The Public Expression Of Religion Act, Christopher D. Tomlinson

Vanderbilt Law Review

In 2004, the American Civil Liberties Union ("ACLU") threatened to sue the city of Redlands, California, if it did not remove a small cross from its city seal.' The cross represented the city's religious heritage and its history as a city of churches. Instead of facing the possibility of litigation and the more daunting risk of losing in court and being forced to pay the ACLU's attorneys' fees in addition to its own, the Redlands City Council agreed to change the seal. The City of Redlands not only could ill afford the risk of paying the ACLU's attorneys' fees; it …

Do patents provide critical incentives to encourage investment in innovation? Or, instead, do patents impose legal risks and burdens on innovators that discourage innovation, as some critics now claim? This paper reviews empirical economic evidence on how well patents perform as a property system.

The Trademark Use Requirement In Dilution Cases, Stacey Dogan, Mark A. Lemley Jan 2008

The Trademark Use Requirement In Dilution Cases, Stacey Dogan, Mark A. Lemley

Faculty Scholarship

The trademark use doctrine plays a critical role in ensuring that trademark law serves its proper purpose of encouraging market exchange and lowering consumer search costs. As we have explained in detail elsewhere, the doctrine ensures that trademarks do not become a weapon used to suppress speech or to interfere with rather than promote the efficient operation of the marketplace.

Those goals are even more important in the context of trademark dilution. Unlike a normal cause of action for trademark infringement, trademark dilution gives broader rights to a few famous mark owners to prevent even non-confusing uses in order to …

Red Versus Blue (And Purple) States In The Same-Sex Marriage Debate: From Values Polarization To Common Ground?, Linda C. Mcclain

Faculty Scholarship

What is the role of courts in circumstances of "values polarization"? The framing of this question brings to mind, but differs from, some familiar inquiries about the judicial role in circumstances of conscientious moral disagreement or value pluralism and debates about liberty, morality, and community. Using the conflict over whether civil marriage should extend to same-sex couples as an example, I contrast two recent analyses of values polarization and its implications for finding agreement, Ronald Dworkin’s book, Is Democracy Possible Here?, and June Carbone and Naomi Cahn's project, Red Families v. Blue Families. Dworkin's strategy is to identify shared principles …

Open Code Governance, Danielle K. Citron Jan 2008

Open Code Governance, Danielle K. Citron

Automated information systems offer an opportunity to improve the democratic legitimacy of the administrative state. Today, agencies transfer crucial responsibilities to computer systems. Computers gather and interpret important information. For instance, electronic machines record and calculate votes. Automated systems execute policy and render decisions about important individual rights, such as a person's eligibility for public benefits. Computer systems store sensitive personal information. These systems' closed architecture, however, shields vital agency decisions from view. No one can see how a system operates without a software program's source code. Closed code hides programming errors that disenfranchise voters, under-count communities for the census, …
