Habeas Corpus, Constructive Custody And The Future Of Federal Jurisdiction After Munaf, Karen Shafrir

University of Miami International and Comparative Law Review

In 2004-05, two American Citizens, Shaqir Omar and Mohamed Munaf were separately arrested in Iraq and placed in the Camp Cropper Military Facility, pending adjudication. Both prisoners filed writs of habeas corpus in the United States District Court for the District of Columbia. The primary issue that the lower courts grappled with was whether or not the courts had jurisdiction to hear the petitions. After various appeals, the United States Supreme Court concluded that the federal courts did have jurisdiction to entertain the habeas petitions but that the petitions would fail on the merits. Hurricane Katrina was one of the worst natural disasters ever to strike the United States, in terms of casualties, suffering, and financial cost. Often overlooked among Katrina s victims are the 8,000 inmates who were incarcerated at Orleans Parish Prison (OPP) when Katrina struck. Despite a mandatory evacuation of New Orleans, these men and women, some of whom had been held on charges as insignificant as public intoxication, remained in the jail as the hurricane hit, and endured days of rising, toxic waters, a lack of food and drinking water, and a complete breakdown of order within OPP Wien the …

In 2006 through 2008, Dr. Mary Cay Sengstock held a grant from the Blue Cross and Blue Shield of Michigan Foundation to study the effectiveness of the current system for identifying and assisting abused elders in the State of Michigan.

This document presents the Final Report of the project. It can serve as a model, not only for the State of Michigan, but for other states regarding the mechanisms which are effective in identifying and assisting abused elders, as well as the problems and dilemmas which may arise.

The intent of this study is to analyze the advancements being made in the switch to digital transmissions and to highlight the increasingly advancing means of data transfer within, but not limited to, the confines of rescue and emergency services. Therefore the transition from the former 4ooMHZ to the 8ooMHZ radio systems will be the focus of this study, and will prove how technology can assist in adaptation and transformation.

The Continuing Threshold Test For Free Exercise Claims, Andy G. Olree

When a claimant challenges some governmental law or action under the Free Exercise Clause of the First Amendment, courts have long required the claimant to make out a prima facie case that the government has burdened the exercise of the claimant's sincerely held religious beliefs. This requirement has been referred to as the threshold test for free exercise claims, since claimants must make this showing as a threshold matter before courts will proceed to evaluate the burden and the governmental interest at stake under some standard of scrutiny. Can sections 2(b) and 3 of the Canadian Charter of Rights and Freedoms be interpreted to protect a constitutional right of access to government information?
