This article first recontextualizes the Second Amendment debate by examining the two main interpretations of militia clause of the amendment. First, this article examines the two main interpretations of the amendment while pushing the historical lens back to an examination of English law and society. Then, this article surveys the jurisprudence and the interpretation of the right to bear arms throughout American history. This article also addresses the rise of the academic debate and significant legal scholarship. Over half a million registered sex offenders currently live in the United States. Sex offenses are among the most devastating crimes because of the long-lasting emotional, physical, and psychological effects it has on victims. Sadly, most victims of sex offenses are innocent children. "Most sex offenders are not in prison, and ... are largely unknown to people in the community." Sex offenders also have a propensity for reoffending their crimes. "While community supervision and oversight is widely recognized as essential, the system for providing such supervision is overwhelmed." While there have been numerous studies examining certain aspects of the effects of collective bargaining, there have yet to be any empirical studies on the effects of collective bargaining on the use of police policy. This study looks to address this issue by examining the impact of collective bargaining on the use of three currently innovative police policies: early warning systems, civilian review boards, and the use of in-car cameras. Using data from the 2003 Law Enforcement Management and Administrative Statistics (LEMAS) survey, we look at municipal agencies with over 100 officers. The reentry of inmates back into the community is a hotly debated topic in society today. A descriptive study was conducted to analyze what mental health services were being provided to inmates who were participants in the Serious and Violent Offender Reentry Initiative (SVORI). Additionally, barriers to implementing comprehensive mental health services, along with trends within and across the New England Region regarding mental health services were examined. The data collected was from three program evaluation surveys completed by Project Directors for SVORI in 2003, 2005, and 2006. Joint ventures between tax-exempt hospitals and for-profit organizations have become a common mechanism for hospitals to acquire new sources of revenue and expand their health care services without completely relying on more traditional sources of funding. Joint ventures between tax-exempt organizations and for-profit entities can lead to unfavorable tax consequences for the exempt organization if the venture is not structured in accordance with the rules and regulations provided by the Internal Revenue Service. IRS Revenue Ruling 2004-51 held that an exempt organization would maintain its exempt status as long as it only contributed an insubstantial amount of its assets or …

Underlying the juvenile court system are two competing philosophies of justice which have taken predominance over the system at different historical periods in relation to the public climate. Early reformers conceptualized juvenile justice as an informal and protective system that would seek to rehabilitate disadvantaged children who had succumbed to criminal influences. In response to negative assessments noting the leniency of juvenile courts, critics began to advocate for a more punitive system which would focus on retribution rather than treatment. Measures adopted by courts to increase the criminal responsibility placed upon juveniles include minimum sentencing guidelines and transfer of offenders …

Really Leaving No Child Behind: How The Supreme Court's Student Speech Doctrine Compromises Modern Education Reform - And How It Can Use The In Loco Parentis Doctrine To Change It, Scott J. Street

tudent speech" doctrine defined by Tinker in favor of an in loco parentis standard that defers to the expertise of school officials in maintaining a safe, effective, and orderly school environment. Contrary to what its critics assume, an in loco parentis standard would not give school officials carte blanche to violate their students' rights. It would, for example, prohibit school officials from discriminating against students on the basis of viewpoint. West Virginia is one of the nation’s most rural states and historically its economy has been more unstable than that of most states. Over the years, West Virginia has devoted efforts through national and local policy programs to induce economic prosperity, curtail out-migration, and mitigate poverty, yet many of its counties remain economically depressed with high unemployment, deeply rooted poverty, low human capital formation, out-migration, and a shrinking economic base.
