Less Privacy Please, We're British: Investigating Crime With Dna In The U.K. And The U.S., Duncan Carling

The United States and Great Britain are the world leaders in the use of DNA databases for criminal investigations, but the laws governing their use are evolving differently in each country. This note compares the American and British DNA database programs, and looks at two notable differences in practice: the collection of DNA samples from people who have been arrested but not convicted, and the technique of looking for an offender's relatives in the database. The note offers an explanation as to why the legislation is evolving differently, and argues that disparate cultural views on privacy are as much part …

The Fourth Amendment And Immigration Enforcement In The Home: Can Ice Target The Utmost Sphere Of Privacy?, Marisa Antos-Fallon

This Note discusses whether targeting and entering homes of non-citizens without court-ordered warrants raises problems under the Fourth Amendment's prohibition of "unreasonable searches and seizures." Specifically, this note argues that additional protections are necessary to ensure that ICE does not violate the Fourth Amendment rights of those they target and those who get swept up in their enforcement effort. This is particularly true with initiatives such as "Operation Return to Sender" and "Operation Community Shield" because they are carried out in private homes, the traditional sphere of greatest Fourth Amendment protection. Securing The Global City: Crime, Consulting, Risk, And Ratings In The Production Of Urban Space, Katharyne Mitchell, Katherine Beckett
Indiana Journal of Global Legal Studies
The last decade has witnessed the rise of private transnational institutions that increasingly influence the organization and management of urban space. Two institutions are especially powerful in this regard: bond-rating agencies and global security firms. Bolstered by a discourse of risk and the need to securitize cities, these institutions have garnered enormous amounts of power with respect to urban social and spatial control. They are implicated in the imprisonment and displacement of marginalized populations, the intensification of gentrification, and general shifts in municipal funding priorities. Brennan Lecture Evidence-Based Judicial Discretion: Promoting Public Safety Through State Sentencing Reform, Michael A. Wolff

In this speech delivered for the annual Justice William J. Brennan, Jr. Lecture on State Courts and Social Justice, the Honorable Michael Wolff offers a new way of thinking about sentencing. Instead of attempting to limit judicial discretion and increase incarceration, states should aim to reduce recidivism in order to make our communities safer. Judge Wolff uses the example of Missouri's sentencing reforms to argue that states should adopt evidence-based sentencing, in which the effectiveness of different sentences and treatment programs are regularly evaluated. Justifying Facial Discrimination By Government Defendants Under The Fair Housing Act: Which Standard To Apply, Kaitlin A. Bridges

This Summary will discuss the standard that the Sixth, Ninth, and Tenth Circuits have adopted, as well as the opposing viewpoint of the Eighth Circuit. In discussing the various standards that courts of appeals have adopted, this Summary will demonstrate that the standard currently employed by the Eighth Circuit fails to adequately prevent and protect citizens from housing discrimination, as intended by the Fair Housing Act. The Summary will ultimately conclude that the Sixth, Ninth, and Tenth Circuits have applied the appropriate standard, and that the Eigth Circuit needs to join those Circuits in applying a standard that encourages those …

As a centerpiece to its 2008-09 budget determination process, the City of Lincoln invited the community to provide input about how the City should prioritize budget items. Several thousand residents provided input over a period of approximately 90 days, starting in February 2008 and ending in May 2008. Michigan Bovine Tuberculosis Bibliography and Database
Bovine Tuberculosis (TB) is an infectious disease that is close to being eradicated in the United States, but still poses a significant risk to domestic livestock, wildlife, companion animals, and humans throughout the world. The Michigan Bovine TB Eradication Project involves a multiagency team of experts from the Michigan Departments of Agriculture, Natural Resources and Community Health, Michigan State University, and the US Department of Agriculture.
