Towards An Equality-Enhancing Conception Of Privacy, Jane Bailey Oct 2008

Towards An Equality-Enhancing Conception Of Privacy, Jane Bailey

Dalhousie Law Journal

Canadian jurisprudence has explicitly recognized the impact of child pornography on the privacy rights of the children abused in its production. In contrast, it has generally not analyzed other forms of harmful expression, such as hate propaganda and obscenity,to be violations of the privacy rights of those targeted. In a previous article, the author suggested that this distinction in the jurisprudence reflected the relative ease with which the privacy interests of the individual children whose abuse is documented inchild pornography meshed with the prevalent Western approach toprivacy as a negative individual liberty against intrusion. Noting the historic role that the …

Executive Branch Lawyers In A Time Of Terror: The 2008 Fw. Wickwire Memorial Lecture, W Bradley Wendel Oct 2008

Executive Branch Lawyers In A Time Of Terror: The 2008 Fw. Wickwire Memorial Lecture, W Bradley Wendel

Dalhousie Law Journal

This article discusses the ethical responsibilities of the lawyers who advise executive branch officials on the lawfulness ofactions taken in the name of national security. To even talk about this subject assumes that there is some distinction -betweena government that does all within its power to protect its citizens, and one that does all within its lawful power If there are good normative reasons to care about maintaining this distinction, then we have the key to understanding the ethical responsibilities of government lawyers. The Bush administration took the position that the role oflawyers is to get out of the way …

Fantasy Crime: The Role Of Criminal Law In Virtual Worlds, Susan W. Brenner Oct 2008

Fantasy Crime: The Role Of Criminal Law In Virtual Worlds, Susan W. Brenner

School of Law Faculty Publications

This article analyzes activity in virtual worlds that would constitute crime if they were committed in the real world. It reviews the evolution of virtual worlds like Second Life and notes research which indicates that more and more of our lives will move into this realm. The article then analyzes the criminalization of virtual conduct that inflicts “harm” in the real world and virtual conduct that only inflicts “harm” in the virtual world. It explains that the first category qualifies as cybercrime and can be prosecuted under existing law. Finally, it analyzes the necessity and propriety of criminalizing the second …

Painting A Moving Train: Adding ‘Postmodern’ To The Taxonomy Of The Law, Adam Todd Oct 2008

Painting A Moving Train: Adding ‘Postmodern’ To The Taxonomy Of The Law, Adam Todd

School of Law Faculty Publications

This article proposes that certain laws or forms of law can be characterized as postmodern because they, like their counterparts in literature or architecture, share similar attributes. Consistent with postmodernism's rejection of modernism, these laws appear to defy the modernist attributes of unitary core principles or singular meaning and stasis. Instead, these postmodern laws are: fragmentary, decentralized, uncertain and allow a multiplicity of interpretations; they reject master-narratives and embrace paradox; they are grounded or rooted in daily life; and are also connected to the internet, cyber-space and high technology.

The identification and characterization of certain laws as postmodern have the …

Existential Temporality As Fore-Ignorance: Implications For Divine Foreknowledge, David Pensgard Oct 2008

Existential Temporality As Fore-Ignorance: Implications For Divine Foreknowledge, David Pensgard

Masters Theses

Investigation into the nature of time is commonly taken to be a necessary precursor to the study of God's temporal status. These studies involve metaphysical concerns within the philosophy of time that focus on the logical structure of tensed statements about the future. Taking a different approach, this paper investigates the nature of temporality, rather than time, and proceeds via a phenomenological methodology. This often-overlooked methodology, it is argued, is preeminent over the metaphysical methodology. When the results of the two methods conflict the phenomenological methodology should dominate discussion. Proceeding with the more powerful method, it is argued that temporality, …

Strategies For Facilitating Athletic Training Clinical Instruction, Pradeep R. Vanguri, Jeff Konim

Internet Journal of Allied Health Sciences and Practice

Purpose: Athletic training education programs ensure the training of clinical instructors through annual workshops designed to familiarize them with athletic training clinical standards and guidelines. An opportunity exists for these workshops to enhance education related to instructional strategies and development. Unfortunately, many clinical instructors lack sufficient time to attend workshops and classes. This research integrates on-line discussion boards as a supplemental tool with in-class workshop sessions. The purpose of this study was to investigate the interaction of clinical instructors through on-line discussion boards. Methods: This research component, in conjunction with a larger project incorporating an in-class clinical instructor workshop, utilized …

Study Of The Sustained Effects Of Reading Recovery In Iowa, Salli Forbes, Mike Szymczuk Oct 2008

Study Of The Sustained Effects Of Reading Recovery In Iowa, Salli Forbes, Mike Szymczuk

Curriculum & Instruction Faculty Publications

Each year 20% or more of students entering first-grade will have severe difficulty learning to read (Clay, 1993; Shaywitz, 2003). Longitudinal research suggests that children who are the lowest achievers in first grade will continue to be the lowest achievers throughout the elementary grades (Juel, 1988). Early intervention with high-quality one-to-one instruction is critical to change the course of learning failure for the lowest-performing children (Clay, 1993; Vellutino et al., 1996). In the United States, a larger percentage of the lowest-achieving children in first grade accelerate their learning and reach grade-level performance in reading and writing with Reading Recovery intervention.

Preacher, Shepherd, Judge: The Role Of The Outlaw Prophet In American Film, Heather Clements Oct 2008

Preacher, Shepherd, Judge: The Role Of The Outlaw Prophet In American Film, Heather Clements

Journal of Religion & Film

U.S. understandings of violence and non-violence are often expressed in stereotypically simplistic terms by Americans and their critics. The maverick cowboy anti-hero who answers to his own code of honor, enforced by redemptive violence, is a quintessential symbol of this American ethos. An exploration of this theme in Pale Rider, Pulp Fiction and The Life and Times of Judge Roy Bean, which center on the tension between violence and non-violence through an outlaw protagonist and his use of Judeo-Christian scriptures, suggests that the true complexity of the American popular moral theology of violence and non-violence is being addressed …

Creating Masculine Identities: Bullying And Harassment "Because Of Sex", Ann C. Mcginley Oct 2008

Creating Masculine Identities: Bullying And Harassment "Because Of Sex", Ann C. Mcginley

Scholarly Works

This Article deals with group harassment of women and men in the workplace under Title VII of the 1964 Civil Rights Act. In Oncale v. Sundowner Offshore Services, the Supreme Court held that Title VII forbids harassment by members of the same sex, but it also emphasized that Title VII is implicated only if the harassment occurs "because of sex." Oncale's "because of sex" requirement has spawned considerable confusion in same-sex and different sex harassment cases. This Article focuses on four fact patterns that confuse courts, scholars, and employment lawyers. In the first scenario, men harass women in traditionally male …

The Inter-American System Of Human Rights: Challenges For The Future, Claudio Grossman Oct 2008

The Inter-American System Of Human Rights: Challenges For The Future, Claudio Grossman

Scholarly Articles in Law Reviews & Journals

The Inter-American system is a combination of human rights norms and supervisory institutions within the Americas. The applicable rules consist primarily of the American Declaration on the Rights and Duties of Man ("American Declaration") and the American Convention on Human Rights ("American Convention"). The institutions involved are the organs responsible for supervising compliance with the established rules: the Inter-American Commission on Human Rights ("the Commission") and the Inter-American Court of Human Rights ("the Court"). The system performs supervisory functions basically through country reports adopted by the Commission which describe the overall human rights situation in a country and decisions in …

Extra-Legal Characteristics And Sentencing Disparity Among Federal Drug Offenders, Justin D. Galasso Oct 2008

Extra-Legal Characteristics And Sentencing Disparity Among Federal Drug Offenders, Justin D. Galasso

Sociology & Criminal Justice Theses & Dissertations

The development of the federal sentencing guidelines was made as an attempt to provide a uniform standard of sentencing procedure for defendants convicted within the federal legal system. Unfortunately, such unvarying policy has over the years birthed a system of sentencing that lacks equality among like defendants. The Supreme Court, in 2005, ruled that the sentencing guidelines were no longer to be compulsory during sentencing procedures, but rather act as an ancillary tool. The present study examines multiple legal and extra-legal variables and their influence on two aspects of imprisonment probability for federal drug offenders for the years of 1999-2006: …

Cooperative Learning With Undergraduate Hispanic Students: Results And Professors’ Interviews, Bobbette M. Morgan, Bret Lefler, Ruth A. Keitz

Teaching and Learning Faculty Publications

Classes of undergraduate Hispanic students assigned to two professors were identified to determine the level of cooperative learning being implemented and to allow the professors to reflect on their experiences over a full semester. Pre-semester and post-semester surveys were completed by each of the undergraduate students. This study is based upon theories of social interdependence, cognitive development, and behavioral learning. The surveys were completed by the university students to determine their experiences in: 1) individual learning, and 2) learning with a partner(s). Interviews of the professors are included. Results of the surveys were analyzed. Results are reported. The authors also …

Review Of Living Blue In The Red States Edited By David Starkey, Greg Kosmicki Oct 2008

Review Of Living Blue In The Red States Edited By David Starkey, Greg Kosmicki

Great Plains Quarterly (through 2013)

I swear I once read in one of my mother's Reader's Digests: "This is a book that all true Americans should be forced to read." Maybe that's a false memory from my youth, but Living Blue in the Red States certainly is one of those books.

Living Blue in the Red States should have a "No Spin Zone" warning on the cover-it could be dangerous for politicians to read. The pollsters and punsters would have us believe we live in the bowels of a Blue state/Red state monster, each political splinter group desperately clinging to its little wedge issue …

Contradictory Subtexts In Willa Cather's O Pioneers! And Thomas Hardy's Far From The Madding Crowd, Grace Wetzel Oct 2008

Contradictory Subtexts In Willa Cather's O Pioneers! And Thomas Hardy's Far From The Madding Crowd, Grace Wetzel

Great Plains Quarterly (through 2013)

An independent and strong-minded woman gains control of a farm and determines to effect its fruition. Though many doubt her capacity, the female landowner trumps her male counterparts when the farm flourishes under her effective management. In the end, she marries- but on extremely unconventional terms. Rejecting romantic love, she instead weds a devoted friend. Camaraderie hence privileged over passion, the novel ends. This summary outlines the story of not one but two major literary heroines-Bathsheba Everdene of Thomas Hardy's Far from the Madding Crowd (1874) and Alexandra Bergson of Willa Cather's 0 Pioneers! (1913). Critics have analyzed these texts …

Personality And Social Psychology Connections Is In Development Stage, Donelson R. Forsyth Oct 2008

Personality And Social Psychology Connections Is In Development Stage, Donelson R. Forsyth

Jepson School of Leadership Studies articles, book chapters and other publications

When will technology, in all its varied forms both complicated and simple, begin to give back some of the minutes, hours, and days that it has stolen from us? Slogging through emails, developing online teaching materials for courses, readying a manuscript for online submission, searching for information on the web, formatting a survey so that it prints nicely, and navigating through digital libraries and journal article repositories wastes more time than a Dean’s introductory remarks at a meeting of the full faculty, the paperwork required by a detailed-oriented IRB, or an eighth-year students’ dissertation defense.

Seeking to counter the trend …

Brilliance, Contrast, Colorfulness, And The Perceived Volume Of Device Color Gamut, Rodney L. Heckaman Oct 2008

Brilliance, Contrast, Colorfulness, And The Perceived Volume Of Device Color Gamut, Rodney L. Heckaman

Theses

With the advent of digital video and cinema media technologies, much more is possible in achieving brighter and more vibrant colors, colors that transcend our experience. The challenge is in the realization of these possibilities in an industry rooted in 1950s technology where color gamut is represented with little or no insight into the way an observer perceives color as a complex mixture of the observer’s intentions, desires, and interests. By today’s standards, five perceptual attributes – brightness, lightness, colorfulness, chroma, and hue - are believed to be required for a complete specification. As a compelling case for such a …

Early Competitive Game Playing In Same- And Mixed-Gender Peer Groups, Nanci Weinberger, Kristen Stein Oct 2008

Early Competitive Game Playing In Same- And Mixed-Gender Peer Groups, Nanci Weinberger, Kristen Stein

Applied Psychology Department Faculty Journal Articles

Sixty-four kindergarten children participated in a bead-collecting game. Their competitive, noncompetitive, and other moves were measured. Gender and gender composition of the group affected competition in the context of playing this game with known peers. The boys were more competitive than the girls. Girls in the same-gender groups, but not mixed-gender groups, had low levels of competitive moves overall. Similar rates of strategic moves and game understanding suggest that the noted gender differences were not due to lack of game skill. However, the experience of playing the game can differ for boys and girls, and this difference may be …
