Curing Consumer Warranty Woes Through Regulated Arbitration, Amy J. Schmitz Oct 2008

Curing Consumer Warranty Woes Through Regulated Arbitration, Amy J. Schmitz

Faculty Publications

This article proposes legislative procedural reforms accounting for the realities of consumer arbitration that have threatened and denied consumers' access to remedies for companies' violations of public, or statutory, warranty remedies under the Magnuson-Moss Warranty Act (MMWA). Furthermore, the Article proposes to clarify and expand the MMWA's current dispute resolution template in order to resolve judicial disagreement regarding the template's application and foster beneficial use of finding arbitration. Accordingly, this is not a call to ban all pre-dispute arbitration clauses in consumer contracts, but is instead an invitation for more politically palatable reforms that preserve both companies' savings and consumers' …

Synergy, Meshworks, And The Nature Of Anthropology: A Teaching Perspective, Robert Shanafelt Oct 2008

Synergy, Meshworks, And The Nature Of Anthropology: A Teaching Perspective, Robert Shanafelt

Southern Anthropologist

Textbooks in general anthropology describe the subject as a holistic endeavor with distinct subfields. However, other than paying lip service to the concept of holism, most establish few fundamental links between the biological, social, and linguistic features of the discipline. In this paper I argue that four-field anthropology is best taught not as a set of layered blocks but as a meshwork of interacting layers of complexity. Moreover, the metaphor of meshworks in synergistic interaction changes not only how we imagine that anthropology’s parts are integrated, it suggests a different philosophical orientation to the study of the physical, communicative, and …

Pride, Sloth, And Lust: A Specific Look At Dante’S Use Of The Seven Cardinal Sins In Purgatorio, Rebekah J. Waltmann Oct 2008

Pride, Sloth, And Lust: A Specific Look At Dante’S Use Of The Seven Cardinal Sins In Purgatorio, Rebekah J. Waltmann

Senior Honors Theses

The Divina Commedia (1308-1321) has been hailed as one of the greatest and most influential literary works in history, and one of the characteristics that puts it in the annals of time is Dante’s mastery of Catholic theological ideals, especially the Seven Cardinal Sins, his artistry in portraying them, and his mix of unique and traditional depictions. Dante utilizes both traditional and unique artistic aspects of the Seven Cardinal Sins to provide both structure and to put moral messages in his greatest work, but in order to be aware of Dante’s deep understanding of the Sins and how he shapes …

Misunderstanding Freedom From Religion: Two Cents On Madison's Three Pence, Kyle Duncan Oct 2008

Misunderstanding Freedom From Religion: Two Cents On Madison's Three Pence, Kyle Duncan

Nevada Law Journal

Forty years ago in Flast v. Cohen, the Supreme Court created, for the Establishment Clause only, a dramatic exception to the bedrock principle barring general taxpayer standing. The Court’s new exception was based on one catchy phrase from a famous historical document—James Madison’s 1785 Memorial and Remonstrance Against Religious Assessments. The Court has been notoriously bad at Establishment Clause history, but Flast seemed to push the envelope. Yet neither the Court nor commentators have questioned Flast’s historical credentials over the last four decades. Recently, the Supreme Court took up the taxpayer standing question again in Hein v. Freedom From …

An Agent-Based Combat Simulation Framework In Support Of Effect-Based And Net-Centric Evaluation, Robert Joseph Bowen

Computational Modeling & Simulation Engineering Theses & Dissertations

The use of information technologies (IT) and information networks has proliferated in industry as a method to achieve competitive advantage. The U.S. Military and its allies, in recent years, have employed IT to improve the way they conduct operations, speed decision making, and increase the span of control of commanders. This has resulted in a fundamental shift in the way military commanders employ combat units today. These (Information Age) forces no longer have to be able to see each other or even communicate directly in order to synchronize maneuvers. Dispersion is now favored over mass, relying on the IT network …

Vincent De Paul And Jean-Jacques Olier: Unlikely Friends, Robert P. Maloney C.M. Oct 2008

Vincent De Paul And Jean-Jacques Olier: Unlikely Friends, Robert P. Maloney C.M.

Vincentian Studies

Robert Maloney traces the friendship of Vincent de Paul and Jean-Jacques Olier and summarizes some essential similarities and differences between them. Vincent was briefly Olier’s spiritual director and helped him persevere in his vocation. They highly regarded one another and collaborated. However, Olier was “one of the purest examples” of the French school of spirituality; Vincent was not of that school, although it influenced him. Both were Christocentric, but Vincent saw Christ in poor persons where Olier focused on the Holy Spirit. Both were concerned with following providence, but for Olier “providence” was interchangeable with “the Spirit” and it was …

Leveraging News And Advertising To Introduce New Brands On The Web, Anca C. Micu, Esther Thorson Oct 2008

Leveraging News And Advertising To Introduce New Brands On The Web, Anca C. Micu, Esther Thorson

WCBT Faculty Publications

Previous studies using the integrated marketing communications framework have examined the increased effectiveness of combining either multiple media or different tactics when promoting a brand. This study considers integrating advertising and publicity to promote an unknown brand on the Internet. Experiment results indicate that when exposure to advertising combines with exposure to objective news about a new brand, effectiveness increases in terms of both brand attitudes and behavioral intentions. For sequencing exposures for technical brands, the news-then-advertising condition offers more effectiveness than the reverse sequence. When introducing non-technical brands on the Web though, using advertising first is more effective in …

Investigating Sense Of Community And Academic Success In First Year College Students In The Department Of Natural Resources Management, Kenneth Michael Hackman Oct 2008

Investigating Sense Of Community And Academic Success In First Year College Students In The Department Of Natural Resources Management, Kenneth Michael Hackman

Master's Theses

This study explored the relationship between sense of community, factors that influence sense of community, and the effect of academic success of first year students in the Natural Resources Management Department at Cal Poly State University, San Luis Obispo. An adapted version of the sense of community index was used to collect data from first year students (n=90) in the Natural Resources Management Department. Linear regression was used to determine which variables had a significant influence on sense of community and academic success. The results of the study indicated that there was not evidence that grade point average (GPA) had …

Does Place Explain Racial Health Disparities? Quantifying The Contribution Of Residential Context To The Black/White Health Gap In The United States, Brian K. Finch, D. Phuong Do, Ricardo Basurto-Davila, Chloe E. Bird, José J. Escarce, Nicole Lurie Oct 2008

Does Place Explain Racial Health Disparities? Quantifying The Contribution Of Residential Context To The Black/White Health Gap In The United States, Brian K. Finch, D. Phuong Do, Ricardo Basurto-Davila, Chloe E. Bird, José J. Escarce, Nicole Lurie

Faculty Publications

The persistence of the black health disadvantage has been a puzzling component of health in the United States in spite of general declines in rates of morbidity and mortality over the past century. Studies that have focused on well-established individual-level determinants of health such as socio-economic status and health behaviors have been unable to fully explain these disparities. Recent research has begun to focus on other factors such as racism, discrimination, and segregation. Variation in neighborhood context - socio-demographic composition, social aspects, and built environment - has been postulated as an additional explanation for racial disparities, but few attempts have …

Executive Branch Lawyers In A Time Of Terror: The 2008 F.W. Wickwire Memorial Lecture, W. Bradley Wendel Oct 2008

Executive Branch Lawyers In A Time Of Terror: The 2008 F.W. Wickwire Memorial Lecture, W. Bradley Wendel

Cornell Law Faculty Publications

This article discusses the ethical responsibilities of the lawyers who advise executive branch officials on the lawfulness of actions taken in the name of national security. To even talk about this subject assumes that there is some distinction between a government that does all within its power to protect its citizens, and one that does all within its lawful power. If there are good normative reasons to care about maintaining this distinction, then we have the key to understanding the ethical responsibilities of government lawyers. The Bush administration took the position that the role of lawyers is to get out …

The Death Of Sigmund Freud: The Legacy Of His Last Days [Review], Michael Fischer Oct 2008

The Death Of Sigmund Freud: The Legacy Of His Last Days [Review], Michael Fischer

English Faculty Research

Sigmund Freud has been on Mark Edmundson’s mind at least since his 1990 book, Towards Reading Freud: Self-Creation in Milton, Wordsworth, Emerson, and Sigmund Freud. In that book, Edmundson uncovers a tension between two sides of Freud: the normative Freud committed to a rigid understanding of human behavior, and the romantic Freud whose restlessness with all given conventions inspired endless self-reinvention in his own writing. This side of Freud shows his kinship to Wordsworth, Emerson, and other writers and provides grounds of resistance to what is most stultifying in his own work. In Edmundson’s view, we need the imaginative …

The Changing Face Of Family Law: Global Consequences Of Embedding Physicians And Biotechnology In The Parent-Child Relationship, George J. Annas Oct 2008

The Changing Face Of Family Law: Global Consequences Of Embedding Physicians And Biotechnology In The Parent-Child Relationship, George J. Annas

Faculty Scholarship

Sexual reproduction, also known as making babies the old-fashioned way, has always brought with it significant challenges for family law, especially regarding protecting the best interests of children, and the identification of parents with the right and responsibility to rear them. But these challenges often seem mundane in the face of what has evolved since physicians have been injected into baby making and thus into novel parent-child relationships. The addition of physicians and their "new" medical technologies, sometimes called Assisted Reproductive Technology (ART), have forced the law to reconsider the very definition of motherhood and have radically altered society's view …

The Potential Importance Of Incorporating Online Dispute Resolution Into A Universal Mediation Model For International Child Abduction Cases, Elizabeth Cunha Oct 2008

The Potential Importance Of Incorporating Online Dispute Resolution Into A Universal Mediation Model For International Child Abduction Cases, Elizabeth Cunha

Connecticut Journal of International Law

Between October 30 and November 9, 2006, the Permanent Bureau of the Hague Conference met to initiate actions to create a universal alternative dispute resolution ("ADR"), primarily mediation, model to be used prior to initiating a Convention action.27 Currently, the mediation model employed in the United Kingdom and tested in a pilot study for international child abduction cases is being introduced internationally as the acceptable universal model. 8 This model employs common mediation practices to work towards more effectively accomplishing the goals of the Convention.29 However, the current model only discusses face-to-face mediation techniques.

While the ultimate goal of the …

Assessing Pedagogy In Bioengineering Classrooms: Quantifying Elements Of The “How People Learn” Model Using The Vanth Observation System (Vos), Monica F. Cox, David S. Cordray Oct 2008

Assessing Pedagogy In Bioengineering Classrooms: Quantifying Elements Of The “How People Learn” Model Using The Vanth Observation System (Vos), Monica F. Cox, David S. Cordray

School of Engineering Education Faculty Publications

One goal of the VaNTH Engineering Research Center is to estimate the effects of the “value added” to bioengineering student learning as a result of “How People Learn” (HPL) framework interventions. A necessary step in that process is to assess pedagogical differences in both lecture-based and HPL-oriented courses. Data from 28 bioengineering courses, over five semesters, were analyzed using a newly developed HPL Index. This index, developed from the Classroom Interaction Observation portion of the VaNTH Observation System, reports levels of HPL-inspired pedagogy, traditional pedagogy, and classroom organization within a class using codes for different types of faculty and student …
