Students’ Perceptions Of “Fun” Suggest Possibilities For Literacy Learning: “You Can Be Entertained And Informed", Brandi Gribble Mathers Oct 2008

Students’ Perceptions Of “Fun” Suggest Possibilities For Literacy Learning: “You Can Be Entertained And Informed", Brandi Gribble Mathers

Reading Horizons: A Journal of Literacy and Language Arts

Perhaps educators shy away from serious consideration of “fun” because the term is typically associated with the kinds of activities found on the playground rather than in the classroom. According to the first, third, and fifth-graders involved in this study however, different definitions of fun can be applied in different contexts and these definitions can be broad enough to include conditions specifically related to literacy activities. When these conditions are met, students do not regard reading and writing as work to be avoided, but rather, work to be embraced. Students revealed that fun motivates them to more willingly expend the …

Empathic And Nonempathic Interaction In Chronic Pain Couples, Annmarie Cano, Justin A. Barterian, Jaclyn B. Heller Oct 2008

Empathic And Nonempathic Interaction In Chronic Pain Couples, Annmarie Cano, Justin A. Barterian, Jaclyn B. Heller

Psychology Faculty Research Publications

Empathy and empathic response are receiving greater attention in pain research as investigators acknowledge that other forms of interaction may impact the pain process. The purpose of this study was to examine validation and invalidation as forms of empathic and nonempathic responses in chronic pain couples. Participants were 92 couples in which at least one spouse reported chronic musculoskeletal pain. Each couple participated in two videotaped interactions about the ways in which the pain has impacted their lives together. Trained raters then coded interactions for each partner’s use of validation and invalidation. Couples also completed surveys on spouse responses to …

Living With Alzheimer’S Disease: A Study Of Adult Day Health Services In Massachusetts, Nina M. Silverstein, Cathy M. Wong, Kristen E. Brueck Oct 2008

Living With Alzheimer’S Disease: A Study Of Adult Day Health Services In Massachusetts, Nina M. Silverstein, Cathy M. Wong, Kristen E. Brueck

Gerontology Institute Publications

The role of adult day health care (ADHC) is gaining increased attention as the nation prepares for the large cohort of baby boomers entering their later years. Many boomers are aging with physical and cognitive impairments, including Alzheimer's disease and related dementias. Projections indicate that Massachusetts, along with the nation as a whole, is experiencing an increasing rate of older persons as baby boomers enter late-life. The Commonwealth can expect that persons with Alzheimer's disease and their care partners will need community-based services that are specifically designed for adults with cognitive impairments. However, a report by the Robert Wood Johnson …

Masculinities And Feminist Legal Theory, Nancy E. Dowd Oct 2008

Masculinities And Feminist Legal Theory, Nancy E. Dowd

UF Law Faculty Publications

Men, patriarchy and masculine characteristics have predominantly been examined within feminist theory as a source of power, domination, inequality and subordination. Various theories of inequality have been developed by feminists to challenge and reveal structures and discourses that reinforce explicitly or implicitly the centrality of men and the identity of the top of a hierarchical power and economic structure as male.

The study of masculinities has been inspired by feminist theory to explore the construction of manhood and masculinity, and to question the real circumstances of men. It has explored how privilege is constructed, and what price is paid for …

The Gender Bend: Culture, Sex, And Sexuality—A Latcritical Human Rights Map Of Latina/O Border Crossings, Berta E. Hernández-Truyol

UF Law Faculty Publications

In the course of studying and theorizing about Latinas/os and their location in law and culture, critical theory has been simultaneously liberating and restraining, confining, and coercive. Critical theorists have made substantial inroads in recognizing the intersectionality, multidimensionality, multiplicity, and interconnectivities of the intersections of race and sex. These paradigms are central to an analysis of the Latina/o condition within the Estados Unidos (United States). However, much work remains to be done in other areas - such as culture, language, sexuality, and class - that are key to Latinas'/os' self-determination and full citizenship.

Cognizant of, and notwithstanding such limitations, this …

Race, Identity, And Professional Responsibility: Why Legal Services Organizations Need African American Staff Attorneys, Shani M. King Oct 2008

Race, Identity, And Professional Responsibility: Why Legal Services Organizations Need African American Staff Attorneys, Shani M. King

UF Law Faculty Publications

Given the fundamental importance of the attorney-client relationship in securing favorable outcomes for clients, legal services organizations that serve large populations of African Americans should employ African American staff attorneys because: (1) African American lawyers and clients share a group identity that makes it more likely that a black attorney will be able to gain a black client's trust; (2) black attorneys communicate more effectively with black clients; and (3) the perception of a judicial system that is unfair and racist is likely to encourage black clients to trust black lawyers more than white lawyers, who are more likely to …

Designing Transparency: The 9/11 Commission And Institutional Form, Mark Fenster Oct 2008

Designing Transparency: The 9/11 Commission And Institutional Form, Mark Fenster

UF Law Faculty Publications

Surpassing the low expectations established by previous investigatory commissions and overcoming the political and legal obstacles created by the Bush administration's opposition to its creation, the 9/11 Commission accomplished what appeared to be the impossible: an authoritative investigation, a widely-read final report, and direct influence on significant legislation. This Article argues that the 9/11 Commission represents an important institutional model for encouraging or forcing the Executive Branch to disclose information about an especially significant and controversial past event or future decision. It suggests that Congress or the President consider establishing such commissions when information held by the Executive Branch can …

". . . See Erie.": Critical Study Of Legal Authority, Kris Franklin Oct 2008

". . . See Erie.": Critical Study Of Legal Authority, Kris Franklin

University of Arkansas at Little Rock Law Review

Good citation requires critical analysis because well-supposed legal analysis requires a layered understanding of how legal authority may be used in different ways. Simultaneously, it demands good judgment in making the best decisions about how to introduce and employ the relevant cases on a particular case. Teaching how to cite legal authorities includes framing because all legal authorities are potential tools for argument. In deciding whether and how to deploy cases, statutes, and other forms of legal authority, advocates must resolve two interrelated questions in rapid sequence:

1. Can I frame or characterize the authority in question in a particular …

Social Reality And Philosophical Ideals In Transitional Justice, Jamie Rowen Oct 2008

Social Reality And Philosophical Ideals In Transitional Justice, Jamie Rowen

Cardozo Public Law, Policy & Ethics Journal

The article argues that transitional justice mechanisms in post-conflict societies, such as Bosnia, often fail to establish legitimate authority because they neglect the crucial role of community building. It emphasizes that community is a prerequisite for legal authority and highlights the dialectical relationship between law and community, where each can shape the other. The case of Bosnia illustrates how the International Criminal Tribunal for the former Yugoslavia (ICTY) and the War Crimes Chamber (WCC) in Sarajevo have struggled to gain legitimacy due to their focus on procedural values over community engagement. The article advocates for a reoriented approach to transitional …

Kim Emigh, Worldcom Whistleblower - A Case Study In Accounting Ethics At Worldcom, David Christensen Oct 2008

Kim Emigh, Worldcom Whistleblower - A Case Study In Accounting Ethics At Worldcom, David Christensen

Mountain Plains Journal of Business and Technology

"About two weeks before internal auditors at WorldCom began questioning capital expense adjustments, the Fort Worth Weekly (cite below) published the story of Kim Emigh, who was fired for questioning inappropriate accounting practices at WorldCom. The article first caught the attention of Mark Abide, the director of property accounting at WorldCom. On May 21, Mr. Abide forwarded the article to Glyn Smith on the internal audit staff, with a note saying that the allegations of the accounting misdeeds by Emigh were ‘worth looking into’ (Krim 2002). The internal auditing team, headed by Cynthia Cooper, met on May 29 to discuss …

Development And Validation Of Two Versions Of The Student Prior Attitude Scale (Spa), James E. Weber, Gary Yoshimoto, James A. Smith, Howard W. Bohnen Oct 2008

Development And Validation Of Two Versions Of The Student Prior Attitude Scale (Spa), James E. Weber, Gary Yoshimoto, James A. Smith, Howard W. Bohnen

Mountain Plains Journal of Business and Technology

It is not uncommon for students to have preconceptions of a class before it begins. These preconceptions may come from information about a class, often through word of mouth, or knowledge that the class requires skills inconsistent with the student’s skill set. These preconceptions of a class may have a positive or negative effect on how a student initially feels about the class, and may, in fact, have an effect on end-of-term student evaluations. Since student evaluations are often used for personnel decisions, it is vital that these evaluations be reliable and valid. This study reports on the development and …

Do Popular People Perform?, Jonathan R. Anderson Oct 2008

Do Popular People Perform?, Jonathan R. Anderson

Mountain Plains Journal of Business and Technology

Are popular people good performers? This is the driving question behind this study of workplace behavior and performance. The literature suggests that popular people, those who hold central positions in a social network, will also have high levels of individual work performance in a customer service setting (Hogans, 1971; Hurley, 1998; Stevens & Macintosh, 2002). However, after analyzing social network data from 128 employees in a call center, the data show that popular people, those holding a central role in the friendship network, are likely to underperform their colleagues in technical work and sales performance. Implications for employee selection and …

Justifying Motive Analysis In Judicial Review, Gordon G. Young Oct 2008

Justifying Motive Analysis In Judicial Review, Gordon G. Young

William & Mary Bill of Rights Journal

Motives concern us in ordinary life and in the law of torts and crimes, and that concern is justified by consequentialist ethics. Despite occasional judicial protestations, motive analysis pervades large parts of constitutional law. Illegitimate motives aimed at suspect classes, or "designed to strike" at any number of rights identified as fundamental, presumptively invalidate the official actions that they animate. The consequentialist arguments for the use of motive review in this class of cases are relatively simple. Such illegitimate official motives tend to cause bad distributions of tangible benefits and burdens, or cause direct cognitive or emotional harm to the …

The Parent Trap: Differential Familial Power In Same-Sex Families, Deirdre M. Bowen Oct 2008

The Parent Trap: Differential Familial Power In Same-Sex Families, Deirdre M. Bowen

William & Mary Journal of Race, Gender, and Social Justice

Do intact same-sex couples where one member of the couple became pregnant with assisted reproduction or was the primary adopter, and the other member became a parent through second parent adoption, understand the legal protections afforded them? In short the answer is no. An interesting family dynamic arises around those who can claim the true status as parent based on their legal understandings of parenthood and their interactions with the dominant culture. While high profile custody cases on this issue have been decided in the United States with varying results, no research has examined the impact of uneven legal protections …

Creeping By Moonlight: A Look At Civil Commitment Laws For Sexually Violent Predators Through The Lens Of The Yellow Wallpaper, Heather R. Willis Oct 2008

Creeping By Moonlight: A Look At Civil Commitment Laws For Sexually Violent Predators Through The Lens Of The Yellow Wallpaper, Heather R. Willis

William & Mary Journal of Race, Gender, and Social Justice

This note examines the constitutional and social implications of the civil commitment of sexually violent predators in the United States. These commitments are implemented on sexual offenders deemed too dangerous to be placed back into society after serving prison sentences and have been gaining popularity across the United States. Currently, these commitments are considered constitutional in limited circumstances by the Supreme Court, but while these commitments are meant for only the most dangerous and least controllable individuals, the public reaction to sexual offenses increases the possibility these commitments will be misused. As a part of examining this commitment process, this …
