Acknowledging Guilt: Forcing Self-Identification In Post-Conviction Dna Testing, Tonja Jacobi, Gwendolyn Carroll
Acknowledging Guilt: Forcing Self-Identification In Post-Conviction Dna Testing, Tonja Jacobi, Gwendolyn Carroll
Faculty Articles
This Essay formally illustrates how it is possible to force prisoners to self-identify as innocent or guilty by deciding whether to seek postconviction DNA testing. Additionally, it shows why other systems that aim to reduce the number of guilty petitioners seeking post-conviction DNA testing create perverse incentives, and why only additional incarceration can effectively encourage innocent and guilty prisoners alike to self-identify. This will reduce costs on the judicial system by discouraging guilty prisoners from seeking post-conviction DNA tests. It will also make it faster and easier for actually innocent prisoners to seek the tests they need for timely exoneration. …
Book Review: Teaching As Community Property By Lee Shulman (Jossey-Bass, 2004), Lynne Mcvey
Book Review: Teaching As Community Property By Lee Shulman (Jossey-Bass, 2004), Lynne Mcvey
International Journal for the Scholarship of Teaching & Learning
Excerpt: Teaching as Community Property is a collection of Lee Shulman’s speeches, papers and presentations from 1987-2004. It is an inspiring and practical volume of Shulman’s profound and influential contributions to the field of teaching and learning in higher education. For readers’ individual interests, it is conveniently divided into three sections; Learning, The Profession of Teaching, and Practices and Policies. In his introduction, Russell Edgerton suggests that readers view this collection from three perspectives: pedagogy, prescription and philosophy. A useful aspect of this book is that each chapter can be read individually for the purpose of finding a solution …

Condemning Our Youth To Lives As Criminals:Incarcerating Children As Adults, Chelsea Dunn
Condemning Our Youth To Lives As Criminals:Incarcerating Children As Adults, Chelsea Dunn
Richmond Public Interest Law Review
Underlying the juvenile court system are two competing philosophies of justice which have taken predominance over the system at different historical periods in relation to the public climate. Early reformers conceptualized juvenile justice as an informal and protective system that would seek to rehabilitate disadvantaged children who had succumbed to criminal influences. In response to negative assessments noting the leniency of juvenile courts, critics began to advocate for a more punitive system which would focus on retribution rather than treatment. Measures adopted by courts to increase the criminal responsibility placed upon juveniles include minimum sentencing guidelines and transfer of offenders …
Really Leaving No Child Behind: How The Supreme Court's Student Speech Doctrine Compromises Modern Education Reform - And How It Can Use The In Loco Parentis Doctrine To Change It, Scott J. Street
Richmond Public Interest Law Review
tudent speech" doctrine defined by Tinker in favor of an in loco parentis standard that defers to the expertise of school officials in maintaining a safe, effective, and orderly school environment. Contrary to what its critics assume, an in loco parentis standard would not give school officials carte blanche to violate their students' rights. It would, for example, prohibit school officials from discriminating against students on the basis of viewpoint. But as long as Tinker's student speech doctrine survives, efforts to improve our schools and prepare our children for the rigors of the twenty-first century will suffer. The in loco …
The Price Of Privilege: Is Virginia's Ban On Mental Health Professionals' Participation In Custody Determinations Really In The Best Interests Of The Child, Mary Wilkins Hunt
The Price Of Privilege: Is Virginia's Ban On Mental Health Professionals' Participation In Custody Determinations Really In The Best Interests Of The Child, Mary Wilkins Hunt
Richmond Public Interest Law Review
This article examines the national treatment of mental health care professionals' participation in custody determinations and compares these practices with Virginia's ban. Furthermore, this article explores the rationale behind the ban on therapist testimony while weighing the pros and cons of allowing such evidence to be used. It then takes a closer look at the arguments for repealing the ban and the possible benefits which could result from the 2008 repeal.

Likelihood Of Using Drug Courts: Predictions Using Procedural Justice And The Theory Of Planned Behavior, Evelyn M. Maeder, Richard L. Weiner
Likelihood Of Using Drug Courts: Predictions Using Procedural Justice And The Theory Of Planned Behavior, Evelyn M. Maeder, Richard L. Weiner
Department of Psychology: Faculty Publications
The current research compares two theoretical models borrowed from social psychology (theory of planned behavior and procedural justice) to predict intentions to make use of a drug court. Medicaid-eligible substance users answered a number of questions regarding their intentions to use a drug court in the future, including items from planned behavior and procedural justice scales. When procedural justice was considered alone, only trustworthiness predicted intention to use drug courts. When planned behavior was considered alone, only deliberative attitudes predicted the intention. After combining the two models, deliberative attitudes from the theory of planned behavior were the only significant predictor …
Mechanisms For Restricting Recovery For Emotional Distress In Contract, John D. Mccamus
Mechanisms For Restricting Recovery For Emotional Distress In Contract, John D. Mccamus
Articles & Book Chapters
While the expectancy principle is widely embraced across common law jurisdictions as a foundational doctrine of remedies law, damages for mental distress related to breach of contract have either been rejected outright or limited to variously constructed exceptions in most jurisdictions. This Article focuses on the policies underlying the rules and exceptions applied to contractually related mental distress claims in England, Australia, Canada and the United States. In reviewing the approaches across these jurisdictions, there does not appear to be a convincing policy rationale behind limiting the expectancy principle for emotional distress claims. Indeed, this Article argues that the existing …
Bupropion Differentially Impacts Acquisition Of Methamphetamine Self-Administration And Sucrose-Maintained Behavior, Carmela M. Reichel, Jessica D. Linkugel, Rick A. Bevins
Bupropion Differentially Impacts Acquisition Of Methamphetamine Self-Administration And Sucrose-Maintained Behavior, Carmela M. Reichel, Jessica D. Linkugel, Rick A. Bevins
Department of Psychology: Faculty Publications
Bupropion reduces the subjective effects and cue-induced craving for methamphetamine in humans. Given these effects of bupropion on methamphetamine in humans and its widespread clinical use, a preclinical model of drug-taking was used to determine if pretreatment with bupropion would alter the acquisition of methamphetamine self-administration. During acquisition, rats were given saline or bupropion (30 or 60 mg/kg, IP) 5 min before a 60-min session. For the first 8 days, each response on the active lever produced an infusion of methamphetamine (0.025 mg/kg). Responding on the inactive lever had no programmed consequence. This FR1 schedule was then increased to an …

The Pattern Of Subjective Anxiety During In-Session Exposures Across Therapy For Clients With Social Anxiety Disorder, Sarah A. Hayes, Debra A. Hope, Richard G. Heimberg
Department of Psychology: Faculty Publications
Exposure-based therapies have been considered the most efficacious treatments for social anxiety disorder (i.e., Gould et al., 1997). The majority of the theory behind exposure-based treatments rely on Foa and colleagues’s (Foa, Huppert, & Cahill, 2005; Foa & Kozak, 1986) emotional processing theory. However, there has been less research examining the way that emotional processing occurs across actual treatment sessions for clients with social anxiety disorder. This study utilized longitudinal data analytic methods to examine the changes in subjective anxiety during the first three exposure sessions in group and individual cognitive-behavioral therapy for social anxiety disorder. The results of this …

Assessing Client Progress Session By Session In The Treatment Of Social Anxiety Disorder: The Social Anxiety Session Change Index, Sarah A. Hayes, Nathan A. Miller, Debra A. Hope, Richard G. Heimberg, Harlan R. Juster
Department of Psychology: Faculty Publications
Frequent assessment during therapy can improve treatments and provide accountability. However, clinicians often do not monitor progress because of the time it takes to administer and score assessments. In response, the Social Anxiety Session Change Index (SASCI) was developed. The SASCI is a short, easily administered rating of subjective improvement that asks clients with social anxiety disorder how much they have changed since the beginning of therapy. Change on the SASCI was related to change in fear of negative evaluation, a core aspect of social anxiety, and to clinician-rated improvement, but not to ratings of anxiety sensitivity or depression. Because …

Articles & Book Chapters
This essay comments on the work of artist Rudolf Bikkers (1943-2023) exhibited in a show called Morphogenetic Fields at Craig Scott Gallery in 2008. On exhibition were 17 mixed-media works (colour lithographs pulled from limestone followed by acrylic painting, on fine archival paper). The entire exhibition catalogue is reproduced, with the permission of the Bikkers’ estate, as the necessary visual context for the essay. Born in Hilversum, the Netherlands, Bikkers’ arts education involved both the visual arts and music. He received his MFA from the Jan van Eyck Academie in Maastricht; that period of art study (1960-1966) overlapped with ten …

Technical Library
This thesis presents research and proposes a framework for increasing the breadth and depth of interdisciplinary knowledge in the field of computer science. The intent is to address an increasing problem of complexity in software and computing systems. The approach is to equip software developers and computer scientists with a contextual perspective and a set of strategies for injecting innovation and creativity into the solutions they design by leveraging knowledge and models outside the traditional realm of computer science. A review of current and historical forms of interdisciplinarity and biomimicry are presented to build that context. The strategies presented include …

Entrepreneurial Orientation Among The Youth Of India: The Impact Of Culture, Education And Environment, Nancy M. Levenburg, Thomas V. Schwarz
Peer Reviewed Articles
Expanding the level of entrepreneurial activity within all nations is an increasingly important political and economic goal, especially for developing countries. Literature suggests that culture, education and environment play key roles, yet these attributes vary greatly across nations. This study explores the level of interest in entrepreneurship among what may be India’s next generation of entrepreneurs, namely undergraduate business students, and draws comparisons with students enrolled in the US. Despite a combination of social structures and cultural values within India that historically constrained entrepreneurship, a number of efforts in recent years seem to have significantly shifted the national mindset regarding …

Moral Awareness And Therapist Use Of Self, Rick Reinkraut
Journal of Pedagogy, Pluralism, and Practice
The concept therapist use of self is examined. Reasons for incorporating the moral awareness of the counselor into this concept are presented and a case example is discussed. The salience of this issue in the context of a post-positivist social science is addressed and contextualized within a multicultural frame. A critique of the notion of therapeutic moral neutrality is presented. The discussion concludes with a proposed framing of the concept of therapist use of self.

Paulo Freire’S Pedagogy For The Children Of The Oppressors: Educating For Social Justice Among The World’S Privileged, Chris Van Gorder
Journal of Pedagogy, Pluralism, and Practice
University-level scholars in North American and European often claim that they are committed to helping their students become active in social justice concerns. Paulo Freire’s book, The Pedagogy of the Oppressed, claims however that most educational models among the world’s privileged and elite share some complicity in the maintenance of an unjust status-quo of oppression. This article will focus on how Freirean ideas can be applied to students of privilege in order to move them from ignorance, guilty remorse, or paternalistic activism vis-à-vis the world’s oppressed towards a respectful, dialogical inter-relationship.

West Michigan Supply Management: A Year In Review, Brian G. Long
Seidman Business Review
Despite the weakened condition of Michigan’s economy, the west side of our state was able to hold its own throughout most of 2007. Although the West Michigan economy was far less robust than it was in the late 1990s, the economic performance for most of the year was positive.

Meth In Allegan County -- Spreading To West Michigan?, Jitendra M. Mishra
Seidman Business Review
According to the Office of National Drug Policy, White House, about 1.3 million people used meth in the year 2002. Moreover, in 2001, 607,000 people used methamphetamine. The University of Arkansas reports that businesses in Benton County were losing an estimated $21 million annually because of meth, mainly due to absenteeism and lost productivity. Methamphetamine is a profoundly addictive drug that seriously affects health, families, businesses, social services, and the environment. Why is meth use on the increase?

Perceptions Of Technology Use In Rural And Urban Pennsylvania High Schools, Brenda M. Freeman
Dissertations
Purpose
Policy makers are implementing standards and developing guidelines for integrating technology into K-12 schools. With this in mind, the integration of technology into curriculum is an ever-growing point of discussion among high-school education professionals. Technology uses in teaching and learning present significant issues in educational reform literature. Rather than trying to describe the impact of all technologies as if they were the same, this study focuses on the differences in the ways technologies are being used in the classroom as well as the role technology played in instruction. There is also a need to investigate whether or not student …

This Article examines theories of fact finding and rules of evidence, as well as critiques of scientific citations in equal protection litigation, drawing on opinions starting with Brown v. Board of Education and its well-known citation of psychological and sociological studies documenting the harms of segregation-what the Brown Court labeled "modem authority." Second, this Article examines a range of equal protection cases and discusses how constitutional frameworks have shaped both core constitutional values and the gathering of relevant constitutional facts. Third, this Article examines in more detail the Parents Involved cases, as well as the underlying science and the citation …
The Many Meanings Of "Politics" In Judicial Decision Making, Bradley W. Joondeph
The Many Meanings Of "Politics" In Judicial Decision Making, Bradley W. Joondeph
Faculty Publications
This essay seeks to untangle the many possible meanings of "politics" in descriptions of judicial behavior. Part I sets out ten possible conceptions of the term, briefly discussing some examples and their empirical foundations. My goal is mostly descriptive (rather than normative), though it is apparent that some conceptions are more useful than others. In all events, claims about the political influences on judicial behavior must be specific about the phenomena they seek to describe. For given the many possible meanings of politics, accounts that lack such specificity are largely vacuous.
Part II builds on this discussion to make two …

The Trauma Of Stalinism Narrated In Varlam T. Shalamov's Kolymskie Rasskazy : Missiological Implications For Contemporary Russia, Yuri N. Drumi
Dissertations
Stalinism and the punitive system of the Gulag left an indelible stamp on the entire social matrix of Russia. Because of the multidimensional and multigenerational nature of the trauma of Stalinism, Russian society retains the label of a traumatized culture. This dissertation explores the significance of this phenomenon for contemporary Christian mission in Russia.
The narratives of Varlam T. Shalamov's Kolymskie rasskazy provided an empirical (based on sensory evidence) inquiry into the reality of enormous sufferings experienced by the inmates of the Kolyma Gulag. Holy Scripture, on the other hand, provided the theological (faith-based) inquiry into the causes and implications …

Hedonic Adaptation And The Settlement Of Civil Lawsuits, John Bronsteen, Christopher J, Buccafusco, Jonathan S. Masur
Faculty Scholarship
This Essay examines the burgeoning psychological literature on happiness and hedonic adaptation (a person's capacity to preserve or recapture her level of happiness by adjusting to changed circumstances), bringing this literature to bear on the probability of pretrial settlement in civil litigation. The existing economic and behavioral models of settlement are incomplete because they do not incorporate the effect of adaptation on the sum for which a plaintiff is willing to accept an offer. When an individual first suffers a serious injury, she will likely predict that the injury will greatly diminish her future happiness. However, during the time that …

Beyond Cost-Benefit Analysis: A Pragmatic Reorientation, Sidney A. Shapiro, Christopher H. Schroeder

The weaknesses of cost-benefit analysis (CBA) are apparent for all to see. The theoretical underpinnings of positivism and rational choice methodologies have been dealt a significant blow in the post-positivist literature in science, political science and policy studies. Likewise, the performance of CBA itself has been the subject of a significant and persuasive challenge in the legal literature. This article critiques specifically the current federal form of regulatory impact analysis (RIA), centered institutionally in OIRA and centered methodologically in CBA. One of reasons for the continuing dominance of a CBA-centered RIA is the success of its proponents in maintaining that …
