The Heart Has Its Reasons: Examining The Strange Persistence Of The American Death Penalty, Susan A. Bandes Jan 2008

The Heart Has Its Reasons: Examining The Strange Persistence Of The American Death Penalty, Susan A. Bandes

Public Law and Legal Theory Working Papers

The debate about the future of the death penalty often focuses on whether its supporters are animated by instrumental or expressive values, and if the latter, what values the penalty does in fact express, where those values originated, and how deeply entrenched they are. In this article I argue that a more explicit recognition of the emotional sources of support for and opposition to the death penalty will have salutary consequences for the clarity of the debate. The focus on emotional variables reveals that the demarcation between instrumental and expressive values is porous; both types of values are informed (or …

A Comprehensive Case Report On University Of Montana Forensic Case 66, Christopher John Buckley Jan 2008

A Comprehensive Case Report On University Of Montana Forensic Case 66, Christopher John Buckley

Graduate Student Theses, Dissertations, & Professional Papers

UMFC 66 is an anatomical specimen from the Physical Anthropology Lab at The University of Montana-Missoula. It is a nearly complete skeleton that exhibits no trauma. I examined the literature on suitable approaches to estimating age from the skeleton, because age is difficult to estimate for this case and presents an interesting challenge. I also estimated sex, ancestry, stature, and weight. I concluded that UMFC 66 is an American Indian, perhaps 20 to 28 years of age with a relatively short stature of about 1.56m (5’01”), weighing approximately 115 to 129 pounds. There is severe osteomyelitis throughout the left lower …

Development Of The Secondary Conditions Among Adolescents With Disabilities (Scaad) Instrument: An Exploratory Study, Marie Middleton Jan 2008

Development Of The Secondary Conditions Among Adolescents With Disabilities (Scaad) Instrument: An Exploratory Study, Marie Middleton

Graduate Student Theses, Dissertations, & Professional Papers

The purpose of this study was to develop a measure of secondary conditions, explore the reliability and validity of the measure, and explore the relationship between secondary conditions and participation among adolescents with disabilities. This research collected ratings of limitation due to secondary conditions, and ratings of participation for 24 adolescents with Intellectual/Developmental Disability. Data show that the participants experience an average of 11 secondary conditions during a three-month period as reported by families. The inter-rater agreement between parents and Family Support Specialists was .73 on a point-by-point comparison, and .85 when comparing whether or not limitation was a concern. …

An Outcomes Assessment Of Two Therapeutic Group Homes Serving Children With Reactive Attachment Disorder In A Rural Community, Brooke Rose Spangler Jan 2008

An Outcomes Assessment Of Two Therapeutic Group Homes Serving Children With Reactive Attachment Disorder In A Rural Community, Brooke Rose Spangler

Graduate Student Theses, Dissertations, & Professional Papers

Archival data collected on 35 4-12-year-old children, each of whom completed treatment for reactive attachment disorder (RAD), was used to evaluate a treatment program in a rural northwestern community. The Child Behavior Checklist (CBCL) (Achenbach, 1991) and Youth Outcomes Questionnaire (Y-OQ) (Burlingame, Wells, & Lambert, 1996) were completed by coding behaviors early in treatment and late in treatment from behavioral records. A correlational design was used, and t-test, repeated measures and fixed factor analyses of variance were conducted. Results showed that there was an overall decrease in the amount of maladaptive behaviors at the conclusion of residential treatment for attachment …

Adolescent Mothers: The Space Between What They Know And What They Do, Nicole Catherine Mccray Jan 2008

Adolescent Mothers: The Space Between What They Know And What They Do, Nicole Catherine Mccray

Graduate Student Theses, Dissertations, & Professional Papers

Although the current rate of teen pregnancy in the United States is at a historic low (Martin et al., 2007), there are a number of risk factors associated with early parenthood. Adolescent parenthood is often embedded in a larger context of risk such as poverty, single parenthood, low educational attainment, a history of physical and emotional abuse, and engagement in risky behavior (Hans & Wakschlag, 2000). As parents, adolescent mothers tend to be less knowledgeable about child development, less stimulating in interactions with infants, less tolerant, and more punitive with punishment (Brooks-Gunn & Furstenberg, 1986). The children of adolescent mothers …

Fostering Resilient Characteristics In Individuals With Learning Disabilities, V. Shelly Dugle, Peggy Grigorenko Jan 2008

Fostering Resilient Characteristics In Individuals With Learning Disabilities, V. Shelly Dugle, Peggy Grigorenko

International Christian Community of Teacher Educators Journal

Educational resilience is an important term for teacher candidates in Christian institutions to understand. Resilience can be nurtured and instilled in the lives of individuals with learning disabilities, and teacher candidates can play a vital role in that process. To assist in this course of action, a look at the definition and common characteristics of resilience are discussed. In addition, a closer look at four resilient individuals with learning disabilities is provided. Concrete suggestions on ways to incorporate resilient characteristics into students with learning disabilities are shared.

Neuroscience And Education: The Importance Of A Christian Understanding Of Human Persons, Laura A. Barwegen Ed.D. Jan 2008

Neuroscience And Education: The Importance Of A Christian Understanding Of Human Persons, Laura A. Barwegen Ed.D.

International Christian Community of Teacher Educators Journal

The increased research in the neurosciences has affected the discipline of education in numerous ways, with publications translating this research into classroom practices. A caution is given to Christian educators to carefully reflect upon how this research influences our view of human persons and what difference this view makes in the teaching and learning process. The purpose of this paper is (1) to examine some of the ways that neuroscience is speaking into the discipline of education, particularly in understanding the capabilities and processes of the learner; (2) to develop an awareness of how this affects our understanding of persons; …

Best They Forget: Challenging Notions Of Remembering And Forgetting, Chris Baird Jan 2008

Best They Forget: Challenging Notions Of Remembering And Forgetting, Chris Baird

International Christian Community of Teacher Educators Journal

In Jeremiah 31:34 the LORD declares, “No longer will a man teach his neighbour, or a man his brother, saying, ‘Know the LORD,’ because they will all know me, from the least of them to the greatest… For I will forgive their wickedness and will remember their sins no more” (The NIV Study Bible, 1995, p.1170). It is not the intention of this paper to enter into a theological discussion as to whether or not God is capable of forgetting; however, at very least He chooses the metaphor of forgetting to display his forgiveness for his people. This seems to …

Adolescent Risk-Taking And Social Meaning: A Commentary, Cass R. Sunstein Jan 2008

Adolescent Risk-Taking And Social Meaning: A Commentary, Cass R. Sunstein

Public Law and Legal Theory Working Papers

Why do adolescents take risks? What is the appropriate response to adolescent risk-taking? This Commentary for a special issue of Developmental Review, discussing a set of papers in that issue, explores these questions with attention to changes in the adolescent brain, to dual-processing theory, to social influences, and to fuzzy-trace theory. It contends that adolescent risk-taking is often driven by the social meaning of risk and caution, and that social meaning operates as a tax on or a subsidy to behavior. Changes in social meaning present a serious collective action problem, but also a valuable opportunity for both law and …

Integrated, Embedded, And Case-Based: Selling Library Instruction To The Business School, Leticia Camacho, Andy Spackman

Faculty Publications

Brigham Young University (BYU), located in Provo, Utah, is home to the Marriott School of Management, which has an enrollment of 1,900 undergraduate and 1,100 graduate students. Nearly 75 percent are bilingual, 20 percent speak a third language, and approximately 10 percent are foreign citizens.

In the year 2000, the Tanner Management Library was displaced from the Marriott School and incorporated into the Harold B. Lee Library, BYU’s main campus library. Without a physical presence in the business school, BYU’s business librarians have struggled to remain relevant to a faculty and student body that is increasingly dependent on the Internet …

Influence Of Public Access On Raccoon Predation On Sea Turtle Nests In Boca Raton, Florida, Andrea. Vandam Jan 2008

Influence Of Public Access On Raccoon Predation On Sea Turtle Nests In Boca Raton, Florida, Andrea. Vandam

Harriet L Wilkes Honors College Theses 2003 - 2009

In the Eastern United States, the Florida coastline provides 85% of all nesting sites for the green (Chelonia mydas), leatherback (Dermochelys coriacea), and loggerhead (Caretta caretta) sea turtles. Palm Beach County beaches experience some of the highest nesting frequencies, but recreational use of the beaches has increased threats like raccoon predation. The Gumbo Limbo Nature Center (GLNC) in Boca Raton (founded in 1984) keeps records of nests and predators to the nests. I analyzed 4554 GLNC nest records from 2002-2007 to examine whether raccoon predation of turtle nests was most prevalent in areas of high human impact. I found that …

Depths Of An English Heart", Joel. Simundich Jan 2008

Depths Of An English Heart", Joel. Simundich

Harriet L Wilkes Honors College Theses 2003 - 2009

In Ford Madox Ford's 1915 novel The Good Soldier, John Dowell comments "I had never sounded the depths of an English heart," as he painstakingly reconstructs his "extreme intimacy" with his late wife and their two closest friends. Throughout his narrative, Dowell approaches the limits of language, struggling to connect with lost companions by bringing language into scenes of miscommunication and silence. By translating emotional impasses and wordless exchanges from memory into narrative, Dowell seems to make these wordless interactions wordful. Ludwig Wittgenstein's investigation into "private language" helps elucidate Dowell's realization that he cannot fill wordlessness with words to reconstruct …

Postscripts To Paradise, Kathleen. Schindler Jan 2008

Postscripts To Paradise, Kathleen. Schindler

Harriet L Wilkes Honors College Theses 2003 - 2009

Since her creation in 1941, cultural critics have cited Wonder Woman as an emblem of femininity. In 1972, the American mainstream feminist movement--through Ms. magazine--officially accepted the character as a representation of feminism. When writers at Ms. criticized changes in the character, in which she abandoned her costume and superpowers, they neglected to consider Wonder Woman's history as American World War II propaganda. In doing so, they allowed the re-vamped 1973 version of the character, and her subsequent incarnations, to ignore the duality of her existence as both a feminist icon and a reinforcement of dominant American ideologies.

Fistful Of Facts, Peter. Salomone Jan 2008

Fistful Of Facts, Peter. Salomone

Harriet L Wilkes Honors College Theses 2003 - 2009

In 1919, the Soviet filmmaker Dziga Vertov declared a "death sentence" on fictional films. Vertov championed his own unique method of non-fiction filmmaking, called Kino-Eye, which is based on Vertov's ideas regarding truth in cinema. Although he does not write specifically about Vertov or film, the philosopher Nelson Goodman offers a contrasting view of truth in general. By comparing the Kino-Eye method to Goodman's philosophy, we can better understand Vertov's radical ideas and see more clearly how the concept of cinematic truth has changed over time.

How Green Is The Mouse?, Cara. Piccirillo Jan 2008

How Green Is The Mouse?, Cara. Piccirillo

Harriet L Wilkes Honors College Theses 2003 - 2009

My project "How Green is the Mouse?" analyses the ways in which the Disney Company utilizes various green marketing strategies in an effort to appeal to the growing number of eco-conscious consumers. My study examines different strategies of green marketing and evaluates the use of these strategies in relation to discussions of the "greenwash" concept. Examples of such strategies include green selling, when a company continues to manufacture a pre-existing product with changes only in marketing and not policy or output, and green partnerships, when a company undertakes a more eco-friendly appearance simply by collaborating with a well-known environmental organization. …

Search For Self In The Postmodern Novel, Jaime Frances. Neudecker Jan 2008

Search For Self In The Postmodern Novel, Jaime Frances. Neudecker

Harriet L Wilkes Honors College Theses 2003 - 2009

In my thesis I look at three novels by Don DeLillo: Americana, Mao II, and Falling Man. These three novels, published in 1971, 1991, and 2007 respectively, represent the full range of DeLillo's body of work, and demonstrate a clear progression of the major themes in his writings. Each of these novels presents a protagonist who is on a journey of self-discovery, effectively seeking what many critics have identified as an outdated form of self--a Modernist notion of self. The problematic nature of identity in these novels is exacerbated by changes in representation and warfare, particularly the perceived loss of …

Role Of Church-State Conflict In The Growth Of Religious Pluralism In Latin America, Michael. Mcmillan Jan 2008

Role Of Church-State Conflict In The Growth Of Religious Pluralism In Latin America, Michael. Mcmillan

Harriet L Wilkes Honors College Theses 2003 - 2009

Since the 1960s Latin America has experienced a religious transformation, with several countries developing significant Protestant populations. These religious changes have influenced the political processes of several Latin American nations, playing a prominent role in elections and the formation of political platforms. Several theories attempt to account for the recent growth in religious pluralism, particularly social anomie theory and religious market models. These theories ignore or downplay the role of conflict between the state and civil society, especially violent confrontations between the government and the Roman Catholic Church. This study focuses on four case studies with varying amounts of church-state …

Pentecostalism, Development And Democracy In Latin America, Pierre A. Louis Jan 2008

Pentecostalism, Development And Democracy In Latin America, Pierre A. Louis

Harriet L Wilkes Honors College Theses 2003 - 2009

The recent explosive growth of Protestantism in Latin America has led a number of scholars to predict that the region may be on its way to reaching a significantly higher levels of socioeconomic development and democracy. These are important claims for a region that has struggled with both economic development and democratic consolidation. This thesis argues that Protestantism in Latin America does not follow the classical Weberian pattern of development. Because the majority of Protestant growth in the region is Pentecostal, the causal assumptions of the--culture and development school do not hold. Furthermore, a context of neoliberalism, a significant colonial …

Size Distribution Of Polymer-Coated Magnetite Nanoparticles, Daniel B. Gopman Jan 2008

Size Distribution Of Polymer-Coated Magnetite Nanoparticles, Daniel B. Gopman

Harriet L Wilkes Honors College Theses 2003 - 2009

A method for estimating the size distribution of magnetite nanoparticles from their magnetic properties is presented. The 10 nm diameter particles were coated with poly(acrylic) acid and prepared as a water-based suspension. A vacuum-dried sample was placed in a transmission electron microscope (TEM) so that the physical sizes of the particles could be estimated. The particle magnetization was measured by a superconducting quantum interference device (SQUID) in magnetic fields up to 25 kiloOersted and temperatures ranging from 5 to 370 Kelvin. The magnetic moments in the sample were estimated by fitting those measurements to a Langevin magnetization model, weighted by …

They Forget I Am An Irishman", Mark. Goldberg-Foss Jan 2008

They Forget I Am An Irishman", Mark. Goldberg-Foss

Harriet L Wilkes Honors College Theses 2003 - 2009

Early twentieth-century Ireland was the setting of a complex political situation dominated by overlapping social, ideological, and ethnic conflicts. A group of working-class nationalists led by James Connolly attempted to fuse the class and national struggles, incorporating elements of nationalist cosmology, Marxist teleology, syndicalist trade-union practice, and the cultural militarization of Ireland's "physical-force" tradition. This thesis critically examines their hybrid theory and revolutionary praxis. With its analysis of the failure to realize an independent, socialist Ireland, it contributes to broader discussions of the relationship between nationalism and socialism, and the ability of these theories to address cultural heterogeneity.

Diatoms As A Food Source For Sorites Dominicensis, Tiffany. Gaston Jan 2008

Diatoms As A Food Source For Sorites Dominicensis, Tiffany. Gaston

Harriet L Wilkes Honors College Theses 2003 - 2009

Sorites dominicensis is a common Foraminifera living on Thalassia testudinum seagrass blades in the Indian River Lagoon. This locality is unique because epiphytic diatoms, characteristic of Caribbean and temperate environments, are expected to make up the biofilm community. Diatoms compose a large part of the Foraminiferan diet. It is important to understand the cause and effect relationship of population variation between S. dominicensis and its preferred food source, since both are valuable bioindicators. We examined the selective feeding of S. dominicensis by first, identifying the diatom assemblage. Second, we utilized scanning electron microscopy (SEM) in order to identifying the remains …

Gentle Gender?, Jenna. Fitzgerald Jan 2008

Gentle Gender?, Jenna. Fitzgerald

Harriet L Wilkes Honors College Theses 2003 - 2009

Twelve years separate the plays Titus Andronicus and Macbeth and yet the similarities between Tamora and Lady Macbeth seem to indicate that the former served as a model for the latter female revenge character. Despite the many characteristics that connect the two powerful women, Shakespeare not only intensifies Tamora but questions her maternal traits, exaggerates her competition with the male characters, and replaces her motives for madness in order to create Lady Macbeth. While it is often assumed that a female's identity is defined through her male counterpart, the opposite is true of the male characters in Titus Andronicus and …

Personality And The News, Mila. Curry Jan 2008

Personality And The News, Mila. Curry

Harriet L Wilkes Honors College Theses 2003 - 2009

The current study examines the relationship between the Five-Factor Model of Personality and preferences for news headlines. This is an online study in which participants were presented two headlines and were asked to choose one of them. Next, participants were asked to fill out a personality inventory. In the results we examine whether certain personality types are more likely to read certain news stories. Authors created five news headline domains, which were intended to map onto the Five-Factor Model of Personality. As hypothesized, Openness to Experience significantly (p < .05) predicted selection of items within the news headline domain entitled Culture. The study also found that personality can be predicted from news headline selection.

Grassroots Gospel, Lauren. Bimmler Jan 2008

Grassroots Gospel, Lauren. Bimmler

Harriet L Wilkes Honors College Theses 2003 - 2009

The presence of music, especially in the form of freedom songs, is a notable constant in the American Civil Rights Movement of the 1950s and 1960s. Participants sang spirituals and freedom songs everywhere in the South - at mass meetings, demonstrations, and in jails. An engaging and participatory activity, singing unified, empowered, and historicized activists, allowing everyone an opportunity to be included in the action. Without these songs, the African-American communities across the South may not have been able to band together to become such a force for change; while the activists were the facilitators for progress, the songs were …

Jury Decision-Making, Steven. Hackett Jan 2008

Jury Decision-Making, Steven. Hackett

Harriet L Wilkes Honors College Theses 2003 - 2009

This thesis is a study of the empirical significance of sentencing information on jury decision-making. A challenge in conducting jury behavior research is that direct observation of jury deliberation is either illegal or impractical. Thus most studies of jury behavior are conducted using archival analysis and mock jury questionnaires. And while we have some information on the issue of jury instruction complexity on jury decision-making, we know very little about the specific role of sentencing information on jury decision-making. My research combines aspects of the jury decision-making literature with the sentencing literature, and thus fills a crucial gap in the …

Tolan Committee And The Internment Of Japanese Americans, Matthew. Saccento Jan 2008

Tolan Committee And The Internment Of Japanese Americans, Matthew. Saccento

Harriet L Wilkes Honors College Theses 2003 - 2009

Within three months of the Japanese attack on Pearl Harbor, President Franklin Roosevelt issued Executive Order 9066, which allowed military commanders to establish zones of military importance within which they could remove any person considered dangerous, specifically those of Japanese descent. The Tolan Committee, a House committee examining the logistics of the new wartime economy, was immediately sent to the West Coast in order to evaluate the merit of the President's policy. They were presented with the most complete set of arguments both supporting and opposing internment, and were therefore in a unique position to make a well-informed decision regarding …

Painful State Of Pleasure In Charlotte Brontèe's Jane Eyre, Michelle. Cannon Jan 2008

Painful State Of Pleasure In Charlotte Brontèe's Jane Eyre, Michelle. Cannon

Harriet L Wilkes Honors College Theses 2003 - 2009

The heroine of Charlotte Brontèe's Jane Eyre is torn between her physical desire to remain close to Mr. Rochester and her psychological need for distance from him. Jane's need for distance tends to dominate her desire for closeness, and this internal conflict is reproduced externally in her relationship with Rochester, with Rochester's desire for physical proximity conflicting with Jane's desire for distance. These internal and external power struggles create a healthy sense of tension necessary both to Jane, and to her relationship with Rochester because it prevents either of them from being fully satisfied, and ensures that both remain in …
