A Literature Review Examining The § 501 (H) Election And § Irc 501 (C)(3) Organizations, Kimberly Anne Hefernan Moss

Graduate Research Papers

The purpose of the study was to conduct a literature review to determine what IRC § 501(c)(3) organizations know about the§ 501 (h) election, and why they do or do not take it. The literature review is divided into three sections: 1) IRC 501 (c) Organizations and Legislation; 2) IRC § 501 (c) lobbying; and 3) IRC § 501(c)(3) Lobbying Rules/Regulations. There has been scant research conducted surrounding lobbying by nonprofit organizations. The first national study that addressed IRC § 501 (c)(3) organizations' lobbying was the Strengthening Nonprofit Advocacy Project (SNAP). Despite the fact that very few organizations have taken …

Lawfare And Legal Ethics In Guantánamo, David Luban Jan 2008

Lawfare And Legal Ethics In Guantánamo, David Luban

Georgetown Law Faculty Publications and Other Works

This paper, part of a symposium on the legal profession, focuses on the lawyers – some civilian and some military – who represent detainees at Guantánamo Bay. These include civilian counsel representing Guantánamo prisoners in habeas proceedings, as well as civilian and military defense counsel for those facing trial before military commissions. Using published sources as well as interviews with some of the lawyers, the paper examines the tactics by which the U.S. government has tried to disrupt the effective representation of Guantánamo detainees. In the case of habeas lawyers, whose very presence at Guantánamo is unwelcome by the government, …

Socioeconomic Disparities In Health: A Symposium On The Relationships Between Poverty And Health, Lawrence O. Gostin Jan 2008

Socioeconomic Disparities In Health: A Symposium On The Relationships Between Poverty And Health, Lawrence O. Gostin

Georgetown Law Faculty Publications and Other Works

The disparities in health between the rich and poor are so striking, and the results so dire, that reducing the gap is an ethical imperative.

A strong and consistent finding of epidemiological research is that socioeconomic status (SES) is correlated with morbidity, mortality, and functioning. SES is a complex combination of income, education, and occupation. Theorists posit that material disadvantage, diminished control over life's circumstances, and lack of social acceptance all contribute to poor health outcomes. The relationship between SES and health often is referred to as a "gradient" because of the graded and continuous nature of the association; health …

Sexual And Gender Based Violence In Africa: Literature Review, Population Council

Reproductive Health

This report provides details of a literature review that is intended to inform partners in the Population Council–coordinated regional network that aims to develop a multisectoral and comprehensive response to sexual and gender-based violence (SGBV) in Eastern, Central, and Southern Africa. The first section defines the terminology used throughout the review, and discusses the prevalence and consequences of SGBV, considers the implications of the disproportionate programmatic focus on adult women survivors, and explores approaches to managing child and male survivors of sexual violence. The second section presents regional policies and programming relating to the medical and psychosocial management of survivors. …

South Africa: Integrated Approach Improves Quality Of Post-Rape Care, Population Council

Reproductive Health

In South Africa, an integrated model for post-rape care by nurses in a rural district hospital, which included a designated room for medical management and guidelines for providing reproductive health and HIV services, improved the quality of care provided. However, nurses remained reluctant to collect forensic evidence that could be used for prosecuting perpetrators. South Africa has developed a strong policy framework outlining medical management of rape survivors, which includes provision of HIV testing and post-exposure prophylaxis and emergency contraception, ideally within 72 hours. However, implementation has been hampered by numerous obstacles, both in health care infrastructure and policy, and …

Africa Regional Sexual And Gender-Based Violence Network Consultation: Technical Exchange And Planning Meeting, Population Council

Reproductive Health

In March 2008, the Population Council brought together members of the Africa Regional Sexual and Gender Based Violence (SGBV) Network for a South-South technical exchange meeting. The objectives were to identify best practices from existing programs, provide an evidence base for new programming, and develop mechanisms for South-South technical assistance. As detailed in this report, discussions covered the medical, legal, and psychosocial issues associated with SGBV prevention and response activities. Participants identified the following: Protocols and guidance documents are essential for ensuring comprehensive, quality response at all levels. Enabling access and utilization of the full range of medical services remains …

Access To Justice: The Use Of Contingent Fee Arrangements By Public Officials To Vindicate Public Rights, Neil F. X. Kelly, Fidelma L. Fitzpatrick

Cardozo Journal of Equal Rights & Social Justice

The article examines the legality and efficacy of contingent fee agreements in public nuisance litigation, particularly in the context of childhood lead poisoning cases. It argues that such agreements are valid, ethical, and necessary for governments to pursue justice and remediation in cases where public health and safety are at risk. The analysis focuses on the landmark Rhode Island case against lead pigment manufacturers, highlighting how contingent fee arrangements ensure fair representation and accountability without compromising due process or impartiality.

Walking The Path Of The Law: How Law Graduates Navigate Career Choices And Tolerate Jobs That Fail To Meet Expectations, Deborah J. Cantrell, Elizabeth Levy Paluck, Heather Lord, April Smith

Cardozo Journal of Equal Rights & Social Justice

The article presents a longitudinal study of Yale Law School graduates from 1970 to 1999, analyzing their career paths, job satisfaction, and gender differences in professional experiences. It highlights the prevalence of career transitions, with many graduates moving from private practice to academia, government, or public interest roles. The study reveals significant gender disparities in job satisfaction and work-life balance, while challenging common assumptions about legal careers, such as the notion that women abandon private practice more frequently than men. The analysis underscores the importance of understanding career dynamics to improve support systems for law graduates.

Allies Not Adversaries: Teaching Collaboration To The Next Generation Of Doctors And Lawyers To Address Social Inequality, Elizabeth Tobin Tyler

Pro Bono Collaborative Staff Publications

Recent reports from the Carnegie Foundation for the Advancement of Teaching, as well as from other medical and legal educators, stress that professional training of doctors and lawyers focuses too narrowly on knowledge-based learning, and not enough on context-based problem solving, professionalism, and ethics. Tracing recent calls from both legal and medical educators to increase the teaching of ethics, social responsibility, the lawyer-client and doctor-patient relationship, and holistic problem-solving, this article offers a model of interdisciplinary medical-legal education focused on developing practitioners sensitive to the needs of diverse and disenfranchised clients and patients. It highlights a burgeoning medical-legal partnership model, …

Vico's "Ingenious Method" And Legal Education, Francis J. Mootz Iii

Scholarly Works

Contemporary discussions about the need to reform legal education, culminating in the 2007 Carnegie Report, should be put into a broader historical, philosophical and ethical perspective. Three hundred years ago the Italian humanist, Giambattista Vico delivered his famous oration, "On the Study Methods of Our Time," in which he lamented the rise of Cartesian critical philosophy at the expense of the cultivation of imagination, prudence and eloquence. Vico discussed law and legal education as his primary example, and his oration therefore provides an incredible resource for our contemporary deliberations.

Part One considers the literature addressing the demise of legal professionalism …

Pressures Toward Mediocrity In The Representation Of Children, Barbara Glesner Fines Jan 2008

Pressures Toward Mediocrity In The Representation Of Children, Barbara Glesner Fines

Faculty Works

When children are the subject of dependency, adoption or guardianship proceedings, protecting those children requires attention to a variety of interests. Children need a voice: an advisor and an advocate whose judgment is unclouded by conflicting interests. Courts need information that the adult parties to the proceedings may not easily discover or willingly provide. The families and social services agencies need monitors and mediators. The attorney guardian ad litem (GAL) is, in many situations, called upon to meet all these needs. During the past decade, major academic conferences and professional organizations have devoted thousands of hours to developing standards of …

This Report is the result of a grant to the University of Missouri-Kansas City from the Ewing Marion Kauffman Foundation to research and describe current methods of training law students and lawyers destined to represent entrepreneurs, and to identify promising pedagogy in pursuit of the goal of educating effective counselors to entrepreneurial clients. Entrepreneurs clearly need help in dealing with a multitude of increasingly complex laws and regulations. They may also require counsel in obtaining financing and negotiating their transactions, within the bounds of the applicable rules, to achieve their goals.
