Impacts Of ‘Three Strikes And You’Re Out’ On Crime Trends In California And Throughout The United States, Elsa Y. Chen

Political Science

The impacts of Three Strikes on crime in California and throughout the U.S. are analyzed using cross-sectional time series analysis of state-level data from 1986 to 2005. The model measures both deterrence and incapacitation effects, controlling for pre-existing crime trends and economic, demographic, and policy factors. Despite limited usage outside California, the presence of a Three Strikes law appears to be associated with slightly but significantly faster rates of decline in robbery, burglary, larceny, and motor vehicle theft nationwide. Three Strikes is also associated with slower declines in murder rates. Although California’s law is the broadest and most-frequently-used Three Strikes …

Four-Factor Disaster: Courts Should Abandon The Circuit Test For Distinguishing Government Speech From Private Speech, Lilia Lim

A recent addition to First Amendment jurisprudence, the government-speech doctrine was developed by the Supreme Court to insulate government speech from certain First Amendment challenges. Broadly, the doctrine rests on the notion that when the government speaks for itself, it may say what it wishes. Recently, government entities facing claims of viewpoint discrimination against speech have asserted a government-speech defense, claiming that their viewpoint-based actions were justifiable because they were not regulating private speech but speaking for themselves. Several federal courts deciding these cases have applied a circuit-developed, four-factor test to determine whether the speech at issue was private speech …

Guarding The Guardians: Judicial Councils And Judicial Independence, Nuno Garoupa, Tom Ginsburg

Public Law and Legal Theory Working Papers

This Article uses comparative evidence to inform the ongoing debate about the selection and discipline of judges. In recent decades, many countries around the world have created judicial councils, institutions designed to maintain an appropriate balance between judicial independence and accountability. Our Article has two aims. First, we provide a theory of the formation of judicial councils and identify some of the dimensions along which they differ. Second, we test the extent to which different designs of judicial council affect judicial quality. We find that there is little relationship between councils and quality. Split On Sanctioning Pro Se Litigants Under 28 U.S.C. 1927: Choose Wisely When Picking A Side, Eighth Circuit, The, Kelsey Whitt

In recent years, an increasing number of pro sel litigants have appeared in federal courts. Between October 2003 and September 2004, federal district courts had over 20,000 cases filed by pro se litigants. In fact, "pro se litigants appeared in thirty-seven percent of all cases.' The increase of pro se litigation is attributed to several factors, including the rising cost of litigation combined with the decrease of funding for legal services, the negative public perception of lawyers, and the rise of do-it-yourself legal resources. The Puzzling Mr. Janin And Mammoth Cave Management, 1900-1910, Katie Algeo

Mammoth Cave Research Symposia

Albert Covington Janin was the key architect of tourism development at Mammoth Cave for two decades at the start of the twentieth century, yet little has been written about his tenure. This paper explores his background and accomplishments for the period 1900 to 1910 as an initial attempt to understand his contributions to Mammoth Cave. Material about his activities in relation to Mammoth Cave is synthesized from primary sources in the archival collections of the Huntington Library (HL) of San Marino, California, and the Historical Society of Washington, DC (HSW).
