Vico's "Ingenious Method" And Legal Education, Francis J. Mootz Iii

Chicago-Kent Law Review

Recent calls to reform legal education have culminated in the 2007 Carnegie Report, which is attracting substantial attention and promises to have tremendous influence on American law schools. In this article I survey these calls for reform and argue that they should be put into a broader historical, philosophical and ethical perspective. Three hundred years ago the Italian humanist, Giambattista Vico, delivered his famous oration that serves as the focal point for this symposium, On the Study Methods of Our Time. This oration lamented the rise of Cartesian critical philosophy at the expense of the cultivation of imagination, prudence, …

Ethical Exploitation Of The Unrepresented Consumer, The, Victoria J. Haneman

Missouri Law Review

This article begins in Section I with a brief overview of the debt industry. Section II describes the circumstances of an unrepresented defendant in the adversarial system of justice. The conventional codes of professional responsibility are weighed against a broader framework of normative ethics in Section III. Section IV illustrates how the particulars of the debt-buying setting are emblematic of broader issues. Two solutions are then discussed in Section V: One broadly targets the failure of attorneys' ethical codes to account for the collapse of the adversarial myth in cases involving unrepresented litigants; the other is a more tailored solution …

The true life story of Nikola Tesla reads like a fiction novel worthy of Hollywood in a tale of the great radio controversy. Who did invent radio? Marconi is often credited with the invention, while a discouraged Tesla mostly watched from the sidelines - his contributions and further innovations to radio being silenced during the height of radio's most rapid growth. While Tesla's bizarre personal life may read like a novel by Jules Verne and F. The 2007 Economic And Fiscal Impact Of Omaha’S Henry Doorly Zoo On Omaha And Nebraska, Eric Thompson

The City of Omaha, and the State of Nebraska, benefit from the presence of a leading national zoo in the city. The nationally-known Henry Doorly Zoo makes a significant contribution to the Omaha economy. The Zoo attracted over 1.3 million visitors, and their spending, in 2007 including many visitors from outside of Omaha and outside of the State of Nebraska. The Zoo also makes a significant contribution to the quality of life in Omaha and Nebraska, and by many indicators, Omaha’s Henry Doorly Zoo is among the largest, and most affordable zoos to visit in North America.

This paper will examine how a number of jurisdictions treat the takings standard for non-profit organizations, and will suggest ways of clarifying and improving the law. Part I discusses Penn Central, which sets the high national standard to for takings claims. This section also discusses how local governments have incorporated that standard into historic preservation laws as economic hardship claims. Part II analyzes how some jurisdictions make a distinction between commercial and non-profit owners in takings claims, and what claimants must demonstrate to succeed in making a claim. This paper will analyze the tension between the historic preservation of sacred places and the free exercise of religion as seen through the recent controversy surrounding the landmarking of Third Church of Christ, Scientist, in Washington, D.C. Assuming Third Church would bring a free exercise and RLUIPA challenge if the District denied a demolition permit, this paper will examine how such a suit would likely fail.

Recent changes in governmental policy toward disaster medicine and hospital incident command foreshadow a significant change in the role that physicians will play in disaster preparedness and response. The distinct discipline of Disaster Medicine has received authoritative recognition and promotion in the recent Homeland Security Presidential Directive 21, and recently established guidelines for incident command within hospitals have included a new position designated as “Medical/Technical Specialist(s)” that will assist the Incident Commander in disaster-related decision-making.
