Licensing Lawyers In The Modern Economy, Trippe S. Fried
Licensing Lawyers In The Modern Economy, Trippe S. Fried
Campbell Law Review
This article explores a key question for the future of the legal profession: does a paradigm in which each individual state has exclusive control over the practice of law within its borders work in the marketplace of Friedman's "flat world"? Or in today's global economy does state micromanagement of the legal profession so inure to the detriment of lawyers and clients that some form of national licensing is necessary?
Should Kiva Pay Interest To Lenders, Asbjorn Osland
Should Kiva Pay Interest To Lenders, Asbjorn Osland
Faculty Publications, School of Management
The case covers Kiva, a 501(c)(3) tax-exempt charity working in the microfinance industry. Through it, people lend money to the working poor of the Third World. Lenders select businesses from the website. They then receive periodic updates and can reclaim the paid back loans, donate the money, or lend the paid principal again. The dilemma faced by Kiva's leadership team is whether or not to pay lender’s interest.
The Grammar Of Catholic Schooling And Radically "Catholic" Schools, Martin Scanlan
The Grammar Of Catholic Schooling And Radically "Catholic" Schools, Martin Scanlan
College of Education Faculty Research and Publications
A "grammar of Catholic schooling" inhibits many elementary and secondary Catholic schools from reflecting on how they practice Catholic Social Teaching (CST). The values of human dignity, the common good, and a preferential option for the marginalized are central to CST. Schools can live these values by serving children who live in poverty, are racial, ethnic, and linguistic minorities, or have disabilities. This article demonstrates how a grammar of Catholic schooling has allowed Catholic schools to fall into recruitment and retention patterns antithetical to CST. Drawing upon a multicase, qualitative study of three urban Catholic elementary schools serving marginalized students, …

Demographics, Trends, And A Call To Action, Toby Golick
Demographics, Trends, And A Call To Action, Toby Golick
Articles
Every discussion of aging in America seems to begin with demographic statistics showing that our population is increasingly old and getting older. But the figures are truly stunning: In 2006 (the latest year for which data are available), 37.3 million persons were 65 years old or older in America; this represents 12.6 percent of the U.S. population-more than one in every eight Americans. By 2030 the number of older people is expected to increase to 71.5 million older persons, over 20 percent of the total population.
The Effective Reach Of Choice Of Law Agreements, Tiong Min Yeo
The Effective Reach Of Choice Of Law Agreements, Tiong Min Yeo
Research Collection Yong Pung How School Of Law
Two fundamental principles relating to party autonomy developed in the recent history of the conflict of laws. Despite initial reservations, the law today takes for granted that the parties’ agreement is nearly conclusive in respect of both their choice of litigation forum and their choice of the law governing the contractual relationship. Meanwhile, the law of obligations – in tort, restitution and equity – has grown apace; disputes between contracting parties today are rarely confined to pure contractual issues. Can contracting parties choose the law to govern non-contractual disputes in cross-border litigation? In the absence of such choice, to what …
Service Supply Chain Management : A Hierarchical Decision Modeling Approach, Roger Angel Solano-Cayama
Service Supply Chain Management : A Hierarchical Decision Modeling Approach, Roger Angel Solano-Cayama
Dissertations
A Service Supply Chain (SSC) may be described as a network of service provider facilities (in-house or outsourced), each of which is able to process one or more service tasks on an as needed basis. Two key characteristics of a SSC are (i) the business service is decomposable into several sequential tasks that can be processed by different service providers, and (ii) the primary capacity resource is skilled labor. SSCs are increasingly being developed by companies that experience a high variability of demand for their services (e.g., loan processing, analytical consulting services, emergency repair crews, claims processing, etc.). Typically, the …

Ownership Characteristics Of Heir Property In A Black Belt County: A Quantitative Approach, Janice F. Dyer, Conner Bailey, Nhuong Van Tran
Ownership Characteristics Of Heir Property In A Black Belt County: A Quantitative Approach, Janice F. Dyer, Conner Bailey, Nhuong Van Tran
Journal of Rural Social Sciences
The existing literature identifies heir property, land held communally by heirs of someone who has died without a will, as a primary cause of land loss among African Americans and a major factor contributing to persistent poverty in the South’s demographically-defined Black Belt. Despite the importance of this form of property, little systematic research has been done to quantify the extent of heir property or the potential wealth tied up in clouded titles. This study documents the presence of more than 1,500 heir property parcels in one Alabama Black Belt county (Macon) and describes the methodological challenges involved in such …

Roman Slavery: A Study Of Roman Society And Its Dependence On Slaves., Andrew Mason Burks
Roman Slavery: A Study Of Roman Society And Its Dependence On Slaves., Andrew Mason Burks
Electronic Theses and Dissertations
Rome's dependence upon slaves has been well established in terms of economics and general society. This paper, however, seeks to demonstrate this dependence, during the end of the Republic and the beginning of the Empire, through detailed examples of slave use in various areas of Roman life. The areas covered include agriculture, industry, domestic life, the state, entertainment, intellectual life, military, religion, and the use of female slaves. A look at manumission demonstrates Rome's growing awareness of this dependence. Through this discussion, it becomes apparent that Roman society existed during this time as it did due to slavery. Rome depended …
