Large Domestic Pits On The Northwest Coast Of North America, Kenneth M. Ames, Cameron M. Smith, Alexander Bourdeau Jan 2008

Large Domestic Pits On The Northwest Coast Of North America, Kenneth M. Ames, Cameron M. Smith, Alexander Bourdeau

Anthropology Faculty Publications and Presentations

Excavations of prehistoric and contact-period houses on the southern Northwest Coast of North America have exposed very large interior pit complexes. The complexes are either long trenches or rows of pits beneath the house floors. They are associated with substantial permanently occupied houses dated to between 300 CAL B.G. and A.D. 1830. The pits add significantly to the storage potentials of these houses and suggest surplus production.

Evaluation Of Stop-Level Vs. Route-Level Breeding Bird Survey Counts For Modeling The Influence Of Land Use And Climate On Breeding Blackbird Abundance In North Dakota, Michelle L. Petersen, George M. Linz, Greg Forcey, Wayne Thogmartin, William J. Bleier Jan 2008

Evaluation Of Stop-Level Vs. Route-Level Breeding Bird Survey Counts For Modeling The Influence Of Land Use And Climate On Breeding Blackbird Abundance In North Dakota, Michelle L. Petersen, George M. Linz, Greg Forcey, Wayne Thogmartin, William J. Bleier

United States Department of Agriculture Wildlife Services: Staff Publications

The Red-winged Blackbird (Agelaius phoeniceus), Yellow-headed Blackbird (Xanthocephalus xanthocephalus), and Common Grackle (Quiscalus quiscula) are the three most abundant blackbird species (Icteridae) found in North Dakota and comprise almost 10% of its avian population (Stewart and Kantrud 1972). Blackbird abundance combined with their food habitats make them significant agricultural pests on sunflower. Cost estimates for blackbird damage to sunflower in the North Dakota are likely over $10 million dollars annually (Kleingartner, pers. comm). Because of this economic impact blackbirds have on agriculture, it is important to understand land use and climatic factors influencing blackbird …

Development Of Polymorphic Microsatellite Loci For The Common Vampire Bat, Desmodus Rotundus (Chiroptera: Phylostomidae), Antoinette J. Piaggio, John J. Johnston, Susan L. Perkins Jan 2008

Development Of Polymorphic Microsatellite Loci For The Common Vampire Bat, Desmodus Rotundus (Chiroptera: Phylostomidae), Antoinette J. Piaggio, John J. Johnston, Susan L. Perkins

United States Department of Agriculture Wildlife Services: Staff Publications

The common vampire bat (Desmodus rotundus) is one of three haematophagous species of bats and the only species in this genus. These New World bats prey on mammals and create significant economic impacts through transmission of rabies in areas where livestock are prevalent. Furthermore, in some portions of their range, it is not uncommon for them to prey upon humans. It is critical to the management of this species and for understanding the spread of bat rabies that detailed studies of D. rotundus population structure be conducted. To further such studies, we have characterized 12 microsatellite loci for …

Evaluation Of An Electrified Mat As A White-Tailed Deer (Odocoileus Virginianus) Barrier, Thomas W. Seamans, David A. Helon

United States Department of Agriculture Wildlife Services: Staff Publications

White-tailed deer (Odocoileus virginianus) pose economic and safety problems for agricultural and transportation industries. We tested an electronic mat to determine if it would reduce deer crossing through fence openings. We measured deer intrusions and corn consumption at five sites with charged mats and five sites with non-charged mats. Weekly intrusions at treated sites decreased an average of 95% from pre-treatment. Weekly intrusions at control sites were reduced 60% during weeks 1 and 2 and increased to 10% reduction by week 6. Weekly corn consumption at treated sites decreased from pretreatment through all treatment weeks. Weekly corn consumption …

United States Department of Agriculture Wildlife Services: Staff Publications

Problem: An effective, single-injection, multi-year, GnRH contraceptive agent is needed to control reproduction in overabundant white-tailed deer populations.

Method of study: Two GnRH conjugates, GonaConTM (GnRH–KLH) and GonaCon-BTM (GnRH–blue protein), were prepared in emulsion form as one-injection and two-injection immunocontraceptive vaccine formulations. In addition, the GnRH–KLH protein conjugate was lyophilized and suspended in AdjuVacTM adjuvant to produce a fifth vaccine formulation. Each formulation was administered to a group of five captive adult female white-tailed deer. Reproductive performance of treated female deer was monitored for 5 years to determine the comparative efficacy of the various treatments.

Results: The …

Deer Impact On Vegetation In Natural Areas In Southeastern Nebraska, Joseph Gubanyi, Julie A. Savidge, Scott E. Hygnstrom, Kurt C. Vercauteren, Gary W. Garabrandt, Seth Korte

United States Department of Agriculture Wildlife Services: Staff Publications

We studied the effect of browsing by white-tailed deer (Odocoileus virginianus Zimmerman) on vegetation at three sites with high densities of deer and six sites with low densities of deer along the Missouri and Platte Rivers in southeastern Nebraska in 1995-1996. Vegetation volume from 0-1 m high was similar between sites with high and low deer densities (P > 0.05). From 1-2 m high, vegetation volume was less at sites with more deer in both years (P < 0.05). Densities for eight of 11 small woody plant categories (< 3 cm dbh) were less common at sites with high densities of deer (P < 0.05). Overall densities of small trees (3-15 cm dbh) were similar between sites with high and low densities of deer. However, small hackberry trees (Celtis occidentalis L.) were more common (P = 0.03), while all other small trees were less common (P = 0.038), at sites with …

An Integrated Vehicle-Mounted Telemetry System For Vhf Telemetry Applications, Jason Gilsdorf, Kurt C. Vercauteren, Scott E. Hygnstrom, W. David Walter, Justin Boner, Greg Clements

United States Department of Agriculture Wildlife Services: Staff Publications

We designed and developed a vehicle-mounted very high frequency–based telemetry system that integrated an on-board antenna, receiver, electronic compass, Global Positioning System, computer, and Geographic Information System. The system allows users to accurately and quickly obtain fixes, estimate and confirm locations of radio-marked animals, and immediately record data into an electronic spreadsheet or database. The total cost of materials to build the system was $7,349 (United States currency). Mean error angle of 2.63 ± 12.1° (SD; range =-33.7–42.2°) and mean location error distance of 128 ± 91.3 m (SD; range = 0–408 m) suggested precision and accuracy of our system …

Livestock Protection Dogs For Deterring Deer From Cattle And Feed, Kurt C. Vercauteren, Michael J. Lavelle, Gregory Phillips Jan 2008

Livestock Protection Dogs For Deterring Deer From Cattle And Feed, Kurt C. Vercauteren, Michael J. Lavelle, Gregory Phillips

United States Department of Agriculture Wildlife Services: Staff Publications

Disease transmission between wildlife and livestock is a worldwide issue. Society needs better methods to prevent interspecies transmission to reduce disease risks. Producers have successfully used livestock protection dogs (LPDs) for thousands of years to reduce predation. We theorized that LPDs raised and bonded with cattle could be used to also reduce risk of bovine tuberculosis (Myobacterium bovis; TB) transmission between white-tailed deer (Odocoileus virginianus) and cattle by minimizing contact between the 2 species and use of cattle feed by deer. We evaluated 4 LPDs over 5 months, utilizing 2 data collection methods (direct observation and …

Management Of The Neck In Differentiated Thyroid Cancer, David M. Cognetti, Edmund A. Pribitkin, William M. Keane Jan 2008

Management Of The Neck In Differentiated Thyroid Cancer, David M. Cognetti, Edmund A. Pribitkin, William M. Keane

Department of Otolaryngology - Head and Neck Surgery Faculty Papers

Differentiated thyroid cancer is characterized by an excellent long-term prognosis, which unlike other head and neck carcinomas, is not influenced definitively by regional lymph node metastasis. The relative rarity of the disease, together with its tendency for delayed metastasis and its low mortality, makes a prospective randomized trial comparing treatment outcomes difficult. As a result, the effect of cervical lymph node metastases on survival is unclear, making meaningful recommendations for their management somewhat subjective. This article discusses guidelines for the management of the neck in differentiated.

Persuasive Design Of Destination Websites: An Analysis Of First Impression, Heejun Kim, Daniel R. Fesenmaier

Publications and Research

This research examines the persuasiveness of destination websites through an investigation of users’ first impression. To achieve this goal, it builds on research by Fogg (2003) and by Kim and Fesenmaier (2007) to assess the effect of the design factors of destination websites on first impression formation. The results of this study indicate that the subjects were able to make quick judgments on tourism websites, and that inspiration and usability were the primary drivers evoking a favorable first impression. This research concludes by discussing the implications of these findings and possible directions for future study.

The Effect Of Hand Position On Maximum Performance Of Push-Ups In Adults, Gregory Douglas Brickey Jan 2008

The Effect Of Hand Position On Maximum Performance Of Push-Ups In Adults, Gregory Douglas Brickey

Open Access Theses & Dissertations

Push-ups are widely used in public school physical education classes, and by military and law enforcement organizations to test upper body muscular fitness. The majority of the test protocols do not specify a hand position. Some research has demonstrated that hand positioning has a significant effect of on electromyographic activity of the working muscles, ground reaction forces and elbow joint loads during single or sub-maximal push-ups. However there are no scientific studies on how a change of hand positions would affect performance in a maximal push-up test to volitional exhaustion. This study examined performance in a maximal push-up test in …

Combined, they provide a total of 21 observations for each variable. The specific data series are total maquiladora employment, operating plants, average hourly wages, and total value added.

Lower Courts And Constitutional Comparativism, Roger P. Alford Jan 2008

Lower Courts And Constitutional Comparativism, Roger P. Alford

Journal Articles

The issue of constitutional comparativism has been a topic of significant commentary in recent years. However, there is one aspect of this subject that has been almost completely ignored by scholars: the reception, or lack thereof, of constitutional comparativism by state and lower federal courts. While the Supreme Court's enthusiasm for constitutional comparativism has waxed and now waned, lower state and federal courts have remained resolutely agnostic about this new movement. This is of tremendous practical significance because over ninety-nine percent of all cases are resolved by lower state and federal courts. Accordingly, if the lower courts eschew constitutional comparativism, …

The Interpretation Game, Robert E. Rodes Jan 2008

The Interpretation Game, Robert E. Rodes

Journal Articles

Sir James Fitzjames Stephen, embarking on a powerful critique of John Stuart Mill, says: "In stating the grounds of one's dissent from wide-spread and influential opinions it is absolutely necessary to take some definite statement of those opinions as a starting point, and it is natural to take the ablest, the most reasonable, and the clearest." This is my justification for reviewing the present work. My disagreement with it is broad and deep, but, unlike many proponents of similar views, Professor Benson writes clearly and without jargon, and he brings to his work the experience of a working lawyer and …

Court Of Public Opinion In And For The State Of Uncertainty, Kevin Farmer, Kathleen Kane, Steven Meisel, Joseph Seltzer Jan 2008

Court Of Public Opinion In And For The State Of Uncertainty, Kevin Farmer, Kathleen Kane, Steven Meisel, Joseph Seltzer

Organization, Leadership, and Communication

Our session has two goals. First, we aim to stimulate debate over a ubiquitous, yet largely unchallenged, instrument that purports to operationalize Jungian personality theory (the Myers-Briggs Type Indicator). Second, we suggest a platform for teaching management theories, the mock-trial, which manifests active learning as well as critical thinking and has been successfully utilized in other disciplines. With contributors playing key roles in the trial and volunteers from the audience serving as potential prosecution and defense witnesses as well as the jury, we hope the discourse on substantive theory and teaching process will provide the jolt OBTC 2008 envisions.

What Is The Government's Role In Promoting Morals - Seriously, G. Marcus Cole Jan 2008

What Is The Government's Role In Promoting Morals - Seriously, G. Marcus Cole

Journal Articles

In thinking about the government's proper role in promoting morals, it is helpful first to understand the nature of the disagreement. Part I of this Essay examines what is commonly meant by-as the great Lon Fuller described it-the "morality of law."' Following Professor Fuller's framework, this Essay distinguishes between two very different moralities of law: the "morality of duty" and the "morality of aspiration." The morality of duty consists of the basic proscriptions-against murder or theft, for example-required by any governmental authority. The morality of aspiration, however, is a different matter altogether. It comprises the rules associated with promoting virtue. …

Sarbanes-Oxley, Kermit The Frog, And Competition Regarding Audit Quality, Matthew J. Barrett Jan 2008

Sarbanes-Oxley, Kermit The Frog, And Competition Regarding Audit Quality, Matthew J. Barrett

Journal Articles

The regulatory scheme after Sarbanes-Oxley has significantly improved public company audits in the United States, or at least has demonstrated the potential to do so, but the obligation to preserve client confidentially still prevents auditors from competing for new clients on the basis of audit quality. This paper suggests a simple way for the SEC to facilitate such competition within the existing regulatory framework. The SEC should require issuers and registrants to disclose whether their independent audits uncovered any financial fraud and, within specified ranges, the number and amount of all audit adjustments incorporated into the financial statements filed with …

Corporate Aiding And Abetting Of Human Rights Violations: Confusion In The Courts, Douglass Cassel Jan 2008

Corporate Aiding And Abetting Of Human Rights Violations: Confusion In The Courts, Douglass Cassel

Journal Articles

This article explores whether transnational corporations or their executives can be held criminally or civilly liable for aiding and abetting human rights violations committed by governments, militaries or other actors in foreign countries where they do business. The article particularly examines the mens rea element under international law: whether the aider or abettor must knowingly—or instead purposefully—assist the principal to commit a crime. At present, the principal concern of major corporations about liability for aiding and abetting is the risk of being held liable in U.S. courts under the Alien Tort Statute. But whatever happens with ongoing ATS litigation, the …

Human Dignity And Judicial Interpretation Of Human Rights: A Reply, Paolo G. Carozza Jan 2008

Human Dignity And Judicial Interpretation Of Human Rights: A Reply, Paolo G. Carozza

Journal Articles

This essay is a reply to Christopher McCrudden's Human Dignity and Judicial Interpretation of Human Rights, 19 EJIL 655 (2008). It argues that McCrudden's study of the uses of the idea of human dignity in constitutional human rights adjudication confirms the thesis that there is at present an emerging global ius commune of human rights. Although McCrudden understates the existence and value of transnational agreement about human dignity and instead emphasizes divergences in the judicial uses of human dignity, in fact there is good reason to regard the core recognition of the status and principle of human dignity as more …

Class Action Criminality, Lisa L. Casey Jan 2008

Class Action Criminality, Lisa L. Casey

Journal Articles

This paper examines the criminal prosecution of Milberg Weiss, formerly the most successful plaintiffs’ securities class action firm in the country, for allegedly making undisclosed incentive payments to class representatives. In particular, the article examines the government’s primary charge - that the firm’s practice violated the “honest services” theory of mail and wire fraud. The government’s application of this theory presumes a fiduciary relationship between the class representatives and the class which has never been clearly delineated and, indeed, is against the weight of case law and the realities of class action litigation.

The Article proceeds on two different levels. …
