The acceptance and use of mediation by courts--at the state and federal level-- has grown steadily over the last several decades. Today, mediation is a central element in the overall case-management system of many courts, and this phenomenon continues to grow unabated.At the same time, however, another quite different phenomenon has emerged--the expression of serious criticism from mediation scholars and experts about the way mediation is used by the courts. Indeed, it appears that judges and lawyers in the court system, on the one hand, and mediation experts on the other, understand court-related mediation--and mediation itself--in very different terms. This thesis examines the build-up to and the events of the First Barbary War (1801-1805) with the purpose of demonstrating that ideological factors significantly influenced the decision to go to war – specifically the republican ideology of Thomas Jefferson and his belief that this ideology represented the essence of the United States and its Revolutionary heritage. As such, Jefferson will be the main focus of this analysis. This focus is justified because it is Jefferson who broke with the policies set by his predecessors and directly engaged the Barbary States with military force. A Growing Concern: Modern Slavery And Agricultural Production In Brazil And South Asia, Justin Campbell

The modern use of slave labor in the production of agriculture takes many forms. In Brazil, the ability of powerful landowners to repress poor workers is an important element of large-scale agricultural production. In South Asia, cultural norms and traditions are used to exploit the most vulnerable communities. In both examples, inequity and poverty are implicit, and debt is a tool used to legitimize bondage.

The Topic

The 1919 Bible Conference was held immediately after World War I during a heightened interest in the apocalyptic and soon after the death of Ellen White. Patterned after the Fundamentalist prophetic conferences of 1918 and 1919, it was arguably the first “scholarly” conference held by Seventh-day Adventists. During a theologically turbulent time, Adventists found the emerging Fundamentalist movement attractive for its biblicist theology, its opposition to modernism and evolution, and the apparent popular appeal of its prophetic conferences.

In A Textual-Historical Theory of the Ninth Amendment, 60 Stanford Law Review, I explain how some of the most common theories of the Ninth Amendment either have nothing to do with the actual text of the Amendment or place the text in conflict with similar terms in the Tenth Amendment. Focusing on the actual words of the Amendment, I argue that the text of the Ninth point towards a federalist rule of construction in which the people's retained rights are necessarily left to the control of the collective people in the several states. Throughout history, those arrested for vagrancy have generally been poor men and women, often young, able-bodied, unemployed, and homeless. Most histories of vagrancy have focused on the European and American experiences. Cast Out: Vagrancy and Homelessness in Global and Historical Perspective is the first book to consider the shared global heritage of vagrancy laws, homelessness, and the historical processes they accompanied.

The family literacy model underlying the national Even Start Family Literacy Program has not fared well in large-scale evaluation studies, with outcomes showing minimal or no positive impact on later school achievement. However, the results of these studies have not been replicated in smaller studies, which hold the possibility of yielding richer and possibly more valid data using appropriate research design, methods, and techniques. This study concentrates on the voice of registered nurses as they describe their experiences of leadership within the nontraditional, non-institutional, non-hospital environment of assisted living. It further expounds upon regulatory and corporate information as context for the nurses’ leadership experiences. The desire to hear nurses describe their personal experiences of leadership influenced the decision to use grounded theory as a methodological process. The belief that voice requires context to be most effectively understood influenced, in turn, the addition of a situational analysis approach to the grounded theory methodology. A Watershed Moment: Reversals Of Tort Theory In The Nineteenth Century, Jed Handelsman Shugerman

This article offers a new assessment of the stages in the development of fault and strict liability and their justifications in American history. Building from the evidence that a wide majority of state courts adopted Fletcher v. Rylands and strict liability for unnatural or hazardous activities in the late nineteenth century, a watershed moment turns to the surprising reversals in tort ideology in the wake of flooding disasters.

Consultants are seen as core agents in the dissemination of business knowledgethrough their relative expertise and/or rhetorical and knowledge management practices.However, relatively few studies focus specifically on their role in projects with clientorganisations. This paper examines knowledge flow in consultancy projects fromlongitudinal observation and interview research as well as a survey of clients andconsultants working together. Our analysis suggests that the conventional view ofconsultants as disseminators of new management ideas to clients is, at best,exaggerated and certainly misrepresents their role in project work. Evangelicals face significant obstacles as they seek to make their publications accessible to potential readers. This study measures the extent to which evangelical scholarly journals have made their contents available in electronic form. Thirty-five journals – all active, refereed, evangelical in perspective, and published in English – were chosen for analysis. Two serials management tools and individual journal Web sites provided data regarding electronic accessibility. Twenty-six of the journals are available in some electronic form – most commonly in one or more aggregated databases. On June 20, 1863, the Wheeling Intelligencer proclaimed, “This day ushers into being the new State of West Virginia, and adds the thirty fifth star to the constellation of the American Union. To-day is the beginning of a new order of things with us here. The old Government goes out and the new one comes in.”1 With their final break from the eastern Virginia elite, West Virginians accepted a new set of laws to govern the new state and its citizens.
