A Study Of Counselor's Legal Challenges And Their Perceptions Of Their Ability To Respond, Mary A. Hermann, Debra Gail Legget, Theodore P. Remley Jr.

The authors explore the results of a study that assessed the types and frequency of legal issues encountered by counselors and counselors’ perceptions of their ability to respond to these issues. They also assessed whether the participants’ perceptions were related to practice setting, years of experience, completion of a course in ethics, recent completion of continuing education in ethics or legal issues, state licensure status, certification by the National Board of Certified Counselors (NBCC), and highest degree earned. Results demonstrate that counselors feel most prepared to deal with situations encountered most often, but that school counselors do not feel as …

This study compared a resistance training program where the exercise was uninterrupted (UT, i.e., continuous repetitions) against a resistance training program where the exercise was interrupted (IT, i.e., 3 exercise sessions during a training day) for enhancing bone modeling and bone mineral density (BMD) in maturating animals. The total volume of work performed between the two resistance training programs was equivalent by design. 24 young male rats were randomly divided into Control (Con, n = 8), UT (n = 8) and IT (n=8) resistance trained groups. Couples wishing to achieve or avoid pregnancy can now use an electronic hormonal fertility monitor to aid home fertility monitoring. The Clearplan Easy Fertility Monitor (CPFM) is a handheld monitor designed to help couples achieve pregnancy. It provides information on three levels of fertility (low, high, and peak) based on urinary threshold levels of estrogen and luteinizing hormone (LH). The monitor can be used as an aid to avoid pregnancy when used with another marker of fertility. This thesis investigates the power of language, discourse, and symbols in the dominant construction of corpulence, and how it simultaneously constricts subjectivity and offers avenues of resistance and revolt. I focus my analysis on the public protest actions of San Francisco's radical cheerleading troupe The Bod Squad. I argue that The Bod Squad's protest constitutes a counter-public sphere in its rhetorical functions of positive self-representation and public confrontation. Through their protest actions, The Bod Squad stretches dominant ideologies of corpulence to create discursive space for alternative articulations of identities, interests, and needs. There has been an incredible amount attention given to the issue of childhood obesity in America today because the prevalence and incidence rates have grown at alarming rates. When addressing this problem, there are multiple things to consider, (a) diet, (b) exercise, (c) support systems, (d) healthy behavior modification, and ( e) interest toward physical activity. This last item mentioned is of significance for the current study. In this study, adolescent children, ages 11 to 18, were asked to evaluate their interest in physical activity, specifically badminton, volleyball, and HALS Pals, during their physical education class. Injuries to the elbow are common among overhead throwers, especially in baseball players. There has been speculation that medial ulnar collateral ligament (MUCL) injuries have been increasing over the past fifteen years, however, population based estimates of MUCL injuries currently do not exist. The purpose of this study was to determine MUCL injury incidence rates derived from the National Center for Health Statistics over a three-year period. Non-identifiable, aggregate data provided by the National Center for Health Statistics were used in this study. The two main databases utilized were the NAMCS and the NHAMCS. The primary purpose of this study was to investigate the knowledge of physical activity guidelines, the perceived importance of physical activity, and the actual physical activity behaviors among college students. Comparisons according to gender, class standing, academic major, and completion of a required personal wellness course were also made. In addition, a secondary purpose of this study was to investigate the relationship between knowledge of physical activity guidelines, perceived importance of physical activity, and actual physical activity behavior. The use of physical activity measures has been used in a variety of populations with various diseases and disabilities. The use of physical activity measures has shown known-group differences in populations with neurological disease, stroke patients, and lower extremity dysfunction. Physical activity measures have been used to show health differences, recovery, and disease progression and regression. The purpose of this project was to examine if physical activity are affected by isolated upper extremity shoulder injuries which then may be used as a functional outcome measure. Thirty participants transcribed 60 words and 30 sentences spoken by persons with dysarthria. Participants, all aged 65 and older were divided into three age groups: Young-Old, Middle-Old, and Old-Old. Each group was comprised of 10 participants. Stimuli were recorded by two male speakers with differing severity levels of dysarthria. Results suggested age did affect the transcription scores, as the Young-Old participants were able to transcribe words and sentences with greater accuracy than the Old-Old participants. The severity of the dysarthric speaker also affected the accuracy of participants in transcribing their words and sentences. Utterances produced by the speaker with mild …

Increasingly, colleges and universities in the United States are adapting toward a model of behavior that incorporates issues of sustainability. This adaptation in universities and in society has implications on the organizational and nation-state level, the very core of which may serve to reshape the social contract between the two. Americans are living longer and, unfortunately, suffering from Alzheimer's dementia in greater numbers. As the population has aged, new legal issues have emerged requiring innovative resolutions. One particularly important issue facing incompetent adults is equitable access to the federal courts under diversity jurisdiction. For individuals, citizenship is equated with the individual's domicile-the place where the individual resides and to which he intends to return. Determination of incompetent adults' domicile, because such adults lack the capacity to form intention, has presented federal courts with a unique challenge when the incompetent is relocated by his or her guardian postincapacitation. Several dozen cases that can be classified as "climate change litigation" have been filed worldwide, and legal scholars have already generated a considerable amount of writing on the phenomenon. The debate and scholarship has sometimes gotten ahead of itself, reflecting on the normative implications of outcomes that are still speculative at this point. This Article seeks to ground this debate by analyzing the actual legal doctrines that may serve as bases for liability, and seeks to make a realistic evaluation of the likelihood of success of these types of suits. How do courts evaluate decisions of statutory interpretation made by government agencies that deal in environmental law? While research on judicial decisionmaking in environmental law has primarily focused on the D.C. Circuit, the Environmental Protection Agency, and the influence of ideology, only recently have legal scholars begun to consider the role of legal factors in judicial decisionmaking in environmental law. Viewed from a watershed perspective, we are unconsciously sacrificing many marine ecosystems because upstream fresh water is a regulatorily fragmented resource. That is, water is subject to multiple assertions of regulatory authority and to multiple types of use-right claims that those authorities regulate. As freshwater supplies become increasingly unequal to the task of meeting the multiple demands for both consumptive and in situ use, and as consumptive and in situ uses of water come increasingly into irreconcilable conflict, the various regulatory schemes governing water use have also increasingly come into legal conflict. Numerous statutes and the tort of wrongful discharge pur-port to prohibit companies from retaliating against employee whistleblowers. However, whistleblowers often lose retaliation lawsuits because these statutory and common law tort protections depend upon a variety of nuanced factors, such as the employer for whom the whistleblower works, the kind of wrongdoing reported, the way in which the employee blew the whistle, and, under some laws, the willingness of an administrative agency to investigate the whistleblower's claim. In Garcetti v. Ceballos, the Supreme Court held that a deputy district attorney who, as part of his job duties, raised concerns with his superiors about possibly unlawful activity and was allegedly fired in response had no First Amendment retaliation claim. In support of its conclusion, the Court suggested that adequate checks already existed at the state and federal level to curb the behavior of employers who engage in unlawful activity and to protect the employees who seek to prevent or expose such activity. This Article presents a novel approach for understanding sex discrimination in the workplace by integrating three distinct areas of scholarship: disability studies, employment law, and architectural design. Borrowing from disabilities studies, I argue that the built environment serves as a situs of sex discrimination. In the first Part, I explain how the concept of disability has progressed from a problem located within the body of an individual with a disability to the failings of the built environment in which that person functions. In 2007, private equity firms came under increasing scrutiny for the favorable tax treatment accorded to their fund managers' compensation. Labor, particularly the Service Workers International Union ("SEIU), was instrumental in bringing this issue to the attention of the media and the public. However, SEIU's private equity campaign is just one way in which the union is pursuing its primary concern: increasing the ranks of its members. This Article examines the role that the SEIU private equity campaign plays both in the overall debate about private equity taxation as well as in the union's negotiations with private equity firms. Human T-cell Leukemia Virus Type 1 (HTLV-1) is a transforming retrovirus that gives rise to Adult T-cell Leukemia (ATL) and a variety of other subneoplastic conditions such as HTLV-Associated Myelopathy/Tropical Spastic Paraperesis (HAM/TSP). In ATL, the transformation and immortalization of T-lymphocytes has been attributed to the expression and activity of a single HTLV-1 viral protein, namely the trans-activating protein Tax. Although the exact mechanism of Tax-mediated transformation is uncertain, current studies support a model in which Tax induces genomic instability in the host cell through interference with DNA repair mechanisms, dysregulation of cell cycle progression, transcriptional activation of cellular …

Liver transplantation is the only treatment of choice for chronic liver disease. The illness distress associated with liver disease and transplantation involves every aspect of the individual's life (physical, psychological, social and spiritual) and impacts the individual's quality of life, an important outcome measure of life satisfaction and well-being (Belle, Hoofnagle, Lake, Porayko & Zatlerman, 1997). Patients on the liver transplant waiting list experience a decline in functional performance or may expire while waiting.

The World Health Organization (2003) stated that "obesity is a global epidemic". The United States (U.S.) in particular has a statistically significant higher rate of obesity in children. According to the American Academy of Pediatrics (2003), 15.3% of children between the ages of 6 and 11 years old are obese as a result of unhealthy habits and routines. Because these habits and routines often begin in the home environment, health promotion activities should involve parents/guardians (Manios, Kafatos, & Mamalakis, 1998).

The purpose of this project was to identify wellness needs of adolescents with mental illness (MI) and to provide a structured program that incorporates occupational activities into wellness programming within a mental health setting.
A literature review was conducted using PubMed, EBSCOhost, PsychInfo, SCOPUS, OT search, and CINAHL to determine the need for wellness programs for this population. Resources included journals, books, websites, government agencies, and government reports.
After an extensive literature review it was found that there are a limited number of wellness programs, as well as a need among adolescents with MI, as evidenced by increasing rates of …

Le béryllium est connu pour sa grande toxicité. Il provoque, suite à l’inhalation de poussières ou de vapeurs des pneumopathies sévères (bérylliose) et des atteintes chroniques dite maladie chronique du béryllium (MCB). En moyenne, 1à 20% des travailleurs exposés deviennent sensibilisés, desquels 1 à 10 % développent la MCB. L’utilisation de gants peu adhérents force le travailleur à appliquer un effort musculaire supplémentaire pour retenir l’objet manipulé, pouvant conduire à une sensation d’inconfort, de douleur ou même à des problèmes musculo-squelettiques des membres supérieurs. L’objectif principal de cette étude préliminaire était d’explorer différentes approches pour caractériser le niveau d’adhérence des gants de protection.

Plusieurs accidents impliquant des machines automatisées sont survenus au cours des dernières années au Québec. Ce rapport a pour principal objectif de proposer une démarche pour évaluer la sécurité d’une machine automatisée, notamment une presse à injection de plastique se trouvant dans le laboratoire de sécurité des machines à l’IRSST. Cet objectif est atteint principalement en appliquant la démarche d’appréciation du risque présentée dans la norme ISO 14121 :1999 à cette machine et en identifiant les moyens de réduction des risques qui sont présents.
Des publications scientifiques sur la sécurité des systèmes automatisés ont servi pour mieux comprendre la problématique. …
