In KSR v. Teleflex, the Supreme Court examined the Federal Circuit's obviousness jurisprudence for patents. Both prior to and in this case, the Federal Circuit rigidly applied its judicially created "teaching, suggestion, or motivation" (TSM) test to determine whether the prior art would direct an inventor of ordinary skill in the art to combine references or elements in references in the same way as the patentee did. The Supreme Court, however, reversed the decision of the Federal Circuit, and held that by applying the TSM test in such a strict manner, the Federal Circuit had "analyzed the issue in a …

Background

The ascomycete fungus Cercospora zeae-maydis is an aggressive foliar pathogen of maize that causes substantial losses annually throughout the Western Hemisphere. Despite its impact on maize production, little is known about the regulation of pathogenesis in C. zeae-maydis at the molecular level. The objectives of this study were to generate a collection of expressed sequence tags (ESTs) from C. zeae-maydis and evaluate their expression during vegetative, infectious, and reproductive growth.

Results

A total of 27,551 ESTs was obtained from five cDNA libraries constructed from vegetative and sporulating cultures of C. zeae-maydis. The ESTs, grouped into 4088 clusters and 531 …

Human vulnerability can be characterized as people living with uncertain livelihood options, precariously settled in structurally unsafe buildings. A striking aspect of this vulnerability is the large number of people living in earthen structures within seismically active zones. This reality is exemplified by the earthquake which occurred this past summer around Pisco, Peru. The earthquake caused enormous damage to more than 80% of the adobe buildings. Although confined masonry is the preferred construction technique for families who can afford it, adobe is still the only economically viable alternative for most.

Nach Schätzungen der Weltgesundheitsorganisation hat die Zigarettenindustrie im vergangenen Jahrhundert mit ihren Produkten 100 Millionen Menschen weltweit getötet. Für dieses Jahrhundert werden 1 Milliarde Tote erwartet. Da der Beginn einer Raucherkarriere nahezu ausschließlich im Kindes- und Jugendlichenalter liegt, besteht auf Seiten der Zigarettenindustrie der wirtschaftliche Zwang, Kinder und Jugendliche durch offene und verdeckte Verkaufanstrengungen zu süchtigen Rauchern zu machen. Bisherige Bemühungen von Eltern, Gesundheitsinstitutionen und Regierungen, die Raucherquote von Kindern und Jugendlichen zu senken, waren nicht hinreichend erfolgreich.
