The Effects Test: Extraterritoriality’S Fifth Business, Austen L. Parrish

American laws increasingly regulate the conduct of foreigners abroad. The growth in extraterritorial laws, in no small part, can be traced to the effects test - a doctrine that instructs courts to presume that Congress intended to regulate extraterritorially when foreign conduct is found to have a substantial effect within the United States. For many scholars and lawyers, the effects test is the doctrinal lynchpin for determining the geographic reach of domestic laws. Territorial limits on legislative jurisdiction, on the other hand, are seen as anachronistic; a remnant of a pre-modern, pre-globalized world.

Potomac's Valley Shall Become A Domain We Create: Commercialism And The South Branch Valley, 1750-1800., Elizabeth Oliver Lee

Farmers in the South Branch Valley in Hampshire County, Virginia (present-day Hardy County, West Virginia), created a commercial agricultural system that made the South Branch Valley the center for beef production in eighteenth-century western Virginia. These farmers improved the traditional methods of cattle raising and driving to increase their profit and, despite the remoteness and isolation of this Appalachian region, maintained important family and economic ties to eastern markets. The first white settlers came to this frontier region with a pre-existing commercial orientation, raising livestock and other agricultural products for external markets, as well as local exchange markets. This study explores African initiatives in the small scale business sector within Kisii town and the larger region of Gusiiland in the period from 1930 to 1978. Despite the transition to a market economy with the onset of colonial rule at the end of 19th Century, African participation in trading activities within Kisii town and other market centers had remained minimal up to 1930. The slow integration of Gusiiland into mainstream colonial economic production before the 1930s was mainly attributed to its relative geographical isolation from major centers of economic production in Kenya together with the violent nature that characterized …

The law of democracy is in a state of incoherence. The experiment begun by Baker v. Carr showed great promise yet soon gave way to disappointment. The promise was one of modest review and respect for political choices made elsewhere. A presumption was still against judicial involvement: absent self-entrenchment or distrust of political outcomes, the Court would stay its hand. But, the reality has been far from that. The presumption has now clearly shifted, and the Court intervenes in politically-charged controversies as a matter of course. This raises a question at the heart of the law of democracy: can we …

What limits ought there be on a state's ability to create a homogeneous society, to increase or perpetuate non-diversity, or to create hierarchies within existing diversity? This paper examines those questions with reference to the Lieberman Plan - which proposes to transfer populated territories from Israel to the Palestine in exchange for Jewish settlements on the West Bank - as an abstract exercise in demographic transformation by the state.
First the article considers if the Lieberman plan would "work": Would it create the alterations it proposes, and would those changes achieve a stable, peaceful, even just settlement? It finds that …

This dissertation is a collection of essays that examines the importance of secure property rights institutions. Economists have long noted the importance of secure property rights to promote specialization and the division of labor through voluntary exchange. Private property provides incentives that stimulate entrepreneurship, capital accumulation, and investment that ultimately facilitate economic development. In addition, property rights also provide incentives for the conservation and preservation of resources. Each essay in this dissertation explores a particular aspect of private property rights. This study examines the concept of local food and the discourses surrounding the concept, both of which have played a significant role during Kentuckys agricultural restructuring. Since the mid-1990s, Kentucky farmers who were dependent on tobacco production began to struggle financially after the substantial reduction of quota allotments, and they were encouraged to diversify their agricultural production. Subsequently, practices of producing, marketing, and consuming locally-grown food were implemented. Drawing primarily on qualitative data, this study investigates the meanings of Kentuckys local food discourse development in four dimensions: 1) the political economy of tobacco production and the structural change of Kentuckys …

This dissertation examines rural families responses to global and local situations that have made earning a livelihood as a farmer very difficult. Drawing from original research, including a household livelihood census of 195 households, interviews with 72 people, participant observation, and archival research, the dissertation explores how rural families have responded to declines in domestic agricultural markets fueled by global and national forces and local environmental change. It asks: what impact will small farming families responses to these forces of change have on peoples identities as peasants? Early complex societies developed in the Central Andes as a result of in situ processes of culture change. However, the developments commonly associated with complex societiespermanent village settlement, monumental architecture, intensive agriculture, and institutionalized stratificationwere neither uniformly nor simultaneously adopted. Rather, they appear to have been the result of different trajectories that initially were tied to changes among populations in certain circumscribed areasoften within individual valley systems. In the 2002 national elections in Turkey, the Adalet ve Kalkınma Partisi (AKP) won a majority of parliamentary seats and the leadership of all government ministries. Viewed by many voters as an alternative to both Turkey’s Kemalist establishment and the country’s Islamist political movement, this self described ‘conservative democratic’ party composed of former Islamist politicians and political neophytes sought to establish a Muslim political identity that was neither Islamist nor secular. This dissertation explores the discourse used by AKP politicians as they navigated several highly charged issues involving the religion-state relationship in Turkey. This thesis concerns identity constructions among rural migrant workers in Kentucky in relation to experiences and articulations of transnational spaces, networks, and identities. It was conducted through semi-structured interviews of migrant laborers on two rural Kentucky horse farms with 13 men. In this project, the men’s identities could be seen to have access to and utilize social, economic, cultural, and familial connections across national borders. These aspects of transnational identities were contrasted and compared to aspects of these men’s masculine identities to problematize popular representations of masculinities. Homeownership and Opportunity for People Everywhere VI (HOPE VI) is dramatically changing the face of public housing. The HOPE VI program proposes to replace barracks-style and high rise apartments with a new public housing landscape built on the planning principles of New Urbanism: small-scale developments of single family homes and townhouses with front lawns and porches. Academic and governmental analyses of HOPE VI have used economic, political, and social perspectives to analyze this significant financial investment, radical landscape alteration, and change in residents lives. Imperial Knowledge And Cultural Display: Representations Of Colonial India In Late-Nineteenth And Early-Twentieth Century London, Alayna Wilburn

The cultural venue of European exhibitions in the late-nineteenth century enabled the promotion of the modern nationhoods of imperial powers. This study examines the official attempts of Britain to project its imperial power and modern nationhood through exhibits of colonial Indian “tradition” in London. It traces the historical dynamics of such Indian displays in three exhibitions: the 1886 Colonial and Indian Exhibition, the 1908 Franco-British Exhibition, and the 1924 Empire Exhibition. The juxtaposition of Indian “tradition” and British “modernity” at the exhibitions denoted India’s inferior “difference” from Britain, and thus the necessity of imperial rule in India. This paper looks at the intersections of nature and culture through a study of forest ecosystem restoration efforts in the Ouachita National Forest (Arkansas and Oklahoma). Ecosystem restoration goals are often informed by a pre-European settlement (PES) condition, with an implicit (and occasionally explicit) assertion that such conditions are both more natural than and preferable to the contemporary state. In many cases resuming pre-suppression fire regimes remains a key mechanism for achieving this restored condition. This dissertation argues that urban neoliberal programs currently formulating in the Global South are unprecedented in historical México as well as in examined practices of gentrification and globalization. In this dissertation I specifically focus on the Programa de Rescate – an urban policy being amassed in México City’s Centro Histórico as a nexus of processes of gentrification, neoliberalization, and globalization. This work re-theorizes how gentrification functions when it is implemented in the Global South – as the neoliberalization of space.

This dissertation examines factors that explain interactions between undergraduate African and African American students enrolled at one Historically Black University (HBCU). It explores beliefs, cultural and contextual factors that shed light on interactions across the two categories of students. The research 1) identifies factors that explain inter‐group interaction; 2) analyzes identified factors; and 3) examines their impact on overall attitudes, behaviors, interactions, and relations across the two groups. Identity theory and social identity theory are applied to explain interaction patterns. The Internet is often touted as a panacea for perceived deficiencies in economic development. Its space-transcending abilities, which can instantly connect producers with consumers, have the potential to cut out intermediaries and to redistribute economic surplus in a more equitable manner. Airline Networks: A Comparison Of Hub-And-Spoke And Point-To-Point Systems, Gerald N. Cook, Jeremy Goodwin

The disparity between the relative success of low-cost and network carriers since 2001 has often been attributed to the difference in route system architecture. This paper compares the economic and operational characteristics of point-to-point and hub-and-spoke route systems. It also argues that the emphasis placed on route structure obscures other differences in business models. Although U.S. low-cost-carriers are frequently characterized as operating point-to-point systems, few actually do so. As network airlines simplify their domestic products and the low-cost-carriers diversify theirs, the distinction between the two is rapidly fading.

Ethnic groups differ in rates of suicidal behaviors among youths, the context within which suicidal behavior occurs (e.g., different precipitants, vulnerability and protective factors, and reactions to suicidal behaviors), and patterns of help-seeking. In this article, the authors discuss the cultural context of suicidal behavior among African American, American Indian and Alaska Native, Asian American and Pacific Islander, and Latino adolescents, and the implications of these contexts for suicide prevention and treatment. Several cross-cutting issues are discussed, including acculturative stress and protective factors within cultures; the roles of religion and spirituality and the family in culturally sensitive interventions; different manifestations …

p>The long-term natural hydrological variability of the Slave River Delta (SRD), NWT, is not well documented and needs to be further developed to provide temporal context to understand and evaluate impacts of Slave River (SR) floodwater influence and climate variability and change on contemporary hydro-ecological doncidiotns of the SRD. Every day hundreds of newcomers begin a new life in Canada. Some are refugees fleeing persecution, others come to join family, and yet others (mostly the economic and independent categories) are seeking to make a better life for themselves. In all, since 2000 around 250,000 people have settled in Canada each year. Their backgrounds and personal histories may be widely different and each one’s experience on arrival is unique. The communities across Canada into which they integrate differ too in their character and in the manner in which they receive newcomers.
